By A H Asmus,, Deputy. //r-7 IN THE MATTEIF THE PETITION OF CERTAIN QUALIFIED ELECTORS IN THE COUNTY OF WELD AND STATE OF COLORADO TO DIVIDE SAID WELD COUNTY INTO ROAD MAINTENANCE DISTRICTS UNDER THE r PROVISIONS OF SECTIONS 5$04 TO 5B25 OF THE REVISED STATUTES OF THE STATE OF COLORADO OF 1908 AND AMENDMENTS THERETO FOUND IN SESSION LAWS 1911 AT PAGES 570 TO 575 INCLUSIVE: Said matter coming on for further hearing and consideration by- the Board upon the petition therefor heretofore filed on October II, A.D. 1912, and upon the order for hearing thereon heretofore made and entered on the llth day of October A.D. 1912, setting said matter for hearing, upon said petition, upon Tuesday, the 19th day of November A.D. 1912, and the hearing thereon having been commenced on said date and continued from time to time for further consideration and said Bard of County Comnissioners having now fully considered said petition and the order setting the same for hearing, and the published n0 tice of said hearing, and the sUfficiency of said petition, order and notice, and having fully considered the proper boundaries and locations of each of said districts, and the persons suitable to be named and appointed as directors for each of said districts, and the Board being fully advised in the presmise, and being ready to take definite, and full and complete action upon said matters, it was moved by Commissioner George A. Hodgson, seconded by Commissioner P.G.Bolander, that the follow- ing resolutions, findings and orders of and concerning said matter, and granting saidpetition, and dividing said Weld County into "ROAD MAINTENANCE DISTRICTS" and fixing the boundaries thereof and appointing three (3) persons in each district to act as the directors thereof, be adopted, found and ordered, to—wit: : WHEREAS, on the 11th day of October, A.D. 1912, a petition duly and regularly signed by a large number of the qualified electors of Weld County, Colorado, purporting to be signed by more than Thirty-five per-cent. (35 0/0) of the qualified electors of said county, was presented to the Board of County Commissioners of said Weld County,praying for the organization of said Weld County into "ROAD DISTRICTS" for road maintenance under theprovisions of sections 5804 tO 5825 inclusive of the revised statutes of 190B, and the amendments thereto found in the Session Laws of 1911, at pp. 570 t. 575 inclusive, which petition appeared to be in oonformity with said laws and the same was duly filed with thi0Clerk of said Board on October 11, 1912, and on said date by order of the Board of County 1 424 . __ _ _ Commissioners, Tuesday the nineteenth (19th) day of November,A.D. 1912, was appointed and sot as the day for hearing thereon before said Boarq/of County Commissioners at their office in the Court House in Greeley, Colorado, and the County Clerk and ex—officio Clerk of said Board, was further ordered to give notice of the time, date anciplace of said hearing, by printing a nOt,ice of said hearing in THE WELD COUNTY REPUBLICAN, a legal newspaper published in said county; and WHEREAS, notice of said hearing was duly published in said Wold County Republican for four successive weeks, the first publication thereof being upon the 24th day of October, and the last publication thereof on the 14th day of November, A.D. 1912, as fully appears from proof and affidavit of publicat ion of said notice made and filed in said matter; and WHEREAS, hearing upon said matter was duly and regularly begun and held on said 19th day of November, A.D. 1912, but the Board then being unable to complete the same and fully and properly consider the same , said matter was duly and regularly continued from time to time , and further hearings held thereon, and further consideration given thereto, and said hearing now being completed, and the Board of County Con issioners having fully considered the same, as well as the proper boundaries for said "ROAD MAINTENANCE DISTRICTS" and the persons suitable to be named and appointed Director for each of the districts hereby and herein created, and the Board having fully considered all of said matters and being fully advised in the premises, and being now ready to act thereon, NOW THEREFORE, said Board of County Commissioners of Weld County, does hereby find and declare that said petition heretofore filed herein is in all particulars regular, and is in due form and sufficient, as a petition under the laws of the State of Colorado, to authorize said Board of County Commissioners to organize and create "ROAD MAINTENANCE DISTRICTS" within said county4nd to divide all of said county into such di:stricts for the purposes therein stated and as by law. provided, and that said petition is duly and regularly signed by more than thirty—five (35°/°) per cent. of the qualified electors of said Weld County, and that said petition should be approved, granted and allowed, and that said county should be divided into "ROAD ,'AINTENANCE DISTRICTS" as by law provided and that said Board of County Commissioners should organize said districts by fixing the boundaries thereof, and appointing three (3) suitable persons in each district as the directors thereof. BE IT FTJRTIER RESOLVED AND ORDERED and the county clerk is hereby directed to procure an additional recoA book to be known as "ROAD MAINTENANCE DISTRICTS OF WELD COUNTY" in which bOOk shall