HomeMy WebLinkAbout20200498.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, FEBRUARY 10, 2020 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, February 10, 2020, at the hour of 9:00 a.m. Ira ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Chair Pro-Tem Commissioner Scott K. James Commissioner Barbara Kirkmeyer Vacant Commissioner Position Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Bri White Controller, Barbara Connolly • MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of February 5, 2020, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner James moved to approve the Certification of Hearings conducted on February 5, 2020, as follows: 1) COZ19-0004 — Richard Sack. Commissioner Moreno seconded the motion, which carried unanimously. ▪ AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. El PUBLIC INPUT: Ron Farmer, Greeley resident, expressed a property boundary dispute is preventing him from selling his land and moving to Arizona to be closer to his grandchildren. After further discussion, Commissioner Kirkmeyer shared the Board is unable to aid with a property boundary dispute because it is typically a civil matter; Bruce Barker, County Attorney, directed Mr. Farmer to speak with Bob Choate, Assistant County Attorney. le WARRANTS: 1) GENERAL WARRANTS - FEBRUARY 7, 2020: Commissioner Kirkmeyer moved to approve the General Warrants, as printed. Commissioner James seconded the motion, and it carried unanimously. Minutes, Monday, February 10, 2020 O3/7 Page 1 2020-0498 BC0016 IE BIDS: 1) APPROVE BID #B2000063, SIGN APPLICATION TABLE AND ACCESSORIES - DEPARTMENT OF PUBLIC WORKS: Rob Turf, Purchasing Department, stated 16 vendors downloaded specifications and two (2) bids were received. Staff recommends awarding the bid to Pacific Coast Sign Supply, the lowest bidder to meet specifications, at a cost of $32,160.00. Commissioner Moreno moved to approve said bid. Commissioner James seconded the motion, and it carried unanimously. 2) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN - (S31, T12N, R64W - 81.37 ACRES): Barbara Connolly, Controller, shared no bids were received. El 3) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN - (S30, T2N, R63W - 7.25 ACRES): Ms. Connolly expressed Verdad Resources, LLC, was the sole bidder at $600.00 per mineral acre, for a total bonus amount of $4,350.00. Commissioner James moved to approve said lease and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. JE NEW BUSINESS: 1) CONSIDER SUBMITTAL OF GRANT APPLICATION AND RESULTING GRANT AWARD LETTER FOR PURCHASE AND INSTALLATION OF DROP BOXES AND VOTING EQUIPMENT AND AUTHORIZE CHAIR TO SIGN: Carly Koppes, Weld County Clerk and Recorder, provided the grant application is requesting $100,000.00 for voted equipment and $7,000.00 for two (2) 24 -hour drop boxes. In response to Commissioner Moreno, Ms. Koppes clarified the referenced video equipment will be located at AIMS Community College and University of Northern Colorado. Commissioner Moreno moved to approve said grant application and authorize the Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. IE 2) CONSIDER WELD COUNTY EMERGENCY OPERATIONS PLAN: Roy Rudisill, Director of the Office of Emergency Management, declared the plan aligns Weld County with State rules and regulations. Commissioner Moreno moved to approve said operations plan. Seconded by Commissioner James, the motion carried unanimously. le 3) CONSIDER CONTRACT ID #3401 REGIONAL COMMUNICATIONS USER AGREEMENT FOR WIRELESS RADIO SERVICES AND AUTHORIZE CHAIR TO SIGN - UNIVERSITY OF NORTHERN COLORADO (UNC): Mike Wallace, Director of the Department of Public Safety Communications, stated the agreement provides radio services for UNC's dispatch center and further supports network security measures throughout the County. In response to Commissioner Kirkmeyer, Mr. Wallace clarified an annual fee is in place, rather than an hourly rate, due to the maintenance and labor required for the equipment UNC currently possesses. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. 4) CONSIDER CRIME VICTIM SERVICES (CVS) GRANT APPLICATION FOR VICTIMS OF CRIME ACT (VOCA) PROGRAM FOR BILINGUAL ADVOCATE UNIT AND AUTHORIZE ELECTRONIC SUBMITTAL: Sonja Kohlgraf, Sheriff's Office, presented the two-year grant application awarding $171,228.00 for funding salary, supplies, and operating and travel costs. Debra Calvin, Sheriff's Office, shared the importance of providing bilingual services to individuals who are facing severe challenges as a crime victim, as well as presented other system -based advocacy benefits. Ms. Kohlgraf addressed Commissioner Kirkmeyer's concern by confirming the County's 5% match is budgeted. In response to Commissioner Moreno, Ms. Calvin expanded upon anticipated indirect costs and stated the existing Minutes, Monday, February 10, 2020 Page 2 2020-0498 BC0016 language line with the Sheriff's Office provides translative needs. Commissioner Moreno moved to approve said grant application and authorize electronic submittal. Commissioner James seconded the motion, and it carried unanimously. 5) CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON CR 79 AT STATE OF WYOMING BORDER, AND CR 105 AT INTERSECTION OF STATE HWY 14: Cameron Parrott, Department of Public Works, stated County Roads (CRs) 105 and 79 are not classified as hazardous haul routes; therefore, Oil and Gas vehicles are receiving tickets for local deliveries. Mr. Parrot provided staff's request for regulatory R14-3 sign postage along said CRs to allow for local deliveries without penalty. Commissioner James moved to approve said resolution. The motion, which was seconded by Commissioner Moreno, carried unanimously. El 6) SECOND READING OF CODE ORDINANCE #2020-01, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 9 INFORMATION TECHNOLOGY, OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read by title only; the motion was seconded by Commissioner Moreno and carried unanimously. Mr. Barker read said title for the record. Ryan Rose, Director of the Department of Information Technology, stated no changes were recommended following the worksession with the Board after First Reading. Mr. Barker submitted Exhibit A with proposed alterations to Section 9-1-10.C to limit staff's network usage and remain within the scope of the agency's Criminal Justice Information System (CJIS) Policy. Mr. Barker confirmed Commissioner Kirkmeyer's verification that the Criminal Justice Agency consists of staff from the Sheriff's Office, District Attorney's Office, Justice Services, and Public Safety Information Technology. All Criminal Justice Agency members are directed to have an independent CJIS policy and some departments resubmit certifications annually. Commissioner Kirkmeyer stated the policies address both the State and County, expressing the importance of having explicit policies for County personnel to follow and align with the County system. Mr. Rose shared CJIS is a federal policy, which is carried through by the State. Chair Freeman clarified staff would utilize the County policy for everything except when working on CJIS activity. Commissioner Kirkmeyer requested an additional work session to review further. No public testimony was offered concerning this matter. Commissioner Moreno moved to approve said ordinance on Second Reading. Seconded by Commissioner James, the motion carried unanimously. 7) SECOND READING OF CODE ORDINANCE #2020-03, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE (SNOW POLICY): Commissioner James moved to read by title only; the motion was seconded by Commissioner Moreno, and carried unanimously. Mr. Barker read said title for the record. Jay McDonald, Director of Department of Public Works, shared no alterations were made after First Reading. No public testimony was offered concerning this matter. Commissioner James moved to approve said ordinance on Second Reading. The motion was seconded by Commissioner Moreno, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances 2020-01 and 2020-03 were both approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
