RESOLUTION WHEREAS, a public hearing was scheduled on Monday, December 27, 1971, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Roy H. Dugan, Box 88, Gill, Colorado, requesting approval to locate a rabbitry operation on the following described property, to-wit: North 100' of Lots Fifteen (15), Sixteen (16) and Seven- teen (17), Gill, Weld County, Colorado, and WHEREAS, the petitioner withdrew his application for location of said rabbitry operation and neither was he present at the hearing, and WHEREAS, there was some opposition to the request of petitioner for the location of a rabbitry operation, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said request to locate a rabbitry operation may be authorized upon the approval of the Board of County Commissioners of Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that because of the application of Roy H. Dugan, Box 88, Gill, Colorado, to locate a rabbitry on the premises indicated above was withdrawn, there is no question before the Board to decide; consequently, the situation is moot and the application is denied. Bowles announced the matter had been tabled from the • 704 the last meeting until an inspection could be made:by members` ` of the Planning Commission. A letter from the>Humane Society stating the conditions of the operation was read by.`Mr. Bowles . At the previous meeting the Health Department had denied the application as it was not good health practice to maintain any type of raising or .feeding of animals within a town , .especially ,i '( next to a restaurant. Mrs: Kutcher stated- s.he:.lives across the alley and objects to the dead rabbits lying around . Mr. Bowles Iii b stated this was also one of the complaints of the Health Depart- "ment. Mr. Leon spoke on behalf of Mr. Dugan. Mr . Bowles stated that Mr. Dugan had. a long way to go to bring the operation up to standard and would require quite an investment and there seems to be no way this could be approved in this location. There is a licensed restaurant next to this which has been there for some time . Mr. Bowles stated the discussion is closed and felt that any time Mr . Dugan could satisfy the Health Department, he could reapply for a Special Use Permit. MOTION: By Mr. Nix to deny the application based upon the recommend - ation of the Health Department. SUBJECT : Dedication of Right-of-way LOCATION : A Part of Lot 15 , Belair Park Second Addition APPEARANCE : Richard Doyle - Mr . Pinkston DISCUSSION : Mr. Lorenson stated there is an existing house on Lot 15 . The applicants wish to convey part of the lot forr:ight- of-way on Mountair Lane in order to obtain a building permit. Belair Park is in the process of being annexed to the City. They agreed to dedicate the road so Mr. Pinkston could get a building permit within a year but give him a written easement so he could get to his property. The easement was not to be recorded . When Belair is annexed to the city, they want to form an improvement district for paving . They are willing to dedicate the ROW but would like to have the paving waived until this occurs. The City doens ' t have any plans for the road ' at this time , whether the street should dead end with a cul -de-sac or eventually extend further. - RESOLUTION : Be it therefore resolved to recommend to the Board of County Commissioners to accept . the ROW dedication and recom- mend to waive the paving for one year and if the property' is not annexed at the end of the year , or make it six months , it would be paved according to County standards but no building permit be issued unless legal council says it is within the jurisdiction of the Planning Commission . APPLICANT : Roy Dugan /-/o .7 DISCUSSION : Mr. Bowles reopeneddiscussYon regarding the application of Mr . Dugan for a rabbitry as Mr. Dugan and his legal council . appeared at this time . Previous discussion was explained to Mr. Dugan . Mr. Dugan denied the accusations in the letter from the Humane Society. Explained what he does regarding the care to-5-_ . I P I _� Mr. Lorenson stated the matter came. before t14e Planging Commission because it is a zone violation , that site, approval should have been acquired before any rabbits where placed on the site whatsoever. The Planning Commission is supposed to . be making judgment on whether it-'is compatible with surrounding ll/p� land use and it was - the staff' s recommendation that a rabbitry not be located in a town situated with housing;: entirely around it and particularly with food preparation in' the next building . . This use in any case is not compatible with surrounding land use. Mr. Paul stated he could not give approval for a rabbitry that close to a restaurant. Mr. Wickersham, council for Mr . Dugan , stated he felt the Planning Commission was being very unreasonable under the circumstances . • RESOLUTION : . Be it therefore resolved to recommend denial of the rabbitry to- the Board of County Commissioners . Motion by Mr. Clark , second by Mr. Watson . A vote of "Aye" by Anderson, Bowles , Clark , Nix, Watson and Weigand . Motion carried . SUBJECT: Hill 1N Park West APPEARANCE : Robert Zoyiopoulos . DISCUSSION : Mr. Zoyio.poulos stated he was representing Huskins and ' Associates as they were unable to be present. He stated they . are purchasing the property from Lundvalls and they would like to change 'the Planned Unit Development from a subdivision to a rental park. They will maintain the same amount of open space , and they would maintain their own streets. They would like a preliminary feeling of the Planning Commission before going ahead with plans . They would like about 5. 2 density, it is now approximately 4 units per acre . The difference would be in the width of the streets . Mr. Lorenson stated the park had been approved for a little over 400 -units , under their proposal there would be approximately a unit more per acre, Mr. Lorenson ' stated the lots would not be too much smaller because_ of the amount of land that would be used for streets in a mobile home subdivision . It was agreed the matter would be discussed at the executive meeting . ' SUBJECT: A Zone . DI'SCUSSION : Mr. and Mrs : Halley Carroll inquired about the "A" zone amendment. Mr.. Lorenson stated there would be a press release , on Wednesday, regarding the proposed amendment , the hearing to be on Monday , Nov . 22, 1971 in the County Commissioners office . . SUBJECT : Regulation books DISCUSSION : Mr. Lorenson reported the mimeograph fees are costing more to produce these books than is being- charged . ' Suggested the price be raised from 50¢ to $1 . 