NOTICE IS HEREBY GIVEN that a Petition for Annexation and concurrent zoning request by Sandy Ochoa and surrounding property
owners of territory hereinafter described has been presented to the Town Board of Ault, Colorado and found to be in substantial
compliance with the applicable provisions of law. At a Special Meeting of the Town Board of Trustees, held on November 4, 2020,
action was taken adopting Resolution 2020-14, to set the review with the Planning Commission on Wednesday, December 2, 2020,
6:00 p.m., and set a public hearing for Wednesday, December 9, 2020 at 7:00 p.m. at Ault Town Hall Council Chambers, 201 1n
Street, Ault, CO, to receive evidence and determine whether the proposed annexation meets all legal requirements and is in the
best interests of the Town of Ault, and to consider the Initial Zoning.
The proposed Annexation encompasses:
OCHOA ANNEXATION
A parcel of land being a portion of the East Half of Section Eleven (11) and the West Half of Section Twelve (12), Township Seven North (T.7N.), Range Sixty-six
West (R.66W.), Sixth Principal Meridian (6th P.M.), County of Weld, State of Colorado:
COMMENCING at the East Quarter Corner of said Section 11 and assuming the East line of the Northeast Quarter of Section 11 as bearing North 00° 13' 12" West a
distance of 2734.17 feet with all other bearings contained herein relative thereto:
THENCE South 02° 28' 14" East along the East line of the Southeast Quarter of said Section 11 a distance of 9.10 feet to the Northerly line of the Map of the Official
Survey of the Town of Ault recorded October 28, 1904 as Reception No. 98517 in the Records of Weld County and to the POINT OF BEGINNING.
THENCE South 89° 35' 46" West along the Northerly line of the Map of the Official Survey of the Town of Ault a distance of 30.02 feet to the Northwesterly corner of
said mapping;
THENCE South 02° 28' 14" East continuing along the Westerly line of said Map of the Official Survey of the Town of Ault a distance of 4.28 feet to the Northeasterly
comer of the Map of Graefe's Seventh Addition to the Town of Ault as recorded February 3, 1960 as Reception No. 1322234 in the Records of Weld County;
THENCE South 88° 39' 46" West along the Northerly line of said Graefe's Seventh Addition a distance of 300.00 feet to the Easterly line of Graefe's Eighth Addition
recorded March 23, 1973 as Reception No. 1609716 in the Records of Weld County;
The following three (3) courses are along the Easterly, Northerly and Westerly lines of said Graefe's Eighth Addition
THENCE North 02° 28' 14" West a distance of 10.00 feet to the Northeasterly corner of said Graefe's Eighth Addition;
THENCE South 88° 39' 46" West a distance of 260.00 feet to the Northwesterly corner of said Graefe's Eighth Addition;
THENCE South 02° 28' 14" East a distance of 130.24 feet to a Northeasterly corner of Ault West recorded April 6, 1979 as Reception No. 1786675 in the Records of
Weld County;
THENCE South 88° 39' 46" West along a Northerly line of said Ault West a distance of 10.00 feet;
THENCE North 02° 28' 14" West a distance of 143.30 feet the most Northerly Northeast corner of Ault West and to the Southerly line of Buckeye Annexation # 1
recorded April 13, 2017 as Reception No. 4293552 in the Records of Weld County;
THENCE North 89° 37' 56" East along the Southerly line of said Buckeye Annexation #1 a distance of 570.29 feet;
THENCE North 00° 13' 12" West along the Easterly line of said Buckeye Annexation #1 a distance of 350.96 feet to the Southwesterly Right of Way line of Colorado
State Highway 85 and the Union Pacific Railroad Company;
THENCE South 16° 46' 52" East along said Southwesterly Right of Way line a distance of 365.67 feet to the North line of the Southeast Quarter of Section 12;
THENCE South 16° 46' 52" East continuing along the Southwesterly Right of Way line of said Colorado State Highway 85 and United Pacific Railroad Company a
distance of 9.63 feet to the Northerly line of said Map of the Official Survey of the Town of Ault;
THENCE South 89° 35' 46" West along the Northerly line of the Map of the Official Survey of the Town of Ault a distance of 76.62 feet to the East line of the
Southeast Quarter of said Section 11 and to the POINT OF BEGINNING.
TOTAL ANNEXED AREA for the Ochoa Annexation is 0.65 acres, more or less (f).