be recorded this resolution creating road districts and all changes and alterations in the boundaries of road districts hereafter made pursuant to provisions the statutes, and in said book shall be also recorded a rap of each road district made by the county surveyor showing the boundaries of each road district and all school districts comprised therein as hereinbefore stated, which map of each district is hereby approved, and made the 'official map' of said district, which said book of records shall be su_plemental to the ordinary records of/said Board of County Commissioners in all matters pertaining to said 'Raid Maintenance Districts. ' AND FURT.t1h_t IT IS ORDERED that a certified copy of this resolution to which shall be annexed true copies of said maps of said road maintenance districts numbers one to thirty—three inclusive, shall be filed in the offioe of the county clerk and recorder as an additional record thereof and of the proceedings had creating said road districts. BE TT FURTHER RESOLVED AND ORDERED that twenty—five (25°V°) per cent. of the amount of the taxes collected during the year 1913 upon the levy made for the year 1912 in each of said road districts for road and bridge purposes be, and the same is h, reby set aside for the use and benefit of each . of said road districts, and that the County Treasurer is hereby authorized and directed to pay over to th4roper officer of each road district twenty—five (25°7°) per cent. of all moneys colleoted on i i 433 on aoc cunt of any tax levied in 1912, payable in 1913, for road and b.'idge purposes, in each of said districts, and that thereafter said districts make and levy their own tax within each district as by law provided. IT IS FURTEER ORDERED that beginning with the year 1913 the County Assessor levy and extend on all property within each road district such taxes as said district or its proper officers ',ball authorize and direct for the purposes of providing funds for the maintenance of rpd.ds within said district. Said resolutions, findings, and orders having been fully considered in all their parts, the roll was called, and the vote thereon resulted as follows: YEAS Commissioners G.A.Hodgson, P.G.Bolander and W. C.Levis. NAYS NONE. It appearing that all of the members of the Board of County Commissioners have voted in favor of said resolutions, findings, , and orders, it was thereupon declared to have been adopted unanimously � IN THE MATTER OF THE APPOINTMENT OF A COUNTY / SUPERINTENDENT OF ROADS AND BRIDGES: Said matter coming on for consideration and the Board having fully considered the matter and deeming that it was for the best interest of the County that a Civil Engineer should be appointed to said office, it was moved by Commissioner G.A.Hodgson, p seconded by Commissioner P.G.Bolander, that Allen G. Lincoln, the present County Sur;reyor be and he hereby is appointed COUNTY SUPERINTENDENT OF ROADS AID BRIDGES beginning with January 1st 1913 and continuing for the period of onelyear at a compensation of $5.00 per day for each day actually employed in the duties of said office, but said empltyment' shall not exceed 200 days in the said year unless by special order of the Board of County Commissioners hereinafter made requiring said additional work . ,5-7 IN TEE MATTER OF FIRE INSURANCE ON COUNTY BUILDINGS: Coming on for consideration and it appearing that Moses & Kinsella have failed to carry out their proposition of April 7 1912, in regard to Fire Insurance policies and having flailed to return the Fire Insurance Policies withdrawn on May 7,1912 for said purposes whereby a great confusion has arisen in regard to Fire Insurance Palieies on the County BuilDings, It was moved by Commissioner Hodgson seconded by Commissioner Bolander and unanimously carried that said proposition of Moses & Kinsella dated April 7 1912 and approted May 7, 1912 be and the same is hereby recinded, cancelled and held for naught upon the ground that said Moses & Kinsella have failed to perform and carry out the same as therein proposed and that said Moses & Kinsella be and are heresy ordered to return all fire Insurance Policies of the County of Weld in their hands or reoeived by them on May 7, 1912. 434 r , This completing the business for the day an adjournment was ordered taken to and until 9 o'clock a.m. Monday January Gth, A.D. 1913. • 9,A1Z Chairman of hoed. RESOLVED, by the By and of County Commissioners of Weld County, Colorado, that the services of Hon. Albert J. Luther, to Weld County have been such as to deserve marked recognition by t' is Board. His eighteen months honorable service for our Country as Lieutanant of Volunteers in the Phillipines during the Spanish American war has been followed by thirteen years equally meritorious conduc0 in the service of this county. Two years of this time he was deputy County Clerk and Recorder, seven years deputy and Aoting Clerk to the Commissioners and four years County Clerk and Recorder. In all of these positions he has won highest esteem by unfailing courtesy, unflinching integrity and intelligent action, resulting in the highest degree of efficiency. It is the desire of this Board to register its appreciation of Mr Luther's Character and services; it is therefore ORDERED that this resolution be spread upon the records of this offioe, and that a copy thereof, signed by the individual members of the Board severally be presented to Mr. Luther as a testimonial of our esteem. Situation for the year 1912. Aocording to agreement the said A W. Soribner appeared before the Board for the reason and purposes heretofore stated, and offered to make a settlement of said taxes on a basis of one fourth valuation. The Board after a full hearing in the matter and upon due oonsideration, decided upon motion duly made and unanimously oarried not to make any onoessions whatever to the said Railroad Company in the matter of compromise settlement of taxes 'or the year of 1912,. as far as valuations were concerned, and in no other respect, except if there be some erroneous assessment, whioh might be sufficient grounds for the consideration of a petition for a rebate of taxes made upon suoh an assessment. 