HomeMy WebLinkAbout20200258.tiff RESOLUTION RE: APPROVE CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING VIOLATION PENALTIES AS SPECIAL ASSESSMENT - CHARLES BENNETT AND MANUEL GALLEGOS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Weld County, on behalf of the Weld County Department of Planning Services, filed a complaint in the Weld County Court against Defendants Charles Bennett and Manuel Gallegos claiming that the Defendants' property is in violation of the Weld County Code, and WHEREAS, the County Court found the Defendants' property to be in violation of the Weld County Code, and WHEREAS, the Defendants failed to bring the property into compliance with the Weld County Code, and upon Weld County's motion, the County Court ordered Defendants to pay $25.00 per day that the property remained in violation of the Weld County Code, beginning on July 9, 2019, and WHEREAS, C.R.S. §30-28-124.5(1) and Weld County Code Section 23-10-40.A allow these costs to be assessed against the property and collected as a special assessment by the Treasurer. On July 9, 2019, this Court ordered daily penalties begin at$25.00 as this case was initiate in 2017 and property at issue was still out of compliance with regard to the Amended Stipulation which was executed by both parties and made an Order of this Court on December 3, 2018. The Amended Stipulation accepted by the Court on December 3, 2018,was the third agreement made by the parties in this case in the County's attempt to allow the Defendant to bring the property into compliance. Previous Stipulations accepted by the Court were entered on March 30, 2018 and December 4, 2017. 2. The daily penalties were ordered based on Defendant's failure to remove tires and to screen all derelict vehicles from view. 3. On August 28, 2019, Bethany Pascoe Zoning Compliance Officer did an inspection of the property at issue. It is the Plaintiffs position that the property still contains tires, see Exhibit 1 and that the derelict vehicles that are allowed to be on the property are still not completely screened from view, see Exhibit 2. 4. For the reasons stated in paragraph 3, the County believes that the daily penalties should remain in place. 5. Additionally,the Plaintiff agrees that there are additional violations of the Stipulation entered on December 3, 2018, specifically, it states that"Since Defendant submitted a complete Site Plan Review application, staff will process and complete Conditions of Approval within 75 days. Defendant agrees to complete all Conditions of Approval and submit an approved final map for recording by June 12, 2019." The Conditions of Approval are attached. See Exhibit 3. It is Plaintiffs position that these have not been completed and a final map has not been recorded. The Plaintiff would request that a hearing be set to establish this violation of the current agreement of the parties. The County would also request that before the hearing, an onsite inspection be allowed as the property is quite expansive and it is difficult to determine compliance without entering the property. WHEREFORE,Plaintiff requests that the daily penalties continue to accrue and that a hearing be set to further determine if the additional violations of the Amended Stipulation may be included part of the currently accruing daily penalties. The sight is being used as for commercial vehicle and equipment parking,as well as a noncommercial junkyard for the owners. The site includes a 1728 square-foot commercial utility building built in 1969. The original non- conforming residence experienced a fire and is not habitable, therefore only one non-permanent caretaker residence may be permitted residences onsite.An oil and gas production facility is also onsite, but is not a part of this site plan review. The applicant is requesting to use the property for outdoor storage of commercial vehicles and equipment. The applicant also requested to use the property as a noncommercial junkyard, however that is not an allowed use in the 1-3 (Industrial) Zone District. Only commercial salvage yards are allowed in this zone with approval by Board of County Commissioners of a Use by Special Review permit under Section 23-3- 330.D.3 of the Weld County Code. This Site Plan Review will not permit the site for use as a commercial salvage yard.As the site was historically used for salvage,only a small portion of the property,as delineated on the proposed site plan map, may be used for personal storage. This area shall not exceed twelve (12) derelict vehicles owned by the current property owner. The owner and one other person plan to be the only employees onsite, though there may be occasional contract workers present. No business signs are proposed "No Trespassing" signs are proposed to be located on the fence. The minimum required landscape area is 15% of the Lot. The Lot shall be deemed landscaped if it is covered with native grasses, decorative rock, or otherwise suitably landscaped. No dumpster is shown on the site plan. Existing lighting will also need to be shown on the map and needs to meet the Code requirements for being downcast and shielded so as to not cast light onto adjacent properties and rights-of-way. The site is currently in violation (ZCV17-00017)of Chapter 23 of the Weld County Code for not having the necessary land use permits for using multiple camper trailers as dwelling units and operating a commercial vehicle and equipment parking operation. The property owner was informed that the property may not be used for camping.This case has been forwarded to the County Attorney's Office;therefore,an investigation fee was required and paid at the time of application submittal. If the Conditions of Approval are met and the Site Plan Review map is recorded, it will correct the outstanding violation. If this application is denied, the case will continue through the County Court process until all commercial vehicles and equipment are removed from the property. According to Section 23-3- 330.E, no land, building or structure shall be used, changed in use or type of occupancy, developed, erected, constructed, reconstructed,moved or structurally altered or operated in the 