BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, DECEMBER 28, 2020
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, December 28, 2020, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Mike Freeman, Chair
Commissioner Steve Moreno, Pro-Tem
Commissioner Scott K. James - EXCUSED
Commissioner Barbara Kirkmeyer
Commissioner Kevin D. Ross

MINUTES: Commissioner Ross moved to approve the minutes of the Board of County
Commissioners meeting of December 23, 2020, as printed. Commissioner Kirkmeyer seconded the
motion, and it carried unanimously.
CERTIFICATION OF HEARINGS: Commissioner Ross moved to approve the Certification of
Hearings conducted on December 23, 2020, as follows: 1) USR20-0029 — Bryan Kugel Living Trust, Gary
P. Kugel Trust, Kay Kugel Sachs, Troy Skogmo, Paula R. Carr Revocable Living Trust, Cynthia L. Walters
Revocable Trust, do Sunshare, LLC. Commissioner Kirkmeyer seconded the motion, which carried
unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner Ross moved to approve the Consent Agenda, as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PUBLIC INPUT: No public input was given.
El WARRANTS:
1) GENERAL WARRANTS — DECEMBER 23, 2020: Commissioner Ross moved to approve the General
Warrants, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously.

BIDS:
1) APPROVE BID #B2000197, LEGAL NEWSPAPER SERVICE FOR 2021 - CLERK TO THE BOARD'S
OFFICE: Rob Turf, Purchasing Department, stated staff recommends selecting the lowest bidder meeting
specifications, The Greeley Tribune. In response to Commissioners Moreno and Kirkmeyer, Mr. Turf
confirmed the bid amount has increased over the 2020 rates, the newspaper did confirm they have an
office in Weld County, and although the ownership transition was chaotic, the issues appear to have been
resolved. Esther Gesick, Clerk to the Board, agreed there were numerous issues following the transition
to new ownership in May, 2020, including failure to publish certain notices that resulted in delay of
hearings; however, The Greeley Tribune did agree to publish the items at no cost to remedy the situation.
She also noted most of the issues have been resolved and staff has not had any significant complaints
in the last couple of months. Responding to Commissioner Ross, Mr. Turf indicated the estimated cost
difference for The Fort Lupton Press is almost double, for a once weekly publication. Ms. Gesick clarified
The Greeley Tribune reduced to four publications per week in 2019, and this is the first cost increase for
the Greeley Tribune since 2019. Commissioner Moreno moved to approve said bid, as recommended by
staff. Commissioner Ross seconded the motion for purposes of discussion. Chair Freeman stated
although there is a significant cost difference between the two publications, he is hesitant to award the
bid to The Greeley Tribune based on the significant amount of staff time that was wasted while hassling
with their mistakes. Ms. Gesick confirmed The Fort Lupton Press currently has an office in Englewood,
Colorado, and has not yet relocated to Fort Lupton. Bruce Barker, County Attorney, stated the office is
not in Weld County, which does not meet the statutory requirement, and Ms. Gesick cited Section 27-4-
101(4) which states, "Published means a newspaper maintains an office in the county to gather news,
sell advertising, or conduct the general business of newspaper publications." There being no further
discussion, the Board reluctantly awarded the bid to The Greeley Tribune as the sole bidder who currently
meets the statutory requirements for publication.
NEW BUSINESS:
1) CONSIDER TEMPORARY CLOSURE OF CR 42 BETWEEN CRS 5 AND 7: Amy Mutchie, Department
of Public Works, requested a temporary closure of CR 42, beginning January 4, 2021, through
January 15, 2021, to replace two irrigation culverts and one drainage culvert, and she confirmed the
detour route is paved. Commissioner Moreno moved to approve said temporary closure. The motion was
seconded by Commissioner Ross and it carried unanimously.
2) CONSIDER APPOINTMENTS TO WELD COUNTY EMERGENCY MEDICAL/TRAUMA
SERVICES COUNCIL: The motion to approve said appointments was made by Commissioner
Kirkmeyer, seconded by Commissioner Ross, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
