RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR BED BUG MITIGATION AND
AUTHORIZE CHAIR TO SIGN - GREELEY TRANSITIONAL HOUSE, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for Bed
Bug Mitigation between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Human Services, and the
Greeley Transitional House, Inc., commencing January 1, 2020, and ending December 31, 2020,
with further terms and conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding for Bed Bug Mitigation between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Human Services, and the Greeley Transitional
House, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 13th day of May, A.D., 2020, nunc pro tunc January 1, 2020.

RE: Memorandum of Understanding (MOU) with the
Greeley Transitional House, Inc. (Transitional
House)
Please review and indicate if you would like a work session prior to placing this item on the
Board's agenda.
Request Board Approval of the Department's Memorandum of Understanding (MOU)
with the Greeley Transitional House, Inc (Transitional House). The Department purchased a
commercial clothes dryer that has been installed at the Transitional House. Department and
Transitional House staff will utilize the dryer for the sole purpose of treating client belongings
infested, or potentially infested, with bed bugs. The MOU further outlines the responsibilities of
both parties with respect to training, access to equipment, utility costs, and equipment repair and
maintenance.
The term of this MOU will be January 1, 2020, through December 31, 2020.
I do not recommend a Work Session. I recommend approval of this MOU and authorize the Chair to sign.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE WELD COUNTY DEPARTMENT OF HUMAN SERVICES
AND THE GREELEY TRANSITIONAL HOUSE, INC.
THIS MEMORANDUM OF UNDERSTANDING is entered into this 1 day of t , 2020 by
and between the Board of Weld County Commissioners, on behalf of the Weld County Department of Human
Services, hereinafter referred to as "Weld County"; and The Greeley Transitional House, Inc. hereinafter referred
to as "Transitional House".
WITNESSETH
WHEREAS, Weld County has purchased a commercial clothes dryer for the purpose of assisting with bed
bug mitigation; and
WHEREAS, the Transitional House has an appropriate location for the installation of this commercial
clothes dryer located at 1206 10' Street, Greeley CO 80631; and
WHEREAS, placement of the dryer at the Transitional House will allow staff members of both Parties to
use the dryer for bed bug mitigation only for clients affiliated with either Party;
NOW, THEREFORE, in consideration of the premises and mutual promises and covenants herein
contained, the Parties agree as follows:
Term of this Memorandum of Understanding
This Memorandum of Understanding ("MOU") shall be effective beginning January 1, 2020 and shall end
December 31, 2020.
Bed Bug Mitigation
A commercial clothes dryer has been purchased by Weld County and has been installed at the Transitional House.
This dryer may only be used by approved employees of either Weld County or the Transitional House to dry
clothing and other appropriate belongings (stuffed toys, blankets, towels, etc.) of clients of either Party to control
for bed bugs. This equipment is not to be used as a substitute for a regular clothes dryer or used by staff members
of either Party for personal use.
Responsibilities of The Transitional House
The Transitional House agrees as follows:
1. To utilize the clothing dryer for bed bug mitigation only for clients of Transitional House.
2. To train all staff members to utilize the equipment as directed by the manual.
3. To maintain the equipment to be operational.
4. To be responsible for payment for all needed repairs for the equipment.
5. To pay for the utility costs associated with running the equipment.
6. To allow Weld County staff members to have access to the equipment at any time required. The
equipment will be made available twenty-four hours a day, seven days a week, including holidays.
7. To work cooperatively with Weld County staff members if use of the equipment is needed at the same
time by both Parties.
8. To inform Weld County if there is an issue with the equipment or if the equipment is down for repairs.

Responsibilities of the Weld County
Weld County agrees as follows:
1. To utilize the clothing dryer for bed bug mitigation only for clients of Weld County.
2. To train all staff members to utilize the equipment as directed by the manual.
3. To work cooperatively with Transitional House staff members if the use of the equipment is requested at
the same time by both Parties.
4. Staff will stay on the premises when the dryer is in use and will not leave items at Transitional House
unattended. Weld County staff will not ask staff of the Transitional House to complete the drying process
or to handle any of the belongings brought in by Weld County staff members.
General Provisions
1. No term or condition of this MOU shall be construed or interpreted as a waiver, express or implied, of any
of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity
Act §§24-10-101 et seq., as applicable now or hereafter amended.
2. It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and
all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and
nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not
included in this MOU. It is the express intention of the undersigned parties that any entity other than the
undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only.
