The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for Oil and Gas
Support and Service (storing and transporting crude oil) in the A(Agricultural)Zone District.
This project is south of and adjacent to CR 30 and is west of CR 47.
Parcel numbers: 1 21 3261 00021 and 1 21 3261 00020.
Access is from CR 30.
ACCESS
Weld County Public Works has reviewed the application materials related to access and determined that
the applicant is proposing to create one (1) new access on County Road 30 located approximately 2,045
feet west of County Road 47. This access location meets the minimum access spacing requirements for a
collector road as defined in the Weld County Code, Section 8-14-30.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Please
refer to Chapter 8 of the Weld County Code for more information regarding access.
ROADS AND RIGHTS-OF-WAY
County Road 30 is a paved road and is designated on the Weld County Functional Classification Map(Code
Ordinance 2017-01)as a collector road,which requires 80 feet of right-of-way.The applicant shall delineate
and label on the site map or plat the future and existing right-of-way(along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required
setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered
in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way
or easement. Right-of-Way Use Permit instructions and application can be found at
https://www.weldgov.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 30 counted 937 vpd with 68%trucks. The 85th percentile speed is 64 mph.
The traffic information submitted with the application materials indicated that during construction there will
be up to 80 passenger vehicle daily roundtrips. Post construction there will be up to 22 passenger vehicle
and pickup truck daily roundtrips with an occasional semitrailer. The application language describing the
expected haul routes was vague and incomplete. No percentages for traffic distribution were given. More
haul route detail will be required for Public Works to be able to prepare the Road Maintenance Agreement
discussed below.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt.
Temporary Tracking Control shall be used during construction unless permanent tracking control is installed
ahead of construction activities. Recycled concrete is not allowed in County right-of-way.A variance request
for alternatives to the tracking control requirement can be submitted to Public Works for review and
consideration.
This site requires double cattle guards and 100 ft. of asphalt or 300 ft. of asphalt.
ROAD MAINTENANCE AGREEMENT
Public Works is requiring a Road Maintenance Agreement (RMA) for this project. Road maintenance
includes, but is not limited to, dust control and damage repair to specified haul routes.

DRAINAGE REQUIREMENTS
This area IS within a Non-Urbanizing Drainage Area: Non-Urbanizing Drainage Areas typically require
detention of runoff from the 1-hour, 100-year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1-hour, 10-year storm falling on the undeveloped site for NON-
URBANIZING areas.
Detention Pond summarized in a Drainage Report:
The applicant has submitted a preliminary drainage report. A final drainage report and detention pond
design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR
map. The drainage report must include a certification of compliance stamped and signed by the PE. A
Certification of Compliance form can be found on the Public Works Development Review website. General
drainage report checklist is available on the engineering website. More complete checklists are available
upon request.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete(plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. A Road Maintenance Agreement is required at this location. Road maintenance includes, but is not
limited to, dust control and damage repair to specified haul routes. (Department of Public Works)
B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Department of Public Works)
C. The plan shall be amended to delineate the following:
1. County Road 30 is a paved road and is designated on the Weld County Functional Classification
Map as a collector road which requires 80 feet of right-of-way at full buildout. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way) and the physical location of the road. All setbacks
shall be measured from the edge of right-of-way. This road is maintained by Weld County.

2. Show and label the approved access location, approved access width and the appropriate turning
radii (60') on the site plan. The applicant must obtain an access permit in the approved location
prior to construction. (Department of Public Works)
3. Show and label the approved tracking control on the site plan. (Department of Public Works)
4. Show and label the entrance gate if applicable.An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Department of Public Works)
5. Show and label the accepted drainage features. Stormwater ponds should be labeled as
"Stormwater Detention, No-Build or Storage Area" and shall include the calculated volume.

6. Show and label the drainage flow arrows. (Department of Public Works)
7. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Department of Public Works)
Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on-site construction.