00. Lorenson stated the Windsor Packing Company had applied for a variance to get a building permit to expand an existing non-conforming use and he had suggested to the Boardcof Adjustment that when a variance was applied for this type of thing , that they make it conditional to a rezoning application.,:., be submitted . Mr. Lorenson read a letter from the Town of Windsor which is opposed to rezoning this area as it is - in a a flood plain zone and said in this instance he didn't feel that rezoning the area is the proper action. If the Planning Commission so desired , Mr. Yauk' s fee would be returned and the application withdrawn . MOTION : By Mr. Watson to return the fee and have the application withdrawn . Second by Mr . Weigand . A unanimous vote of "Aye" . Motion carried. SUBJECT: Regional Planning Commission - Steering Committee ' DISCUSSION : Mr. Lorenson stated that some of the towns and the • planning staffs are not being informed of what the Regional Planning Commission is doing. The professional planners feel a steering' committee should be formed made up of these plan- ners who act as staffs for these various agencies . SUBJECT : State Planning Office reorganization DISCUSSION : Mr. Lorenson stated the State Planning Office held a second meeting in Frisco. An association of professional • non-metropolitan planners was formed . They felt there is a tremendous over-lapping of functions being performed. They did an analysis of where most of these functions were and where they should be. All of the functions except two were housed in ' one department of the State government , the Division of Local Affairs . The committee suggested and made d resolution which will be presented to the State Commissioner' s meeting to the effect that the State Environment Commission and the State Land Use Commission be housed in the' same Division of Local Affairs and there be some administrative body that acts and coordinates all of these various things that have been created by the State Legislature . SUBJECT: Intern Students DISCUSSION : Mr. Lorenson states there are two intern students in the office at this time , both part time. In talking to the Agriculture Council made up of the Farm Bureau., the grange , the feeders , etc. , .a -committee has been formed of 6 people , ' who will be working' with the Planning Department to work on 707 l the agricultural part of the Comprehensive Plan. One student isn ' t being used as much as planned . For $100. 00 per month more a full time ( Ag intern student can be hired who is working on his masters . An effort is being made to strenghten a portion of the Agricultural plan to show facts of why this should remain agricultural . The Ag Council will be asked to pay this $100. 00 per month and use the student in working in coordination with them in producing this portion of the plan. SUBJECT : Weld County Data Bank DISCUSSION : Mr. Lorens.on stated the assessor and the chief account- ing officer have given their approval to sign a contract with UNC on the Data Bank. UNC is willing to go to this expense provided the County Commissioners will sign a contract which . allows our records to remain open to them to continually up- date this information. All parcels will be identified and all pertinent information related to each . SUBJECT: Stanford Research Institute DISCUSSION : Ford Foundation is willing to give us a 100% grant to do an economic study of this area . This would amount to from $100 ,000. 00 to $150 ,000. 00 . This would be in the form of consultant or staff or any combination thereof. The Regional Planning Commission has to make application for the grant. . SUBJECT : Foster & Schott Planned Unit Development DISCUSSION : Mr. Lorenson asked for a motion to sign this PUD by the Planning Commission chairman if it is legally necessary. The Planning Commission has recommended denial to the Board of County Commissioners . Mr . Nix stated it should not be signed . SUBJECT : Application for rezoning by Ralph Heinz DISCUSSION : Mr. Lorenson read a letter from the City of Brighton stating they have no objection to the rezoning but water and sewer are being used to the maximum capacity and cannot pro- vide these services outside of the city limits at this time. SUBJECT : Division of Water Resources DISCUSSION : Mr. Lorenson read a report to the County Commissioners regarding developmentsand expansion and the effect on the water resources . SUBJECT : Hill ' N Park West DISCUSSION : Ruskin & Company have an option to buy this property which has been approved for a zone change and Planned Unit Development showing a density of approximately 4 . 2 units per acre . They would like to change the Planned Unit Development and show approximately 5 units per acre . MOTION : By Mr. Weigand that the Planning Commission is not receptive to increasing the density or changing the Planned Unit Develop- ment. Second by Mr. Nix. Glen Paul stated they have a high water table and high percolation, Mr. Barrell proposed an alternate method for getting rid of the effluent rather than leaching fields . Mr . Paul stated their regulations called for the conventional type and until the other method is approved by the State Health Department he could not approve it. In this case, a restaurant within thirtyI (30) feet of the building where rabbits are maintained; and homes within a hundred (100) feet. As to the present instance; Mr. Dugan was issued an order on August 13, 1971 to clean up the building where the rabbits are maintained; and allowed thirty (30) days to accomplish this. At the end of that period and to the present date the building and premises are as dirty as when the order was issued. Box 398 gtssL€y, eofotado 80637 November 16,1971 Dear Mr. Paul, Humane Officers Stolz and Shindledecker inves- tigated a cruelty complaint brought to our attention by a woman from Fort Collins on November 15, 1971 . She was going to purchase rabbits from Roy Dugan of Gill, Colo. but hesitated because of the following deplorable conditions. 1 . Individual animals with ear lice were not isolated from healthy ones. 2. The concentration of animals is such that it actually facilitates any spreading of diseases. 3. Cage space per animal (approximately 200 total) is inadequate , nearly to the point of cramping. 4". The disposal of excretion merely con- sists of picking up the solid matter. The investigating officers felt that this case under the existing laws to be one that no action could be taken.
