This letter serves as notice that L.G. Everist, Inc. has filed an application with the CO Division of
Reclamation, Mining and Safety (DRMS) to obtain a permit to mine and reclaim a site known as
Ragsdale Reservoirs. The site will be mined for the natural sand and gravel reserves and will be
reclaimed as developed water storage.
The site is approximately 703.95 acres located within portions of Sections 7, 8, 17, 18, and 19, all within
Township 2 North, Range 66 West of the Sixth Prime Meridian, Weld County, Colorado. The property
is generally bounded by Weld County Road 22.5 on the north, adjacent farms on the east, Weld County
Road 20 on the south, and the South Platte River on the west. Currently, the property has several land
uses, residential, grazing, agriculture, and oil and gas production.
As an Owner of Record of a Structure(s) within 200 feet of the mine, you are receiving this letter and
Structure Agreement (attached) as required by the Colorado Division of Reclamation, Mining and
Safety (DRMS). When a permit application is filed, DRMS rules require either:
a. The operator/applicant requests a Structure Agreement with owners of any permanent man-
made structures within 200 feet of the permit area. In the agreement, the operator agrees to
reimburse the structure owner for any damage done to their structure as a result of the mining
operation. OR
b. The operator/applicant can provide the DRMS with a Geotechnical Stability analysis which
demonstrates that any structures within 200 feet of the permit area shall not be damaged by
mining or reclamation activities occurring at the above -referenced site.
L.G. Everist, Inc. included a Geotechnical Stability analysis in its permit application to the DRMS, which
indicated that structures listed in the attached agreement will not be damaged by mining or reclamation
activities. Please be assured that if any damage occurs to your structure(s) as a result of our
operations, L.G. Everist, Inc. will reimburse you for any damage to the structure.
This notice contains a Structure Agreement and a vicinity map, which shows the area to be permitted.
Your structure(s) is/are listed in the attached agreement. Please review and return the Structure
Agreement, signed and notarized, within 30 days of receiving it, if possible. Enclosed is a stamped,
pre -addressed envelope so you can return one copy of the notarized agreement to us.

PERMITTEE / STRUCTURE OWNER AGREEMENT
The CO Division of Reclamation, Mining and Safety (DRMS), abiding by the State of Colorado, Mined Land
Reclamation (MLR) Law, requires the permit applicant/operator to agree to reimburse the owner of any
permanent man-made structure(s) within 200 feet of the permitted mining area for damage done to the
structure(s) as a result of the permitted operation.
L.G. Everist, Inc. shall be operator of the Ragsdale Reservoirs (in Weld County, Colorado), a sand and gravel
mine, which has a reclamation plan of developed water storage
Weld County Commissioners owns the following structure(s), which are located within 200 feet of the permitted
area: County Roads 20, 22, 22.5
L.G. Everist, Inc. agrees to, and certifies this agreement as follows:
The permittee, L.G. Everist, Inc., does hereby certify that the above -named Owner shall be compensated for
any damage to the above -listed Structure(s), which is located within 200 feet of the permitted area, as a result
of the mining operation known as Ragsdale Reservoirs.
A signature by the Structure Owner and a notary seal in the spaces provided below shall satisfy the MLR law
requirement. A copy of the signed notarized agreement shall be kept by L.G. Everist and the structure owner.

Structure Agreement - Ragsdale Reservoirs
The Clerk to the Board's Office received your structure agreement for Colorado Division of Reclamation,
Mining, and Safety (DRMS) Reclamation permit for Ragsdale Reservoirs. Weld County will not be executing
this agreement. Upon request, Weld County can provide our template structure agreement for execution, which
requires a slope study.
