The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for a kennel (Cat
Rescue Shelter) in the A(Agricultural)Zone District.
This project is south of and adjacent to High 66 and is east of CR 3.
Parcel number 120729200013.
Access is from Highway 66.
ACCESS, ROADS, AND RIGHTS-OF-WAY
Access to this site is on State Highway 66 at a location approximately 680 east of County Road 3. The
Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways.
Please contact Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any
additional requirements that may be needed. (State Highway 66)
DRAINAGE REQUIREMENTS
This project qualifies for an exception to stormwater detention per Weld County Code, Section 8-11-40.1.8,
which reads, "8. Development of sites where the change of use does not increase the imperviousness of
the site."
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
The map shall be amended to delineate the following:
1. Show the approved Colorado Department of Transportation (CDOT) access(es) on the site plan and
label with the approved access permit number if applicable. (Department of Public Works)
2. Show and label the drainage flow arrows. (Department of Public Works)
3. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the
property. (Department of Public Works)
DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

3. Weld County is not responsible for the maintenance of onsite drainage related features. (Department

Environmental Health Services has reviewed this proposal for a Site-Specific
Development Plan and Use by Special Review Permit for a kennel (Cat Rescue Shelter)
in the A (Agricultural) Zone District.
There is an existing residence which will be used for the business. Water service is
provided by Longs Peak Water District and a letter was provided that indicates the
District has no issues with the change in use of the dwelling.
There is a permitted commercial on-site wastewater treatment system (OWTS) which
serves the existing residence (SP-2000068). The system was sized for a three-
bedroom residence which required a larger system than what was needed for the cat
rescue, according to the engineer design. Should the rescue revert back to a residence
the system would be adequately sized.
The application states that waste will be placed in trash bins which will be disposed of
on a weekly basis.
A Pet Animal Care Facilities Act (PACFA) license is required.
We recommend that the following requirements be incorporated into the permit as
development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.

3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
5. Any On-site Wastewater Treatment System located on the property must comply
with all provisions of the Weld County Code, pertaining to On-site Wastewater
Treatment Systems.
6. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
7. Animal and feed wastes, bedding, debris and other organic wastes
shall be disposed of so that vermin infestation, odors, disease hazards, and
nuisances are minimized.
8. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry regulations.
9. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

After reviewing documents and county records, building staff has the following comments
regarding this case:
The proposed structure to be used for the Animal Shelter (cats) was built as a 1536 sqft Single-
Family Residence in 1969. The proposed use will require a building permit for a change of use
from an existing residence to a Commercial Building for Animal Shelter.
A complete code analysis prepared by a registered design professional is required and shall be
submitted with All Commercial Building Permit Applications to Weld County. A Floor Plan shall
be submitted showing room dimensions, room uses, along with details showing compliance with
Accessibility requirements and currently adopted building codes.
Currently the following has been adopted by Weld County: 2018 International Residential Code,
2018 International Building Code, 2018 International Mechanical Code, 2018 International
Plumbing Code, 2018 International Plumbing Code, 2018 International Fuel Gas Code, 2006
International Energy Conservation Code, and 2017 National Electrical Code.
All new Commercial Building Projects require Fire District Notification (letter or email form).
Proof shall be submitted with Commercial Permit applications. Final Fire District Approval is also
required prior to issuing a Certificate of Occupancy.
Additionally, please contact building department to provide more details regarding the type of
storage and use of the accessory structure to determine if a change of use will be required.
