Planning Question:
1. Explain, in detail, the proposed use of the property. Include, at a minimum, the following:
a. Type of use for which the application is being made.
The applicant is hoping to operate a small granite fabrication business from an existing building at the west end
of his property.
No sign is being requested.
b. Current or previous use of the ;and, if any.
The applicant currently lives in the single family residence located on the site.
include a statement delineating the need for the proposed use.
The business will be a beneficial employment opportunity while having little if any impact on the surrounding
properties.
d. Describe the uses surrounding the site and explain how the proposed use is compatible with them.
The surrounding properties are primarily agricultural Recorded Exemption lots. There should be very limited
impact on the surrounding properties. The business is operated from within the building limiting noise. Storage of
the granite will be screened from most of the surrounding properties by the existing building. Additional fencing
will be erected if deemed necessary.
e. Describe the proximity of the proposed use to residential structures.
Multiple residences lie to the north and south of the building. Their locations are shown on the attachment.
f. Describe the hours and days of operation (e.g. Monday thru Friday 8:00 am. to 5:00 pm.
The hours of operation are from 8 am. to 5 pm. Employees may arrive as early as 7:00 am. and leave as late as
6:00 pm.
g. Describe the number of shifts and the maximum number of employees per shift.
The business employs two people in addition to the applicant. There are no shifts.
h. Describe the maximum number of users, patrons, members, buyers or other visitors that the use
by special review facility is designed to accommodate at any one time.
Customers do not visit the site. There are occasional deliveries and trash pick-up.
i. List the types and maximum numbers of animals to be on the site at any one time (for dairies,
livestock confinement operations, kennels, etc.).
Not applicable.
j. List the types and numbers of operating and processing equipment to be utilized.
The majority of the stone cutting will utilize a saw with a water recycling system to limit dust. Any dry cutting or
stone polishing is done with a vacuum system. A small compressor is usedwhile polishing the stone_ There is
also a fork lift used for moving the stone.
lc. List the types, number and uses of the proposed structures to be erected_
No additional structures are being proposed.
I. Describe the size of stockpile, storage or waste areas to be utilized, if any.
Stone storage will be located on the southeast side of the business.
m. Describe the method and time schedule of removal or disposal of debris, junk and other wastes
associated with the proposed use.
Fines collected by the recycling system in the cutter and within the vacuum system are sent every two weeks to
a Total Disposal for recycling. Everyday trash is disposed of weekly by ARC.
n. Include a time table showing the periods of time required for the construction of the operation.
The business is operating at this time.
a Describe the type of lot surface proposed and the square footage of each type (e.g. asphalt, gravel,
landscaping, dirt, grass: buildings).
The building is located at the west side of the property in an area that is separated from the residential use by a
fence. This area is planted in approximately 174,000 sf of pasture grass. The buildings cover approximately
5,000 sf. The parking area and road are approximately 11,400 sf covered in road base.
p. How many parking spaces are proposed? How many handicapped (ADA) parking spaces are
proposed?
Ten parking spaces are proposed.
q. Describe the proposed screening for all parking and outdoor storage areas.
The Stone will be stored on the southwest side of the building which will screen it from most residences.
Additional fencing can be added if deemed necessary. The residence to the south of the storage area is owned
by a family member
r Describe the existing and proposed landscaping for the site.
None is being proposed.
s. Describe the type of fence or other screening proposed for the site.
No screening is being proposed_ if deemed necessary wood fencing will be added around the stone storage
area.
t. Describe reclamation procedures to be employed as stages of the operation are phased out or
upon cessation of the Use by Special Review activity.
There will be no reclamation required.
Li. Describe the proposed fire protection measures.
The application includes an informational sheet that shows information that would be necessary in the case of an
emergency. The applicant will attempt to comply with any Brighton Fire District requirements. Further, the
proposed use is not likely to increase the prospect of a fire on the site.
2. Explain how this proposal is consistent with the Weld County Comprehensive Plan.
Section 2 - -2U GA oal 7. County land use regulations should protect the individual property owner's right to
request a land use change.
.A. Policy 7.2. Conversion of agricultural land to non -urban residential, commercial and industrial uses
should be accommodated when the subject site is in an area that can support such development, and
should attempt to be compatible with the region.
The stone work will be conducted within a building, where noise will be very limited. Storage will he located in an
area screened by the existing building. Additional fencing can be added if deemed necessary. Traffic from the
business will be minimal.

