RE: NOTIFICATION OF MINERAL INTEREST OWNERS AND LESSEES
The undersigned Applicant certifies compliance with the provisions of C.R.S. § 24-65.5-
103(1), and in support thereof, states and certifies as follows:
I. That Applicant has provided notice, (a copy of which is attached hereto as
Exhibit "A"), containing the time and place of the initial public hearing on its application
for Case Number IMT] O-1 -0048, the nature of the initial public hearing, the legal
description by section, township and range of the property which is the subject of the
initial public hearing, and the name of the applicant;
2. That said notice was provided thirty (30) days prior to the scheduled
public hearing, that it was provided by certified mail, return receipt requested, or by a
nationally recognized overnight courier;
3. That said Exhibit A includes the list of the names and addresses of the
surface owners, mineral estate owners and lessees of mineral interests to whom the notice
was sent, including those persons who have requested receipt of such notices, pursuant to

A Public Hearing will be held before the Weld County Planning Commission on November 17 at
12:30 p.m. regarding Weld County 1 iMIJUSR2O-15-0048. The hearing will take place in the
Hearing Room, Weld County Administrative Building, 1150 O Street, Greeley, Colorado.

A Site Specific Development Plan and Amended Use By Special Review Permit for a solid
waste disposal site and facility (a designated commercial exploration and production waste
management facility) that will receive non -hazardous wastes that may contain very low
concentrations of naturally occurring radioactive materials (NORM) and technically enhanced
naturally occurring radioactive materials (TENORM) pursuant to the Colorado State Statute and
as defined and regulated by Colorado Department of Public Health and Environment and obtain
a Certificate of Designation, pursuant to Section 30-20-104 C.R.S. in addition to accepting
Construction and Demolition (C&D) Waste, and Industrial Waste, the addition of two (2) new
storage buildings and a company only heavy equipment parking area outside of Subdivisions
and Historic Townsites in the A (Agricultural) Zone District.

SUBJECT: 1 MJUSR2O-15-0048 Pawnee Waste LLC
Conditions of Approval
The Department of Planning Services is requesting to delete Condition of Approval 1.A under the
heading "Prior to recording the map" that states:
"The existing Improvements and Road Maintenance Agreement (Document 20170173
Amended per Document 20202400) shall be reviewed and revised appropriately. Road
maintenance includes, but is not limited to, dust control and damage repair to specified haul
routes. The Agreement shall include provisions addressing engineering requirements,
submission of collateral, and testing and approval of completed improvements." (Department
of Public Works)
The Department of Planning Services is requesting to delete Condition of Approval 1.B under the
heading "Prior to recording the map" that states:
"A Final Drainage Report and Certification of Compliance stamped and signed by a
Professional Engineer registered in the State of Colorado is required." (Department of Public
Works)
The Department of Public Works indicates that both of these Conditions of Approval have been met.

The Accepted Drainage Report was uploaded to Accela on the 22nd of Oct. (COA1.B. can be omitted) .
RMA update has been satisfied per 10 23 email (COA1.A. can be omitted).
USR map should include the access point and the roads associated — i.e. unmaintained CR 118 and the
intersection where this unmaintained road and CR 95 and maintained CR 118 come together.
