HomeMy WebLinkAbout20200582.tiffRESOLUTION RE: ACTION OF BOARD CONCERNING CHANGE OF ZONE, PUDZ18-0006, FROM THE A (AGRICULTURAL) ZONE DISTRICT TO THE PUD (PLANNED UNIT DEVELOPMENT) ZONE DISTRICT FOR 300 LOTS WITH R-1 (LOW DENSITY RESIDENTIAL), R-2 (DUPLEX RESIDENTIAL), R-3 (MEDIUM DENSITY RESIDENTIAL), R-4 (HIGH DENSITY RESIDENTIAL), AND C-1 (NEIGHBORHOOD COMMERCIAL) ZONE DISTRICT USES WITH 14.1 ACRES OF OPEN SPACE AND ONGOING OIL AND GAS ACTIVITY - ALF EQUINOX TODD CREEK VILLAGE NORTH, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of January, 2020, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the application of Alf Equinox Todd Creek Village North, LLC, P.O. Box 50233, Colorado Springs, Colorado 80949, for a Change of Zone, PUDZ18-0006, from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for 300 lots with R-1 (Low Density Residential), R-2 (Duplex Residential), R-3 (Medium Density Residential), R-4 (High Density Residential), and C-1 (Neighborhood Commercial) Zone District Uses with 14.1 acres of open space and ongoing oil and gas activity, on the following described real estate, to -wit: Lot B of Recorded Exemption, RE -4462 and Lot B of Recorded Exemption, RE -433; being part of the W1/2 of Section 35, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, deemed it advisable to continue the matter to February 12, 2020, at 10:00 a.m., to allow the applicant adequate time to accomplish necessary meetings with the City of Fort Lupton and the Todd Creek Village Metropolitan District regarding intergovernmental agreements for the provision of sewer service, and WHEREAS, on February 12, 2020, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, finds that this request be approved and the matter should again be continued to October 28, 2020, at 10:00 a.m., to allow the applicant adequate time to work on the terms and provisions of the Intergovernmental Agreement between the Todd Creek Village Metropolitan District and the City of Fort Lupton.
