M. , EAST OF STATE HIGHWAY NO. 34; AND A PORTION OF COUNTY ROAD NO. 59 BETWEEN SECTIONS 25 AND 26, IN TOWNSHIP 5 NORTH, RANGE 64 WEST OF THE SIXTH P. M. , NORTH OF STATE HIGHWAY NO. 34. • WHEREAS, a petition has been presented by Monfort Feed Lots, Inc. , Greeley, Colorado, to the Board of County Commissioners, Weld County, Colorado, accompanied with a map marked "Exhibit A", requesting the closing of a portion of County Road No. 54 along the south side of Sections 23 and 24 in Township 5 North, Range 64 West of the Sixth P. M. , east of State Highway No. 34; and a portion of County Road No. 59 between Sections 25 and 26 in Township 5 North, Range 64 West of the Sixth P. M. , north of • . State Highway No. 34; being located adjacent to property wholly owned by the aforementioned petitioner, and WHEREAS, some objections to said petition for the closing of the aforementioned portions of such County Roads have been received in the office of the Board of County Commissioners, Weld County, Colorado, and WHEREAS, the Board, after investigation of the facts and circum- stances of the petition and request for closing of the aforementioned portions of said County Roads and upon good cause shown, believes it to be in the best • interest of the County to close such portions of the aforementioned County • Roads as indicated on plat marked "Exhibit A" submitted with petition, and • WHEREAS, the Board has satisfied itself that no roadway or part thereof will be vacated so as to leave any land adjoining said roadway without an established roadway connecting said land with another established roadway. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that that portion of County Road No. 54 along the south side of Sections 23 and 24 in Township 5 North, Range 64 West of the Sixth P. M. , east of State Highway No. 34; and that portion of County Road No. 59 between Sections 25 and 26 in Township 5 North, Range 64 West of the Sixth P. The roads requested to be vacated are as follows: 1. That portion of an existing County road starting at a point located 2,500 feet east of the northwest corner of Section 26 , Township 5 North, Range 64 West of the 6th P.M. , said point being the intersection of said County road • and presently existing U.S. Highway 34; thence continuing • in an easterly direction for a distance of approximately 6,500 feet; thence continuing in a southeasterly direction for a distance of approximately 1,500 feet to a point located approximately 650 feet south of the northwest corner of Section 30 , Township 5 North, Range 63 West of the 6th P.M. , said portion of the County road encompassing a total of approximately 8 ,000 feet; • 2. In addition, Monfort Feed Lots, Inc. respectfully requests that the County Commissioners of Weld County vacate and abandon the right to construct a County road along a certain portion of a section line, such right being reserved to the County under the terms. of a resolu- tion passed by the Board of County Commissioners of the County of Weld, State of Colorado, on the 12th day of October, 1899 . The portion of that section line is described as follows: 4. From the southwest corner of Section 24, Township 5 North, Range 64 West of the 6th P.M. thence north along the section line which is the west border of said Section 24 a distance of 2,500 feet as described in blue on Exhibit A attached hereto. • In support of this request Monfort Feed Lots, Inc. hereby states that it has acquired all of the property as indicated in green on Exhibit A attached hereto. This land was acquired following approval of a . • feedlot site by the Board of County Commissioners to Monfort Feed Lots, Inc. , said site approval having been granted by the Commissioners in a resolution dated July 12, 1972. As presented at the public hearing on June 30 , 1972, the vacation of these roads is an absolute pre- requisite to the development of the feedlot; therefore, it will be impossible to construct the feedlot as approved by the Board of County Commissioners unless the said County roads are, in fact, vacated. As indicated on the attached Exhibit A, Monfort_ Feed Lots, Inc. has purchased virtually all of the land contiguous to and adjoining the said County roads and portion of the section line. Although it is its policy not to sign petitions for road vacation, the Union Pacific Railroad Company, which owns an easement for a track line through the area, has indicated that it would not,' in any manner whatsoever, oppose Monfort' s request. Indeed, the Union Pacific Railroad -Company • in cooperation with Monfort will constructa railroad Spur' facility from it's main line into the feedlot site. Greeley, CO 80631 0 ':•y <`fl 1, %7 P7 \, Monfort Feed Lots, Inc. has requested this office to furnish you with the soils information for those portions of Sections 23, 24 and 25, T5N, R64W, Weld County, Colorado, bounded by the U.P.R.R. Highway 34 and Kuner county road (See attached map) . The area in question is to be used for a cattle feeding operation. The soils are mapped as 51-B & 51-C Vona loamy sand, 1-3 & 3-5% slope; 51B-A, Vona sandy loam, 0-1% slope; 72-AB & 72-X, Valent sand, 0-3 and greater than 3% slope and 80-E-31 Terrace escarpmentsjare coarse tex- tured soils with moderately rapid to rapid permeability. These soils all have severe limitations for lagoons or holding ponds and would necessitate a blanket of impervious material. Soils mapped as X53-A, Kim loam, 0-1% slope; 55-C Ascalon sandy loam, 3-5% slope and 55A-B, Olney loamy sand, 1-3% slope, are moderately coarseato medium textured soils with moderate' to moderately rapid permeability. These soils have moderate limitations for lagoons or holding ponds. Soils mapped as 17-A & 17-B, Nunn clay loam, 0-1 & 1-3% slope and 17A-A, Nunn loam, 0-1% slope are moderately fine textured soils with moderately slow permeability. These soils have only slight limitations for lagoons or holding ponds. Soils mapped as 11B-A, Gilcrest gravelly sandy loam, 0-1% slope; 17M-B, Dacono clay loam, 1-3% slope and 23-A, Altvan loam, 0-1% slope, all have sand and gravel substratum between 20 and 40 inches. These soils have severe limitations for lagoons or holding ponds. There is very little run off from this area and it is not subject to flooding. There are two detention ponds prepared at present. One, along highway 34, is in an area mapped as Dacona clay loam which has severe limitations for holding ponds due to sand and gravel substratums between 20 and 40 inches. A pond in this area would necessitate a Burman Lorenson, April 20, 1972 2 blanket of impervious material. The other pond is proposed for the area east of the Kuner beet dump. The soils in this area (80-E-3) are little more than sand and gravel, have severe limitations for ponds and any drainage from this area flows directly into the South Platte River. The soil survey is made on the basis of 40 inch borings, although in most cases the borings are made to depths of 50 to 60 inches. The soil map should be used for general planning and does not exclude the need for on-site investigation for specific engineering purposes.
