HomeMy WebLinkAbout740581.tiff RESOLUTION RE: AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS, WELD COUNTY, COLORADO, TO SIGN MEMORANDUM OF AGREEMENT (JOINTLY WITH THE CITY OF GREELEY) WITH REUBEN CROISSANT. WHEREAS, the County of Weld, State of Colorado, and the City of Greeley, Colorado, have jointly purchased the Peterson Farm for the benefit of the Weld County Municipal Airport, and WHEREAS, both the County of Weld and City of Greeley have applied for federal funds necessary to enlarge and update said airport, and WHEREAS, in order to obtain said federal funds it is necessary for both the county and the city to comply with certain rules and regulations regarding dislocation allowances and moving expenses of the present tenant (Reuben Croissant) on the aforementioned Peterson Farm, and WHEREAS, the Board of County Commissioners, Weld County, Colorado has determined (jointly with the City of Greeley) that it would be in the best interests of the county to enter into an agreement guaranteeing to Reuben Croissant (present tenant on said Peterson Farm) certain moving expenses and dislocation allowance pursuant to said federal rules and regulations. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that said agreement with Reuben Croissant, copy of which is attached hereto and made a part hereof by reference be, and it hereby is approved. BE IT FURTHER RESOLVED that the Board be, and it hereby is authorized to execute said agreement as submitted and to make the same effective forthwith. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 22nd day of May A. D. , 1974. WHEREAS, in order to comply with the federal relocation require- ments pursuant to Part 25 under Title 49 of the Federal Register, regard- ing relocation assistance and land acquisition and federally assisted programs, the Board of County Commissioners, Weld County, Colorado, and the City of Greeley, Colorado have entered into an agreement with Reuben Croissant, tenant on said Peterson Farm upon the following terms and conditions, to-wit: 1. That pursuant to Title 49 of the aforesaid Federal Register an advisory assistance program conference was had between the Board of County Commissioners, Weld County, Colorado, the City of Greeley, Colorado and Reuben Croissant, the aforementioned tenant on the Peterson Farm. 2. That Reuben Croissant was fully advised of the Department of Transportation relocation assistant rights to which he is or will be entitled to in the event that he moves away or ceases to farm said Peterson Farm premises. 3. That he was advised of his eligibility under the law to receive certain payments to cover all moving expenses and dislocation allowance in accordance with the aforementioned federal requirements. 4. That Reuben Croissant has no present plans to quit farming or to move away to another farm. NOW, THEREFORE, it is mutually agreed that in the event Reuben Croissant quits his farming operation or moves to another farm, he shall receive a flat moving expense of Two Hundred Fifty Dollars ( $250. 00) rather than maintain the necessary records to receive reimbursement for his actual moving expenses, in! IT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED that Reuben Croissant shall receive an additional sum of Two Hundred Dollars ( $200. 00) representing dislocation allowance which is considered to be fair and equitable to all parties. Dear John: Confirming telephone conversation had with you recently with regard to the above-entitled matter and especially concerning the question of just compensation to the Petersons for their farm in 1973, enclosed please find Affidavit properly executed by Mr. Thomas A. Richardson, who was the attorney representing the Petersons at the time that the transaction was consummated. I trust that this Affidavit is self-explanatory and hope that both Weld County and the City of Greeley are in absolute and in full compliance with whatever needs to be done in order to bring this matter to a speedy conclusion.