43 IN THE MATTER OF C B eoc Q RY COMPANY TAXES FOR THE YEAR 1912. /// Upon this day there appeared before the Board of County Commissioners a represenative of the C B & Q Ry Co, requesting that the Board consider the matter of taxes erroneously assessed in Sohool Districts of the Third Class. It being claimed by this Represenative of the said Railroad Company, that the Act by which Third Class School districts re authorized to, levy 20 Mills, having originated in the Senate, as is shown on Page 5B5 or session Laws of 1911, was unconstitutional, and that such being a fact, the Said Railroad Company did not believe that they should be required to pay taxes thus erroneously assessed. After a full hearing on the subject the Board of County Commissioners deoided, upon motion duly made and unanimously carried, to take the matter under advisement with the County Attorney, and to further advise in the matter at a later meeting. The temporary organization was made permanent, and the following resolutions were read and adopted: • RESOLUTION NO 1 RESOLVED, That we consider that the paramount need of Colorado is good roads, and plain and concise laws governing the County Commissioners of the several Counties of the State of Colorado. RESOLUTION NO 2 RESOLVED, That the system of primary roads in all sections of the State, as shown on the plat and record of the State Highway Commission, meets with our fullest approval, and we urge Legislation that shall imnediat ly disburse the accumulated and accumulating monies of the internal and improvement Rind, Vy universal and fair distribution thereof, and for quick response to the wishes of ''the people, we urge expeditious action, by both the House and Senate of our Legislature new in session. RESOLUTION NO 3 RESOLVED, That the general laws of Colorado relating to Public Highways should at once be revised, and we urge the immediate creation of a Legislative Committee chosen from the .Coatissioners of the State ,to confer with a. similiar committee of the Good Roads Association, and to formulate a comprehensive and explicit general Highway Law. RESOLUTION NO 4 RESOLVED, That the subject of co-operation of the State and Federal Goverment in the expenditures of monies on such of the public raodsas shall be aided by the Federal Goverment is an important one, and it is the sense of this Convention that the several Counties of the State should offer the National Goverment the expenditures of at least 100 .00 to each dollar provided by the Goverment. RESOLUTION NO 5 RESOLVED, That we recommend the appointemnt of a permanent committee of five of which the President and Secretary of this Association shall be members, to confer with the joint Congressional Committee on the construction and maintainance of Postal routes in the State of Colorado. RESOLUTION NO 6 RESOLVED, That it be the sense of this Convention that we recommend the re—classification of the various Counties of this State, and the matter of said classification be referres to the Legislative Committee. RESOLUTION NO 7 RESOLVED, That it is the sense of this Convention that the present Legislature should provide for equitable and specific salaries for County Commissioners, which shall reasonably compensate the responsibility and actual work done, and to that end recommend salaries as follows: Counties- of the first class 2400.00 Counties of the second Class 00.00 Counties of the third olass 1500.00 Counties of the fourth class 200.00 Counties of the fifth class either $ 800.00 ' :or per diem as is now by law provided, and further, that in art event the present limitation on ' the anual amount of per diem of Counties of the third and, fourth class be repealed. • RESOLUTION NO 8 WHEREAS, The 18th General Asembly passed a Water Commission bill satisfactory to the majority of the Counties of the State, and WHEREAS, The same was vetoed by the Govenor, and, as, we believe to the detriment of the majority of the Counties interested; therefore be it RESOLVED, That it is the sense of this Convention that a law sheUld be enacted at the earliest possible date similiar to the: one vetoed: RESOLUTION NO 9 RESOLVED, That a copy of the foregoing resolutions be f'urnsihed the Commissioners of each County and that it be spread on the Commissioners record, and that a certified copy thereof be t furnished by the various Boards of County Commissioners to their Senators and Represenatives with t ! a request that each of them shall support the measures looking to ,thepassage of good and sufficient laws to accomplish the purposes therein recommended.
