Re: Petition for the reinstatement of the petroleum exemption and for implementation of the crude oil exemption on Weld
County Road 49.
Dear members of the Board of Commissioners:
The Colorado State Patrol (CSP) has completed our review of the captioned petition received by our agency on September 9,
2020. As previously communicated in our letter, dated September 30, 2020, the petition was considered complete for purposes
of acceptance and moving forward with public outreach as required under state law. I am happy to report those public outreach
efforts have been completed and the Patrol has rendered a decision with respect to the petition.
In accordance with S 42-20-302, CRS, the Patrol provided public notice on three consecutive weeks in the Greeley Tribune
regarding the acceptance of the petition, future public meetings as well as the allowance of the public to submit written
comment. In addition, formal notice was made to community leaders and stakeholders identified in your petition who may be
impacted by the petition and the ultimate decision.
Informal Public Conferences (IPCs) were held virtually on December 1 and December 5, 2020 during which Weld County was
provided the opportunity to present the petition to the public, answer questions and resolve any opposition which may have
arisen. The Patrol also provided the opportunity in those forums for public comment and questions. Through course of those
public outreach efforts, the Patrol received no opposition either verbally or written.
Based on these factors and the content of the petition, your petition to reinstitute the exemption on Weld County Road 49 for
gasoline, diesel fuel and liquefied petroleum gas and to institute the exemption for crude oil as allowed under § 42-20-301(1)(a),
CRS, is hereby approved. As such, the Patrol with be seeking change to applicable rules related to the transportation of
hazardous materials under 8 CCR 1507-27, HMR 8. The Patrol is currently undergoing our annual process for updating and
revising these rules and it is our intent to make the necessary change during this cycle with an effective date of April 1, 2021.
As you may be aware, the rulemaking process carries necessary outreach requirements and therefore is subject to further
comment by members of the public. While further presentation of your petition is not necessary on your part, I will ensure
that you are included in that outreach and are afforded the opportunity to attend our upcoming public hearing related to the
hazmat transportation rules.

Dear members of the Board of Commissioners:
The Colorado State Patrol (CSP) has completed our review of the captioned petition and have accepted it for further processing,
pursuant to § 42-20-302, CRS. In accordance with § 42-20-302 (10), CRS, the Patrol is required to render a final decision
regarding your petition within six months from the date of this letter. During that period, the Patrol may ask for additional
information to properly evaluate the petition prior to formal approval.
After providing public notice to potential stakeholders, to include members of the community, the Patrol will schedule informal
public conferences wherein the County may present its petition and receive questions from stakeholders and members of the
community. Given the current pandemic, it is our goal to provide a forum to gain community input in a manner that ensures
appropriate public health and safety guidelines are met while at the same time providing accessibility to all members of the
affected communities who chose to participate. I can assure you that CSP will continue to work closely with members of your
staff to coordinate those efforts.
A copy of this letter will be sent to you via certified U.S. Mail as required under § 42-20-302 (4)(a), CRS. Should you or members
