WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Grant Application for the Energy and
Mineral Impact Assistance Fund (EIAF) Program for the County Roads 74 and 31 Intersection
Roundabout Design Project (August Cycle -Tier I) from the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Works, to the Colorado Department of Local Affairs, with further terms and conditions being
as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Grant Application for the Energy and Mineral Impact Assistance
Fund (EIAF) Program for the County Roads 74 and 31 Intersection Roundabout Design Project
(August Cycle -Tier I) from the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works, to the
Colorado Department of Local Affairs, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Department of Public Works, be, and
hereby is, authorized to submit electronically.

SUBJECT: DOLA Applications— 2020 October Cycle
In accordance with the work sessions with the Board of County Commissioners held on
July 14, 2020 and August 10, 2020, Public Works is requesting the Commissioners submit
two energy and mineral impact grants to the Department of Local Affairs (DOLA) on
October 1, 2020.
The first grant request is for a Tier 1-$200,000 application for funding to assist with
funding contract design for a single -lane modern roundabout at the intersection of WCR
74 and WCR 31.
The second grant request is for a Tier 2 -$1,000,000 application to assist with funding
the contracted construction of a concrete roundabout at 35th Avenue (WCR 35) and 'O'
Street (WCR 64).
Staff recommends authorization of signature on the DOLA applications. I am available at
your convenience to further discuss this matter.

You are required to work with your Regional Field Manager prior to completing your application.
The Department of Local Affairs' (DOLA) Energy and Mineral Impact Assistance Fund (EIAF) program was created to assist
political subdivisions that are socially and/or economically impacted by the development. processing, or energy conversion of
minerals and mineral fuels. Funds come from the state severance tax on energy and mineral production and from a portion of the
state's share of royalties paid to the federal government for mining and drilling of minerals and mineral fuels on federally -owned
land. The creation of the fund is outlined in C.R.S. 34-63-102 (Federal Mineral Lease) and C.R.S. 39-29-110 (Severance). Grant
dollars are to be awarded for the planning. design. construction, and maintenance of public facilities and for the provision of
services by political subdivisions.
Requests in this Cycle 20-11 may be for either Tier I: up to $200,000 or Tier II: over $200.000 and up to $1,000.000 with a 50/50
match requirement for any application. Tier I award notifications are anticipated in late November. Tier II applicant presentations are
scheduled for early January 2021 with funding decisions anticipated later that same month. For more information and additional

Description of the various tasks involved in the project including specific data such as quantities. mileage. square feet, linear ft.

Weld County requests funding to contract design for a roundabout at the intersection of WCR 74 and WCR 31. This location
is currently a 4 -leg arterial intersection with one through lane in each direction and stop control on the north -south
movements (WCR 31). There is a high volume of heavy trucks using this intersection and WCR 74 is posted 55 -mph, which
makes for fast-moving traffic and large speed differentials creating unsafe conditions at the intersection. Stop -delay is
relatively high for north/south traffic and is expected to increase. Traffic counts are growing at a rate of 4-6% per year in
this area. The installation of a roundabout would address future intersection capacity issues and provide significant safety
and air quality benefits. It is well documented that roundabouts can decrease vehicle delays and significantly increase
safety by reducing injury and fatal accidents. The intersection improvement will improve safety by raising the entire
intersection to help with site distance and decreasing the hill on Weld County Road 74 east of the intersection. Weld County
would follow our procurement policies and bid, contract, and manage an engineering firm to complete this design by the
end of 2021.
e. Describe the problem, opportunity or challenge that resulted in the request.

The main problem at this intersection is safety and congestion due to increased traffic. Weld County's intersection safety
analysis identifies 12 crashes occurring from 2013-2017, with no fatalities. Of the 12 crashes the majority are broadside
accidents, which would be eliminated with the construction of a roundabout. The North Front Range MPO identifies WCR 74
as a regionally significant corridor in their Regional Transportation Plan. Recently, Severance, Eaton and Weld County
developed the WCR 74 Access Control Plan to assist with safety preservation of the corridor. In addition, Weld County
received FHWA Surface Treatment Block Grant (STBG) funding from the NFRMPO to construct a roundabout at the
intersection of WCR 74 and WCR 33, which will contribute to safety and system preservation.

