The agreement is for $600 per month. The lease term expires August 31, 2020. Attached is a lease extension through May 31, 2021, until the current Academy completes its coursework. Sincerely, Toby Taylor Director cc &ACTT I SG) Ors/IalW 00/0%0 2 167- ./©©3 3 Go02 I CONTRACT AMENDMENT BETWEEN THE COUNTY OF WELD AND THE FIRST UNITED METHODIST CHURCH OF GREELEY This Agreement Amendment ("Amendment"), made and entered into(O aay of 2020 by and between the Board of Weld County Commissioners, on behalf of the Weld County Sheriff's Office, hereinafter referred to as the "Tenant", and First United Methodist Church of Greeley, hereinafter referred to as the "Landlord". WHEREAS the parties entered into an agreement (the "Original Agreement") identified by the Weld County Clerk to the Board of County Commissioners as document No. 2019-4003 approved on 09-09-2019. WHEREAS the parties hereby agree to amend the Original Agreement in accordance with the terms provided herein. NOW THEREFORE, in consideration of the premises, the parties hereto covenant and agree as follows: • The Amendment, together with the Original Agreement, constitutes the entire understanding between the parties. The following change is hereby made to the Lease Documents, which shall be effective upon the expiration of the current term of the Original Agreement: 1. Landlord agrees to the provide the classroom space & services described in the Original Agreement for the extension of time beginning 09-01-2020 thru 05-31-2021. 2. Tenant agrees to compensate Landlord for said services in accordance with the Original Agreement for this extension of time. • All other terms and conditions of the Original Agreement remain unchanged. Box 758, 1150 O Street, Greeley, Colorado 80632, on behalf of the Weld County Sheriff's Office, hereinafter referred to herein as "Tenant." WITNESSETH: That in consideration of the payment of the rent and the keeping and performance by Tenant of the covenants set forth in this Lease Agreement, Landlord hereby leases unto Tenant the following described premises, situated in the County of Weld and in the State of Colorado, to -wit: A classroom located in the First United Methodist Church building located at 917 10th Avenue, Greeley, Colorado, hereinafter referred to as "the Premises." Tenant shall obtain and maintain at all times during the tenancy of this Lease commercial general liability insurance, naming the Board of Trustees of the First United Methodist Church of Greeley as an Additional Named Insured. At the start of the tenancy of this Lease, Tenant shall provide to Landlord a current Certificate of Insurance which evidences such insurance and lists the Additional Named Insured. Furthermore, the parties hereto agree as follows: A. The term of this Lease shall be from September 1, 2019, to and until August 31, 2020. B. Either Landlord or Tenant may terminate this Lease at any time during the term hereof for any reason by notifying the other Party in writing of such intent to terminate at least sixty Page 1 of 3 Pages (60) days prior to the intended date of termination. C. Tenant is leasing the Premises "as is." D. If any provision of this Lease, or any application thereof to any person, shall be invalid or unenforceable to any extent, the remainder of this Lease, and the application thereof to other persons or circumstances, shall not be impaired, and shall be enforced to the fullest extent permitted by law. E. This Lease shall be governed by the laws of the State of Colorado. F. This Lease, including any attachments and documents specifically incorporated herein by reference, contains the entire Lease between the parties. All prior negotiations between the parties are merged in this Lease, and there are no understandings or agreements other than those incorporated herein. This Lease may not be modified except by written instrument signed by both parties. G. It is expressly understood and agreed that the enforcement of the terms and conditions of this Lease, and all rights of action relating to such enforcement, shall be strictly reserved to both parties and nothing in this Lease shall give or allow any claim or right of action whatsoever by any other person not included in this Lease. It is the express intention of both parties that any person or entity other than the undersigned parties receiving services or benefits under this Lease shall be an incidental beneficiary only. H. No portion of this Lease shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any portion of this Lease be deemed to have created a duty of care which did not previously exist with respect to any person not a party to this Lease.