B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Department of Public Works)
5. The Property Owner shall comply with all requirements provided in the executed Road Maintenance

6. The Road Maintenance Agreement for this site may be reviewed on an annual basis, including a site
visit and possible updates. (Department of Public Works)
7. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

Re: USR20-0004 Liberty Crude Oil Storing and Transporting
Environmental Health Services has reviewed this proposal for a Site-Specific Development
Plan and Special Review Permit for Oil and Gas Storage Facility (storing and transporting
crude oil) in the A (Agricultural) Zone District.
The application indicated that 8 fulltime employees would service the site after
construction. The applicant is proposing to permit and install a commercial well and
engineered septic system prior to the certificate of occupancy.
Various chemicals, fuels, hazardous and non-hazardous materials,beyond the storage of
crude oil and oily water, will be stored onsite for use in the facility operation. These will be
managed in accordance with all applicable regulations and the site-specific SPCC Plan. No
washing of vehicles or equipment will occur onsite.
The application did not include a noise study or a commitment to adhere to specific noise
limits. Due to the proximity of surrounding property owners, a residential noise standard
has been suggested.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An onsite wastewater treatment system is required for the proposed facility and
shall be installed according to the Weld County Onsite Wastewater Treatment
System Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Onsite Wastewater
Treatment System Regulations.
2. Documentation showing the facility has a permanent, adequate water supply for
drinking and sanitary purposes.

Environmental Health has no objections to the proposal; however,we recommend that the
following requirements be incorporated into the permit as development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust,blowing debris, and other potential nuisance conditions. The facility
shall operate in accordance with Chapter 14,Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations.
5. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions
Permit Application and obtain a permit from the Air Pollution Control Division,
Colorado Department of Public Health and Environment, as applicable.
6. Adequate drinking, handwashing and toilet facilities shall be provided for employees
and patrons of the facility, at all times. As employees or contractors are on site for
less than 2 consecutive hours a day portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall be retained on
a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers. Portable toilets shall be screened
from the public ROW and any adjacent properties.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code pertaining to On-site Wastewater Treatment Systems (OWTS).A
permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
8. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from
the Colorado Department of Public Health and Environment (CDPHE),Water Quality
Control Division, as applicable.
9. All potentially hazardous chemicals on-site must be handled in a safe manner in
accordance with product labeling.All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
10.Secondary containment shall be constructed around tanks to provide containment
for the largest single tank and sufficient freeboard to contain precipitation.
Secondary containment shall be sufficiently impervious to contain any spilled or
released material. Secondary containment devices shall be inspected at regular
intervals and maintained in good condition. All secondary containment will comply
with the Colorado Oil and Gas Conservation (COGCC) Commission Rules and/or the
provisions of the State Underground and Above Ground Storage Tank Regulations.
11.As applicable, a Spill Prevention, Control and Countermeasure Plan, prepared in
accordance with the applicable provisions of 40 CFR, Part 112, shall be available.
12.The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
13.Any contaminated soils on the facility shall be removed,treated or disposed of in
accordance with all applicable rules and regulations.All spills will be reported to
local, state and federal agencies in accordance with all state and federal regulations.
14.The facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S.
15.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from
the Colorado Department of Public Health and Environment(CDPHE),Water Quality
Control Division, as applicable.
16.The facility shall notify the County of any revocation and/or suspension of any State
issued permit.
17.The applicant shall notify the County upon receipt of any compliance advisory or
other notice of non-compliance of a State issues permit, and of the outcome or
disposition of any such compliance advisory or other notice of non-compliance.
18.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