D. DEMONSTRATION OF NEED
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistance to "political
subdivisions socially or economically impacted by the development, processing or energy conversion of minerals and mineral
fuels."
a. Demonstration of need
Why is the project needed at this time? (2,500 character limit)
Due to continued traffic accidents, this intersection is in critical need of safety improvements. The increased traffic and
congestion as a result of the numerous oil Et gas wells in the vicinity, a thriving agricultural community and continued
population growth necessitates the urgency for these safety improvements. As previously mentioned, WCR 74 is a regionally
significant corridor connecting US 85 and 1-25 through many communities. WCR 31 is also a busy roadway connecting
Greeley to Eaton, Ault, Pierce and US 85 to the north. The intersection is home to farms and a busy gardening and
landscaping supplies business. The proposed roundabout and lowering of the hill to the east will slow down traffic and
create a safe passage for all vehicles and trucks, including school buses, emergency vehicles and farm equipment.
b. Project implementation
How does the implementation of this project address the need? (2.500 character limit)
Constructing safety improvements at the intersection of WCR 74 and WCR 31 will address the need and pressure of keeping
traffic flowing in a safe manner for the public, trucks, and local residents. Roundabouts promote a continuous flcw of
traffic. Traffic is required to yield but not stop unless necessary. Also, roundabouts are particularly effective in reducing
and even eliminating fatal and injury accidents by reducing the potential vehicle -vehicle conflicts, especially those that are
more severe, like head-on collisions and broadsides.
c. Does this project address the stated need

Yes, the intersection design completely addresses the stated need. No additional funding will be requesting for these
intersection improvements.

Weld County installed a flashing stop sign at the intersection prior to consideration of a roundabout. In addition, Weld
County evaluated the installation of a traffic signal, but that would not resolve the current crash type of broadside
accidents compared to roundabouts. Roundabouts promote a continuous flow of traffic as traffic is required to yield but not
stop unless necessary. At the WCR 74/31 intersection, a roundabout will decrease stop delay for vehicles on the north -south
intersection approaches and on the east -west approaches (compared to a future condition with a signalized intersection or
all -way stop control). Freight -carrying heavy trucks and vehicles impacted by their movement will benefit from reduced
delays and more efficient operations by eliminating difficult right-angle turns.
e. What are the consequences if the project is not awarded funds?

If funding is not awarded, there will be no intersection design, which would delay constructing these needed safety
improvements and result in the continued unsafe traffic route for trucks, industry and residents using this intersection.

The outcome of this project wilt result in a 100% engineered design set of plans that are ready to bid for construction.
Overall, this project will improve regional safety, which by default improves the livability of the surrounding area. In
addition, roundabouts not only improve congestion but provide enhanced air quality benefits over a standard intersection
where you stop (idle) and go (accelerate and produce more exhaust).
b. Energy efficiency
Will this project implement an energy efficiency/strategy that could result in less carbon footprint or conserve energy use
or capitalize on renewable energy technology? If yes, please describe. (2,500 character limit)
Yes, as mentioned above, roundabouts assist with reducing the carbon footprint by improving the amount of vehicle
emissions produced at intersections. Also, whenever possible, Weld County uses recycled asphalt to assist with
reconstruction of any improvements to reduce the carbon footprint during construction.
H. LOCAL EFFORT
a. Relationship to Community Goals
Is the project identified in the applicant's budget or a jurisdictionally approved plan (e.g. capital improvement plan,
equipment replacement plan, comprehensive plan, utility plan, road maintenance and improvement plan or other local or

Yes, Weld County identifies this project as a high priority in our five-year capital improvement plan (CIP) and currently in
anticipation of this partnership would pay for this project from Public Works 2020 General Fund. In addition, this project
was recognized in our 2045 Transportation Plan and WCR 74 Access Control Plan.
b. Why can't this project be funded locally?

In order to complete the design next year, Weld County needs DOLA's assistance to help us contract this project because we
do not have enough staff to perform the design in-house. As the most impacted county in the state, we need DOLA's
partnership to strategically assist with the impacts created on our road system as a result of oil and gas development.
c. Has this project been deferred because of lack of local funding? If so, how long?

Yes, several projects were previously prioritized above WCR 74, but deferment is no longer an option because this corridor
is reaching a point it can no longer be ignored.

Weld County has committed the funds for this project out of Public Works 2020 General Fund.

What other community entities, organizations, or stakeholders recognize the value of this project and are collaborating

the improvement to the livability of the community through this project. If in -kind contributions are included in the

Any person traveling this corridor will benefit from this project. WCR 74 is a regionally significant corridor and is recognized
as Collins Avenue in Eaton, East Harmony Road in Severance and Harmony Road in Windsor, Timnath, Fort Collins. and West
CR 38 in Larimer County. Unfortunately, this intersection is located in between Severance and Eaton, so while they support
the project, they are not financially contributing to it. Oil and gas will provide in -kind materials as requested when
performing projects near different facilities.

