WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that William E. Monson
and Joseph M. Monson, Greeley, Colorado, are the owners of
approximately 71. 804 acres of land located in the Southwest Quarter
of Section 29, Township 6 North, Range 65 West of the 6th P. M. ,
Weld County, Colorado, and more particularly described as follows:
Beginning at the South Quarter Corner (Si Cor) of
said Section 29, and considering the South line of
said Section 29, as bearing North 90°00'00" West,
with all other bearings contained herein relative
thereto;
Thence North 90°00'00" West, along the South line
of said Section 29, 11. 32 feet to the True Point of
Beginning, said point being the Centerline of a Private
access road;
Thence North 05°50'32" West, along the Centerline
of said Private access road, 2630. 75 feet to a point
on the South Right-of-way line of the Union Pacific
Railroad; thence North 88°57'57" West, 727. 08 feet;
Thence on a line bordering the South Right-of-Way
line of the Union Pacific Railroad the following eight
(8) courses and distances:

containing 71. 804 acres, more or less, including a strip
of ground 30 feet in width along the South line of said Sec-
tion 29, reserved for County Road Right-of-way purposes
and is subject to any rights-of-way or other easements as
recorded by instruments of record or as now existing on
said parcel of land, and
WHEREAS, the Monsons are desirous of selling approximately
five (5) acres, more or less, of this land and keeping approximately
66.804 acres, more or less, unto themselves, and
WHEREAS, it appears that to accomplish said sell, the Monsons

may apply for a Recorded Exemption from the Subdivision Regulations
of Weld County, as same as defined in Section 9-4 of the Weld County
Subdivision Regulations, and
WHEREAS, in addition to evidence presented by the Monsons,
the Weld County Planning Commission staff has presented evidence
and made representations concerning the desirability of granting
said variance, and
WHEREAS, the Board of County Commissioners feels that when
all of the evidence and representations are considered, good cause for
granting a variance from the minimum lot size requirements of the Weld
County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the
powers granted to the County under Chapter 106 CRS 1963 and Section
9-4 a(6), Weld County Subdivision Regulations as amended; that the
Monsons are granted as exemption from the lot size requirements of
the Weld County Zoning Resolution.
BE IT FURTHER RESOLVED, that this Exemption is allowed
so that the Monsons may proceed to apply for a Recorded Exemption
and the lot size variance is conditioned on the Monsons applying for and
doing all necessary to obtain said Recorded Exemption within one (1)
year, and said variance is limited to the Monsons, and will terminate
if they sell or otherwise discontinue their interest in the above men-
tioned land prior to obtaining approval for and recording the above
mentioned Recorded Exemption.
BE IT STILL FURTHER RESOLVED, that this Exemption is
allowed under the following additional conditions, to-wit:
1. Applicants must follow the Weld County Engineer's recom-
mendations regarding access to subject property and as to proper
drainage.
2. That Weld County will not maintain access to subject property.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 6th day of
November, A. D. , 1974.

Dear Sirs:
The attached application, plat and other items are in reference to a request,
by William and Joseph Monson, for a Recorded Exemption. The parcel in
question contains approximately 72 acres currently zoned commercial .
Based upon the information submitted and Weld County Regulations for
Recorded Exemptions, the Planning staff recommends approval for the
following reasons:
1 . The proposed land split complies with the Weld County Compre-
hensive Plan and the Intent Clause, Section 9-2, of the Weld
County Subdivision Regulations, in-so-far as it is a more
productive use and compatible with surrounding agricultural
uses.
2. Application guidelines have been satisfied.
3. Access to the proposed five (5) acre lot will be provided via
i private access off County Road 64.