After discussion with Brian Olsen with Phillips 66 , I would like to update our position on the U R20 -
gg04 referral .
The following is what we discussed . Therefore the comments in my previous referral are to be
rescinded with regard to the foam requirement . However, because of the remoteness of this location ,
we would like to have a fire hydrant in place for possible secondary fire caused by an event on this
site such as ground cover fires or other occupancy fires . The location of this hydrant could be offsite
on the county road if possible at all .
The following is our conversation .
Jeff — Thanks for speaking on Thursday afternoon of last week . It was a good conversation . I wanted
to quickly document our call , also sharing the path forward with our team .
During our call we discussed the criteria of NFPA 30 and how shell -to-shell tank spacing is such a
significant fire protection feature for storage tanks such as we are planning . We also discussed how
the decision to provide fire protection systems at facilities such as that proposed is normally based on
the Owner's risk tolerance, with smaller organizations likely displaying lower risk tolerance than would
larger players . In our effort to make risk informed decisions at Liberty Pipeline sites we are
developing a Fire Safety Analysis ( FSA) . Among things , the FSA documents passive and active fire
protection features (where employed ) , fire prevention efforts and initiatives , potential losses , etc . , in
the effort to document our overall exposure and rationalize our fire protection approach .
While not documented in its final form , our FSA efforts for the Liberty site in your jurisdiction place
much significance on passive fire protection and prevention efforts, including shell-to-shell spacing ,
containment , redundant tank level instrumentation capabilities, etc. With this approach fire protection
systems are not included for the proposed site .
Also during the call we discussed the logistics and challenges of fighting tank fires , including the
tremendous water supply and foam concentrate supply required . I shared our company approach
where each fire scenario differs significantly and how we preplan the use of specially trained industrial
fire brigades such as Williams Fire to help assess and potentially extinguish tank fires when they do
occur. I also shared that part of our effort is Emergency Responder education and that we are willing ,
and would like to visit your jurisdiction for this purpose . Further, our sponsorship of firefighters
towards attending Industrial Fire School was discussed as were public safety grants .

At the conclusion of our conversation you shared your intent to update the most recent comments you
had on file with the county in regard to the proposed site, effectively documenting your satisfaction
with the overall fire protection approach . As our FA documentation is completed and construction
progresses we will contact you to coordinate training opportunities . This should mean that we reach
out to you mid-summer. If for some reason you do not hear from us please contact Denzil Traylor
(copied ) or I . Looking forward to meeting you in person .

First of all, thank you for checking into it and second I thought that might be the case because we do not have hydrants
along this pipeline.
I have some calls into our neighboring districts that have large terminals like this just to see how they are handling this
issue . I will get back to you as soon as I can .
In the meantime, I will contact the county and take the hydrant requirement off the referral .

Jeff — Just got off the phone with WCR 30 engineer Jim Struble (970) 369-7246. Unfortunately, fire
hydrants can't be added to the WCR 30 waterline north of County Road 30 . While this water line is
28" diameter and runs at 200 psi it is unreliable as it is down for maintenance fairly often . The line
provides raw water to Fort Morgan for treatment and ultimately use as potable eater for the city . Jeff
Indicated that he has had similar conversations about hydrant requests from Weld County
Emergency Manager Roy Rudisill , with each conversation having the same result . Due to the
intermittent availability of the line , high pressure, water quality, and its dedication to Fort Morgan ,
there are no fire hydrants elsewhere on the line and they cannot add them .
I do wish the response were different. What are your thoughts at this point?

I imagine this hydrant is really to provide a water source for your engine , tanker, etc . , to supplement
firefighting water supply availability in the area , though not in adequate volume for an attack on our
equipment . Are you fine if the hydrant sits on the same side of the highway as the main ? I am
assuming you would really prefer it along the highway so you guys have better access to it for all
hazards in the area ?

Hello Brian,
No Sir, I have not heard of " instantaneous hose connections " Wow ! How are they held together?
The water line is on the north side of WCR 30, just across the road from your site running east and west. It is owned by
" Northern Colorado Water Conservancy District. " I don 't think it is a service line, maybe a conveyance line, but it might
be able to provide a hydrant. Please see picture attached .

Things here are quite interesting with many subtle differences. Have you heard of instantaneous hose
connections. No screwed hose connections or stortz fitting here. I had no idea . Brian .

I rescinded the foam requirement but did ask for a hydrant if it is possible because of the location and lack an