3. Explain how this proposal is consistent with the intent of the zone district in which it is located. (intent
statements can be found at the beginning of each zone district section in Article III of Chapter 23.)
Section 23-3-401 of the weld County Code allows for a Home business in the Agricultural District upon the
approval of a Use by Special Review Permit
4. Explain how this proposal will be compatible with future development of the surrounding area or
adopted master plans of affected municipalities.
The site lies within the Fort Lupton Intergovernmental Agreement area. Todd Hodges, Planning Director for the
City has indicated that the property is south of their growth boundary per their agreement with Brighton,
5. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal is located
within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Towns ices Overlay Districts)
or a Special Flood Hazard Area identified by maps officially adopted by the County.
The site does not lie within any overlay zone district or a flood hazard area.
6. If the proposed use is to be located in the A (Agricultural) Zone District, explain your efforts to conserve
prime agricultural land in the locational decision for the proposed use.
The site is not designated as prime agricultural land.
7. Explain whether this proposal interferes with the protection of the health, safety and welfare of the
inhabitants of the neighborhood and the county.
The proposed use should not affect the health, safety or welfare of the neighbors. The proposed use will have
little impact to the surrounding properties.
Environmental Health Questions:
1. What is the drinking water source on the property?
The residence on the site is serviced by a domestic well. A copy of the well permit is attached to this application.
The business can not utilize the existing residential well water. Water will be trucked in occasionally to fill the
holding tank for the saws recycling system. Bottled water will be made available for the employees.
2. What type of sewage disposal system is on the property?
The existing residential septic system is permitted by SP -0000675. The permit is attached to this application. The
building that the business will operate from does have a restroom. However, the well that services the site is
limited to residential uses so a port -a -let with a hand washing component will be installed for the employees.
3, If storage or warehousing is proposed, what type of items will be stored?
Small granite slabs will be stored outside of the building.
4. Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will occur on
this site.
A propane tank containing approximately 4 gallons is stored within a cage outside of the building. A 50 gallon
diesel container used in the compressor used to polish the stone is also stored outside of the building.
5. If there will be fuel storage on site, indicate the gallons and the secondary containment. State the
number of tanks and gallons per tank.
The propane tank contains approximately 4 gallons. The diesel container is approximately 50 gallons.
6. If there will be washing of vehicles or equipment on site, indicate how the wash water will be contained.
No washing of vehicles or equipment will be done on site.
7 . If there will be floor drains, indicate how the fluids will be contained.
Fluids from the stone cutter are collected in a floor drain then a sump pump returns the water to the holding tank.
A diagram showing the system is attached to this application.
8. Indicate if there will be any air emissions (e.g. painting, oil storage. etc.)-
Fines from the stone cutting will be contained by a water or a vacuum system.
9. Provide a design and operations plan if applicable (e.g. composting, landfills, etc.),
Not applicable.
10. Provide a nuisance management plan if applicable (e.g. dairies, feedlots, etc.).
Not applicable.
11. Additional information may be requested depending on type of land use requested.
Public Works Questions:
1. Traffic narrative.
a, The projected number of vehicle trips (average per day, maximum per day, peak hour data) to and
from the site and the type of vehicles (passenger, semi -truck, etc.),
Business associated traffic should average seven round trips per day. This would include two personal vehicles.
The business operates from a pickup or pickup with a flat bed. Peak traffic would be from 8 am. to 12 pm.
b. Describe how many roundtripsfday are expected for each vehicle type: Passenger Cars/Pickups,
Tandem Trucks, Semi-Truck/Trailer/RV (Roundt:r ip = 1 trip in and 1 trip out of site)
See a. above.
c. Describe the expected travel routes for site traffic.
Traffic will be along County Road 29 heading south to County Road 2 (168th Avenue) then west to Highway 85 or
east to Interstate 76.
d. Describe the travel distribution along the routes (e.g. 50% of traffic wilt come from the north, 20%
from the south, 30% from the east, etc.)
The traffic on County Road 2 is approximately 50% east and 50% west.
e. Describe the time of day that you expect the highest traffic volumes to and from the site.
Peak traffic would be from 8 am to 12 pm.

The business will utilize the existing access onto County Road 29.
3. Drainage Design: Design and construction of a detention pond as described in an approved Drainage
Report is required unless the project falls under an exception to stormwater detention requirements

in a drainage narrative the following:
a. Which exception is being applied for? Include supporting documentation.
Exception 8. Development of the sites does not increase the imperviousness of the site.
No additional buildings are being proposed. Further, the access to the building and parking area have existing
road base.

Water flows to a low spot at the southwest portion of the property.

Water flows from the east portion of the property to the west and southwest.

A soils report has been attached to this application. The report indicates that surface water management has
limitations. Should the Department of Public Works not accept the request for an exception an engineer will be
hired to complete a drainage plan for the site or prove that the site meets an exception.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
1) This well shall be used in such a way as to cause no material injury toexistingwatsr r rights. The issuance i permit
it
does not ti1sure me applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action,
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well construction and Pump Installation
ContractorsCcntractors in accordance with Rule 18,
3) Approved pursuant to CRS 37,.92-602(3)(b)(1) and policy of the State Engineer under the following conditions br a 7,78
acre parcel described as Lot B, County Recorded Exemption 1471 324 RE- ` `h7, Weld County, more particularly described
in attached Exhibit A,
4) The use of ground eater from this wall is limited to ordinary household purposes inside one (1) single family dwelling} the
watering rin of the users own non-oor menial domestic animals, and the Irrigation of not more than 0.5 acres (21780 square
feet) of home gardens and lawns,
5) Preduction from this well is restricted to the Laramie -Fax Hills aquifer: which corresponds to the interval between 855 feet
and 1105 feet below the ground surfact Flair casing shall be installed and grouted to prevent production from other
zones.
B) The depth to the top of the Laramie -Fox Hills aquifer is approximate. To ensure the exclusion of poor quality water from
zones immediately above the aquifer, plain casing and grout shall extend throtgh the lowermost coal and/or carbonaceous
share that overlies the Laramie sand portion of the aquifer,
7) The maximum pumping rate of this well shall not exceed 15 GPM,
8) the annual withdrawal of ground water from this well shall not exceed 1.5 acre-foot.
9) The return flaw from the use of this well must be through an individual waste water disposal system of tre type so that not
less than 2% of the total amount of water withdrawn Is returned to the same stream system in wrtich the well is located.
10) This well shall be constructed not more than 200 feat from the 'cation specified on this permit.
NOTE: The ability of this well to withdraw Its authorized amount of water from this nonnrone able aquifer may be less than
the 100 years upon which the amount of water in the aquifer is allocated, due to anticipated water level declines.
NOTE: To insure e maximum productive life of this wall, perforeted casing should De set through the entire producing
