Gentlemen: -- The road petition of divers parties residing west of Greeley for a public highway between sections 32 and 33 Tp. 6 B. R. 66 W. , having been referred to me, as well as the remonstrance which was filed against the report of the findings of the road a viewers, I am of the opinion that the first, second and third grounds set forth in the said remonstrance are proper- ly taken and can be successfully maintained. As to the fourth, fifth and sixth grounds I have not and cannot obtain sufficient knowledge upon which to base a belief. I accordingly recommend that the report of the viewers i be dissaproved, and tbn.t the matter be again referred to this board or some other board of viewers with instructr ions to them to make their report confer$o the descrip- �O tion of the land and petition, and that they call to 4c3 their assistance a surveyor as by law required, and would 2i-2 444. el - also recommend that the notice be mailed to parties in time so that it can be posted for a period not longer than that required by the statute. On motion the following resolution was unanimously passed and adopted, viz :-- WHEREAS, On September 12, 1905 there waa "filed and presented to this Board a petition signed by J. F. Moody, D. H. Barber, J. B. Dickey and numerous others, a petition for the establishment of a public highway between sections 32 and 33, Tp. 6N. , Range 66 West , and_ WHEREAS, This Board appointed viewers in relation to said road as provided by law, and WHEREAS, Said viewers reported to this Board on the 19th day of September, A. D. 1905 , and recomkended the establishment of said • highway,, and . . WHEREAS , This Board after, the coming in of said report have found that the notices purported to have been posted as ordered September 12, 1905, the day said viewers were appointed, was not posted in conformity to section 3934 of Mill Annotated Statutes for the full period of Five days preceeding the meeting of the viewers appointed by this Board; THEHBPORE BE IT RESOLVED, That in view of the foregoing facts that this Board at this time does hereby reconsider their proceedings here- tofore had upon said petition and do hereby set aside all this Board' s actions, orders and proceedings heretofore had and entered of record upon said petition, and do hereby declare the action taken on said pe- tition to be null and void and of no effect. The petition signed by J. F. Moody, D". H. ,Barber and numerous other praying for a line of road sixty feet in width, as follows, viz :-- Commencing at the Section Corners common to sections 32 and 33 Tp. 6N. , Range 66 West and sections 4 and 5, Tp. 5N. , Range 66 West and running due North along section line one mile and connecting with the present county road running east and west along the north aide of said sections 32 and 33 was again presented to the Board when the following action was taken and entered of record, to-wit :-- It appearing to the Board that the right of way for the line of road prayed for is not all granted and J. F. Moody having deposited 015.00 to pay the expense of viewing in case said road be not granted, on motion it was ordered that Robert Steele , P. W. Allen and B. C . Blanks be and they are hereby appointed viewers to meet at the starting pojnt at 10 :00 o 'clock a. m. Thursday March 15th, 1906 and view the line of road herein prayed for and file their report thereon, as requird by law, ten days before the next regular meeting of the Board, the same being Thursday, March 22, 1906. To the Honorable Board of County Commissioners of Weld County, Cob . GENTLEMEN:—We, the undersigned, Citizen of your County, respectfully represent that the necessities of the public require a County wagon road to be laid out as follows, to-wit: Commencing at Commencing at the Section corners common to sections 32 and 33, Tp. 6N. , Range 66West and Sections 4 and 5, Tp. 5N. , Range 66 West and running due North along section line One mile and connecting with the present county road running east and west along the north side of said section, 32 and 33. \\=.7' • Said road to be not less than sixty (60)feet in width.