Jeff — Thanks for speaking on Thursday afternoon of last week. It was a good conversation . I
wanted to quickly document our call , also sharing the path forward with our team .
During our call we discussed the criteria of NFPA 30 and how shell -to-shell tank spacing is such a
significant fire protection feature for storage tanks such as we are planning . We also discussed
how the decision to provide fire protection systems at facilities such as that proposed is normally
based on the owner' s risk tolerance , with smaller organizations likely displaying lower risk
tolerance than would larger players . In our effort to make risk informed decisions at Liberty
Pipeline sites we are developing a Fire Safety Analysis ( FSA) . Among things , the FSA
documents passive and active fire protection features (where employed ) , fire prevention efforts
and initiatives , potential losses , etc . , in the effort to document our overall exposure and rationalize
our fire protection approach .
While not documented in its final form , our FSA efforts for the Liberty site in your jurisdiction place
much significance on passive fire protection and prevention efforts , including shell-to-shell
spacing , containment, redundant tank level instrumentation capabilities, etc. With this approach
fire protection systems are not included for the proposed site .
Also during the call we discussed the logistics and challenges of fighting tank fires , including the
tremendous water supply and foam concentrate supply required . I shared our company approach
where each fire scenario differs significantly and how we preplan the use of specially trained
industrial fire brigades such as Williams Fire to help assess and potentially extinguish tank fires
when they do occur . I also shared that part of our effort is Emergency Responder education and
that we are willing , and would like to visit your jurisdiction for this purpose . Further, our
sponsorship of firefighters towards attending Industrial Fire School was discussed as were public
safety grants .
At the conclusion of our conversation you shared your intent to update the most recent comments
you had on file with the county in regard to the proposed site , effectively documenting your
satisfaction with the overall fire protection approach . As our FSA documentation is completed and
construction progresses we will contact you to coordinate training opportunities . This should
mean that we reach out to you mid-summer. If for some reason you do not hear from us please
contact Denzil Traylor (copied ) or I . Looking forward to meeting you in person .

I am in receipt of your referral for U R2o- 0004 and our concerns are available water and fire-
fighting foam onsite.
The nearest fire hydrant is approximately 2 . 5 miles away at the entrance to the Pelican Lakes
subdivision. We do carry fire-fighting foam on our apparatus but not nearly enough to fight a
possible fire at this location or size. I would like to discuss possible options to address these
items .
I have been out to the site and there is a buried water line owned by Northern Colorado Water
Conservancy District on the north side of County Road 30. I don't know if this is a viable source
for a fire hydrant or this line is only for conveyance purposes. I look forward to discussion with
you about possible solutions to this issue.
Looking at the USR map, it shows additional buildings besides the tanks. I will need drawings of
each to be able to review them for fire and life safety purposes if you are applying for
building permits for those also .

Hi Diana ,
Jake Rosenberg gave me a call and asked about the 3 , 000 gallon tank . I realized that in the
submitted materials , I interpreted the examples the county gave on the emergency action plan as
the plan itself. This was a mistake , and our comments on the tank in our letter dated January 23rd
are not applicable . To clarify , we do not have any concerns with the plan so long as any water
hauled to the site is from a legal source .

Dear Diana Aungst:
We have received your January 21 , 2020 request concerning the above - referenced use by special review
proposal for Lots A and B of Recorded Exemption No . 1213 -26- 1 RE - 3171 . According to the submitted
information , the applicant is seeking a site specific development plan and use by special review permit
for oil and gas support and service, including storing and transporting crude oil.
This referral does not appear to qualify as a "subdivision " as defined in Section 30 -28 - 101 ( 1O ) (a ) ,
C . R. S. Therefore, pursuant to the State Engineer' s March 4 , 2005 and March 11 , 2011 memorandums to
county planning directors , this office will only perform a cursory review of the referral information and
provide informal comments. The comments do not address the adequacy of the water supply plan for
this project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition , the comments provided herein cannot be used to guarantee a viable water supply plan or
infrastructure , the issuance of a well permit, or physical availability of water.
According to the submitted material, there will be a 3 , 000 gallon water storage tank on site . Proposed
water uses were not clearly defined . Drinking water will be provided through water hauled on site during
construction and provided by a proposed well during operation . The ability for Lots A and B to obtain
well permits will be determined at the time permit applications are submitted to and reviewed by this
office.
According to the submitted material, stormwater runoff will be directed to two detention basins . The
applicant should be aware that unless the structure (s ) can meet the requirements of a "storm water
detention and infiltration facility" as defined in section 37 - 92- 602(8 ) , C. R . S, the structure(s) may be
subject to administration by this office. The applicant should review DWR's Administrative Statement
Regarding the Management of Storm Water Detention Facilities and Post -Wildland Fire Facilities in
Colorado , to ensure that the notification , construction and operation of the proposed structures meet
statutory and administrative requirements. The applicant is encouraged to use Colorado Stormwater
Detention and Infiltration Facility Notification Portal to meet the notification requirements.