Weld County has been directing the revenues from the Specific Ownership Tax to Public Works since 1985.

Estimates were developed by Weld County's Professional Engineers (PE's). The project is an engineer's estimate at this
time, but if the bids come in higher than estimated, Weld County will cover the additional costs and will true up the
contracted budget with DOLA.

Describe how the applicant is, has been, or will be impacted by the development, production, or conversion of energy and
mineral resources (2,500 character limit).
Weld County is extremely impacted by oil and gas activities, which account for more than 50% of all oil and gas activity for
the entire State of Colorado. As of August 2020, Weld County has 19,900 active wells out of the State's 51,349 active well
county emphasizing why the energy and mineral impacts to Weld County are primarily related to oil and gas heavy hauling
truck activities.
b. Use data
Cite actual use data that documents direct impact as it relates to the need for the project. For example, "heavy truck
traffic directly related to energy development activities is impacting County Road X. a traffic count done in May
2019 showed energy related truck traffic increased from 100 trips per day to 300." (2,500 character limit)
WCR 31 is a local paved road and the ADT reports 3,006 vehicles per day with 17% being trucks on the north leg (2018
count). The south leg recorded 5,273 vehicles per day with 11% being trucks. WCR 74 is classified as an arterial road. It's
west ADT is 4,296 vehicles per day (vpd) with 18% being trucks (2017 count) and ADT of 5,097 vpd with 18% truck traffic
east of WCR 74.
K. MANAGEMENT CAPACITY
a. Fund management
How will you separate and track expenditures, maintain funds and reserves for the capital expenditures and improvements

Weld County's Accounting Department is recognized as a Tier 3 local government by the State and can manage all invoicing
information through Banner Accounting System. In addition, Public Works will use the project management software
PubWorks to assist in administering the project and grant.
b. Project sustainability
Describe the funding plan in place to address the new operating and maintenance expenses generated from the

Both these roads are currently maintained by Weld County, so no additional funding is needed.
c. Expertise
Describe the technical and professional experience/expertise of the person(s) and/or professional firms responsible to

Weld County Public Works has several engineers on staff and proven expertise in roadway improvement projects. Barbara
Connolly is the point of contact for this grant and Elizabeth Relford will be responsible for managing the construction
project.

This is a design project and does not duplicate service capacity but improves it.
L. RESILIENCY CRITERIA
The Energy and Mineral Impact Assistance Program is required to integrate resilience criteria into the program. By bringing
resiliency considerations into project planning and implementation. projects should be better poised to see benefits across a
number of sectors (economy. health. infrastructure. etc.). minimize long-term risks. and anticipate or be better prepared to respond
to changing conditions faced by Colorado communities.
The 2015 Colorado Resiliency Framework provides nine resiliency criteria that can serve as a guide when planning a project to
enhance its long term resilience. More information on these criteria and the 2015 Colorado Resiliency Framework can be found

Overall, this project will improve regional safety, which by default improves the livability of the surrounding area. In
addition, roundabouts not only improve congestion but provide enhanced air quality benefits over a standard intersection
where you stop (idle) and go (accelerate and produce more exhaust). Lastly, Weld County is sensitive to the environment
and re -uses (recycles) construction materials in order to reduce the carbon footprint during construction.
M. HIGH PERFORMANCE CERTIFICATION PROGRAM (HPCP) COMPLIANCE
Colorado Revised Statutes (C.R.S. 24-30-1305.5) require all new facilities, additions, and renovation projects that meet the
following criteria to conform with the High Performance Certification Program (HPCP) policy adopted by the Office of the State
Architect (OSA) if:

• The project receives 25% or more of state funds; and
• The new facility, addition, or renovation project contains 5,000 or more building gross square feet; and
• The building includes an HVAC system; and
• In the case of a renovation project, the cost of the renovation exceeds 25% of the current value of the property.
The HPCP requires projects that meet the criteria above to achieve third party verification with the target goal of LEED Gold or
Green Globes -Three Globes. Projects are strongly encouraged to meet the Office of the State Architect's (OSA) Sustainable
Priorities in addition to the LEED prerequisites. Projects funded through DOLA that meet the above applicability criteria are
required to complete the DOLA registration and tracking process. See DOLA's HPCP web page

or contact your DOLA regional manager.
In instances where achievement of LEED Gold or Green Globe -Three Globes certification is not achievable, an applicant may
request a modification of the HPCP policy or a waiver if certain conditions exist. DOLA staff will work with applicants to identify
workable solutions to meet the program's intent to maximize building energy efficiencies.