1-3 Zone District until a Site Plan Review has been approved by the Department of Planning Services. Oil and gas production facilities are exempt from the Site Plan Review process. This site plan review is approved with the attached conditions: 1. Prior to recording the Site Plan Review Map,the applicant shall address the following to the Department of Planning Services'satisfaction: A. The property is in violation of Chapter 23 of the Weld County Code(Violation#ZCV17-00017).The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. The dwellings on the site shall be reduced to one (1) for the caretakers and all outdoor storage of vehicles and equipment shall be removed from the one-percent chance Flood Hazard Area Zone AE(100-year flood). Evidence shall be submitted in writing to the Department of Planning Services. C. The applicant shall address the future use of the access located on Fern Avenue approximately 610 feet south of East 18th Street.This is currently permitted for Oil&Gas use but is not addressed in the draft site plan map or application material. D. A Traffic Impact Study is required to be submitted for review prior to recording the Site Plan Review. This study may indicate that off-site improvements are required for the use on the site.The Traffic Impact Study shall be completed by a Colorado Licensed Professional Engineer. E. An Improvements and Road Maintenance Agreement is required for off-site improvements at this location. Road maintenance includes but is not limited to damage repair to specified haul routes. The Agreement shall include provisions addressing engineering requirements, submission of collateral, and testing and approval of completed improvements. F. Any unpermitted On-Site Wastewater Treatment System (OWTS) located on the property is required to have proper documentation. A Statement of Existing (SE) permit is required for the proposed facility. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed,the system shall be brought into compliance with current regulations. H. Evidence of a permitted potable water well is required. I. The applicant shall attempt to address the concerns of the Colorado Division of Water Resources, as stated in the referral response dated December 21, 2018. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. J. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. 5. Show and label the approved access locations, approved access width and the appropriate turning radii (60')on the site plan.The applicant must obtain an access permit in the approved location(s)prior to recording the SPR map. 6. Show and label the approved tracking control on the site plan. 7. Show and label the entrance gate if applicable. An access approach that is gated shall be designed so that the longest vehicle(including trailers)using the access can completely clear the traveled way when the gate is closed. Neither the direct, nor reflected, light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. No outdoor storage is allowed below the base flood elevation (BEE). Storage within the one- percent Chance Flood Hazard Area and above the BFE requires a Flood Hazard Development Permit. 9. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. 10. No derelict vehicles, as defined in Section 23-1-90 of the Weld County Code, shall be stored on the site, except the limited storage of twelve or fewer that are registered to the current property owner. 11. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 12. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off-site tracking. 13. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. 14. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire an approved Right-of-Way Use Permit prior to commencement. 15. The Property Owner shall comply with all requirements provided in the executed Improvements Agreement. 16. The Improvements Agreement for this site may be reviewed on an annual basis, including a site visit and possible updates. 17. The historical flow patterns and runoff amounts on the site will be maintained. 18. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,30 20 100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 19. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30 20 100.5, C.R.S. 20. Waste materials shall be handled,stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14,Article 1 of the Weld County Code. 21. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 22. The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S. SPR18-0020 Page 5 of 6 23. For employees or contractors on site for less than 2 consecutive hours a day,and 2 or less full- time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 24. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 25. Adequate drinking, hand washing, and toilet facilities shall be provided for employees and patrons of the facility, at all times. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The existing well cannot be used for the business unless it is repermitted to allow commercial use. 26. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 27. Any contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. All spills will be reported to local, state and federal agencies in accordance with all state and federal regulations. 28. The facility shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 29. Building Permits issued on the proposed lots, will be required to adhere to the fee structure of the County-wide Road Impact, the County Facility Fee, and the Drainage Impact Fee Programs. 30. Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. 2. The applicant shall submit one (1) electronic (.pdf) copy of the site plan review map for preliminary approval to the Department of Planning Services. Upon approval of the map,the applicant shall submit a Mylar, along with all other documentation required as conditions of approval. The Mylar shall be recorded in the office of the County Clerk and Recorder by the Department of Planning Services. The Mylar and additional requirements shall be recorded within one hundred twenty (120) days from the date the administrative review was signed.The applicant shall be responsible for paying the recording fee.
