We have received information on the proposed gravel mining on the property across the road from us — northeast corner of Roads 64 and 27. I may have mentioned somewhere along the way that I am Secretary and Board Member for the Whitney Irrigation Company. A pipeline/lateral to the Whitney runs through the middle of the Orr property and they are proposing to relocate it to run around the lake, rather than through it. There has been some initial conversation, but shareholders who use this lateral are concerned about the ditch continuing to run properly after the relocation. I believe one of the stockholders was going to submit a Structure Agreement to Applegate Group earlier this year, but it sounds like he had back surgery and may have not completed this. We would like to suggest to Weld County Planning that a conversation and most likely some sort of agreement needs to be in place between Orrlando/Applegate and the ditch as part of the approval of the USR. I know the County agrees the ditch needs to be protected in these types of situations.. So, my question is, at this point, would it be a good idea to fill out the referral form and submit a letter indicating concern about the realignment of the ditch? What else would you suggest? In the meantime, we will try to start a conversation with the applicant abut the realignment. Hi Angela, I wanted to follow-up with you on our conversation prior to your vacation about the concerns of the Bracewell Lake community. We support the proposed mining as long as our quality of life won't be affected do to the increase in noise, dust, and increased distractions on the curve creating more accidents. We are asking that the county require the owner to build a substantial berm from the north corner extending south past our subdivision to help reduce the noise levels and the unsightly construction zone. Our corridor has historically been ag with a predominant increase in residential growth. In 2014-2015 there was an RV storage facility that wanted to go in and the county rejected the USR because it was not congruent with the residential growth in the area. We would request that the county acknowledges that and requires the owner to comply with residential noise standards compared to the proposed industrial noise standards. As the county is aware there have been many severe and fatal accidents on the Bracewell curve and primarily from eastbound traffic. Having increased distractions on that curve will only create more accidents to an already dangerous road. I will be at the meeting tomorrow to represent our neighborhood. As you know, represent the Storms Lake Drainage District (District) which owns and operates a clay drainage tile line crossing a portion of the property which is the subject of the USR application. The clay tile line was installed in the early 1900s and has operated continuously. It appears that the Applicant proposes to use an existing access over the District's clay tile line for heavy equipment and trucks and to transport topsoil and up to 444,000 CY of overburden from the east part of the project to the proposed western stockpile. Because of the proposed substantial expansion of scope of use of the access, the District requests that the County condition any approval of the application on a requirement that the applicant enter into a crossing agreement with the District before the access can be used.
