EMERGENCY CODE ORDINANCE 2020-06
IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2
ADMINISTRATION, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted
Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld,
including the codification of all previously adopted ordinances of a general and permanent nature
enacted on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of emergency revision and clarification with
regard to procedures, terms, and requirements therein, inasmuch as the Weld County Health
Officer has issued a Declaration of Pandemic Health Emergency, pursuant to Colorado State
Statutes and Section 14-10-10 of the Weld County Code; therefore, this Ordinance is declared to
be an Emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule
Charter.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County
of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and hereby
are, repealed and re-enacted, with amendments, and the various Chapters are revised to read as
follows.
CHAPTER 2
ADMINISTRATION
Amend Sec. 2-1-10. - Conduct of meetings.
A. The Board of County Commissioners shall conduct two (2) regular weekly board meetings on
Monday and Wednesday of each week, to commence at 9:00 a.m.
1. A regular meeting may be canceled by resolution of the Board of County Commissioners
passed and publicly announced at least ten (10) days prior to the canceled meeting date.
2. Special meetings shall be called by the Clerk to the Board upon the written request of the
Chair or of any three (3) members of the Board of County Commissioners. Each member
of the Board shall be provided at least twenty-four (24) hours' written notice of such
meeting, served personally or left at each member's usual place of residence. However,
a special meeting called as herein provided may be held on shorter notice if all members
of the Board of County Commissioners are present and have waived notice thereof in
writing. A copy of the notice of a special meeting shall be posted in a conspicuous place
in the office of the Board of County Commissioners at the time such notice is given to

members of the Board. No business shall be transacted at a special meeting unless the
same has been stated in the notice of such meeting.
3. In the event that a legal holiday should fall on a Monday or Wednesday, there shall be no
need to declare a cancellation of said meeting.
4. If at least three (3) Board members are unable to meet physically, Board meetings may
take place using electronic communications that allow for a record of proceedings. If a
Pandemic Health Emergency has been declared by the Weld County Health Officer,
Commissioners may attend the Board meetings using electronic communications that
allow for a record of proceedings.
Remainder of Section — No change.
BE IT FURTHER ORDAINED by the Board that an emergency exists, inasmuch as the Weld
County Health Officer has issued a Declaration of Pandemic Health Emergency, pursuant to
Colorado Revised Statutes and Section 14-10-10 of the Weld County Code; therefore, this
Ordinance is declared to be an Emergency Ordinance under the provisions of Section 3-14 of the
Weld County Home Rule Charter.
BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Municode to supplement the Weld County Code with the amendments
contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they
currently exist within said Code; and to resolve any inconsistencies regarding capitalization,
grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections
in said Code.
BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.