RESOLUTION NO. 2020-14
A RESOLUTION REPEALING RESOLUTION 2020-11 FINDING THE PETITION FOR
ANNEXATION SUBMITTED BY SANDY OCHOA TO BE IN SUBSTANTIAL
COMPLIANCE WITH C.R.S. 31-12-107 AND SETTING A HEARING BEFORE THE
BOARD OF TRUSTEES TO CONSIDER ANNEXATION
WHEREAS, a written petition has been re -filed with the Town Clerk requesting the annexation
of certain property to be known as 729 Hwy 85 AND a strip of land on the north side of
properties being 203 Jackie Ann, 201 Jackie Ann, 105 Jackie Ann, 103 Jackie Ann and 100
Jackie Ann; and
WHEREAS, the Board of Trustees for the Town of Ault desires to initiate annexation
proceedings in accordance with the Municipal Annexation Act, Section 31-12-101, et seq.,
Colorado Revised Statutes; and
WHEREAS, the Board of Trustees must set a public hearing to determine if the proposed
annexation complies with the Town of Ault Land Use Code.
IT IS THEREFORE RESOLVED by the Board of Trustees of the Town of Ault, Colorado,
this 4th Day of November 2020, as follows:
1. That the Board hereby accepts the annexation petition for the remaining portion of the
parcel for 729 Hwy 85 and the north portion(s) of the above -named properties; and
2. That the Board hereby finds and determines that the annexation petition is in substantial
compliance with the requirements of C.R.S. 31-12-107(1), Section 30 of Article II of the
Colorado Constitution in that the annexation petition contains the following:
(a) An allegation that it is desirable and necessary that such area be annexed to the
municipality;
(b) An allegation that the requirements of Colorado Revised Statutes sections 31-12- 104
and 31-12-105 exist or have been met;
(c) An allegation that the signers of the petition comprise more than fifty percent of the
landowners in the area and own more than fifty percent of the area proposed to be annexed,
excluding public streets and alleys and any land owned by the annexing municipality;
(d) The signatures of such landowners;
(e) A request that the annexing municipality approve the annexation of the area proposed
to be annexed;
(f) The mailing address of each such signer;
(g) The legal description of the land owned by such signer;
(h) The date of signing of each signature; and
(i) The affidavit of the circulator of such petition that each signature therein is the
signature of the person whose name it purports to be.

3. That the Board of Trustees finds and determines that the annexation map accompanying
the annexation petition for 729 Hwy 85 AND a strip of land on the north side of properties being

is in substantial compliance with the Municipal Annexation Act in that the map contains the
following:
(1) A written legal description of the boundaries of the area proposed to be annexed;
(2) A map showing the boundary of the area proposed to be annexed;
(3) Within the annexation boundary map, a showing of the location of each ownership
tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat
numbers of plots or of lots and blocks;
(4) Next to the boundary of the area proposed to be annexed, a drawing of the contiguous
boundary of the annexing municipality and the contiguous boundary of any other municipality
abutting the area proposed to be annexed.
4. That the Board of Trustees desires to initiate annexation proceedings in accordance with
law.
3. That the Notice attached be adopted as a part of this Resolution. The Notice establishes
the date, time, and place a public hearing will be held to determine if the proposed annexation
complies with section 30 of article II of the Colorado Constitution and sections 31-12-104 and
31-12-105 of the Colorado Revised Statutes or such provisions thereof as may be required to
establish eligibility under the terms of the Act. The Town Clerk is directed to publish a copy of
this Resolution and Notice as provided in the Act.
