ESTABLISHMENT PEST CONTROL DISTRICT KNOWN AS
EASTERN WELD PEST CONTROL DISTRICT
EXPIRES SEPTEMBER 1 , 1978:
WHEREAS, pursuant to the provisions of Chapter 6,Article
5 CRS, 1963, the Board of County Commissioners of Weld County, Colorado,
caused a ballot to be mailed to landowners in a given area , requesting
the establishment of the Eatern Weld County Pest Control District for
the eradication of grasshoppers, and
WHEREAS, statutes require that at least sixty six and
two-thirds (66 2/3) percent of said ballots representing more than
fifty-one (51 ) percent of the land, voted in favor of the proposed
district, and
WHEREAS, the Board believes it to be in the best interests
of the County to establish said District.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, that the Eastern Weld County
Pest Control District be and the same is hereby established, said area
more particularly described as follows:

Dear Sirs:
The ballots for voting the Eastern Weld Pest Control
District are hereby presented to the Board of County Commissioners
by the official counting board.
The total acres in the proposed district is 177,920 acres.
There was 138,101 acres balloted of which 105,081 acres are
deeded land and 33,020 acres are leased land. This is 77.6%
of all land in the district. There were 19 votes cast, 16
in favor, 2 opposed and 1 not a landowner in the district
any longer.
This .represents 81.3% of those voting voted in favor.
This district to remain in effect until September 1, 1078.

At the request of ranchers in Eastern Weld County petitions
have Leen circulated to begin the formation of a Pest Control
District for grasshoppers. The petitions and signatures are accord-
ing to the requirements as established by the Pest Control Act.
We request that the petitions be accepted as fulCi.11ing the
requirements and further request that we be permitted to distrib-
ute ballots to all landowners within the designated boundries,
to determine if a majority of landowners will favor the formation
of this district.

PROCEDURES .OR GRASSHOPPER CONTROL PROGRAM
I. Establish a Pest Control District
A. See attached procedures.
B. Critical points which should be checked:
1. Insure that proper percentage of landowners have petitioned •
and later voted for the establishment of the district.
2. Correct legal descriptions are given for the boundaries of
the district.
3. All pests desired are listed,
4. Each step listed herein is followed to the letter.
II. Obtain Governor's Major Disaster Declaration
A. Definition of major disaster--flood, drouth, blizzard, storm, insects
or other pest infestation, plant contagion, pestilence, epidemics,
hurricane, toronado, earthquake, and other catastrophies in any part
of the state and which is or threatens to be of sufficient severity
and magnitude and so widespread as to be clearly beyond the actual
and potential abilities of the local governmental units and other
agencies to deal with, and therefore to require summary action and
the expenditure by the state of public funds to prevent or alleviate
common distress or hardship to life and property.
B. Steps required for Governor's Disaster Declaration:
1. Country Commissioners of a respective county notifies Governor
that a major disaster has occurred or is eminent, or threatened ,
and a request that the Governor so determine and declare. Such
notification shall specify:
a. Exact nature of the disaster.
b. The area affected.
c. Facilities or funds which are or may be available by
the county.
d. Statement that private facilities and funds, as well as
any already designated by the state, federal, and local
governmental facilities and funds are unavailable or in-
adequate to alleviate or control the situation. (SEE COPY
OF TELEGRAM OF WELD COUNTY, 1968 ATTACHED)
2. County Commissioners of each respective county certifies to
Department of Agriculture the following facts about the area
within the county:
a. That a pest control district in said areas has been
established.
b. That 66 2/3% of the landowners have agreed to pay 100%
of the cost per acre for crop acreage , and 1/3 of the
cost per acre for range acreage.

3. State Department of Agriculture makes report to Governor with
facts to assist or substantiate Governor's decision concerning
declaring a major disaster.

4. If Governor declares major disaster, declaration contains:
a. Specific area or areas of major disaster.
b. Emergency measures to be taken to alleviate conditions.
c. Agencies responsible for administering program.
d. Agencies to cooperate with the agency who will administer
the: program.
e. Consent for contracts or cooperative agreements which may
be entered into with federal, state, local governmental
units, and private agencies. (SEE GOVERNOR'S .DECLARATION
OF WELD COUNTY, 1968)
III. Administering Grasshopper Control Program
A. The state and federal agencies define the area boundaries to be
• treated and estimate costs.
B. State Department of Agriculture requests Governor for the transfer
of funds from the Agricultural Emergency appropriation into an
active account to carry out the program. (SEE LETTER ON WELD COUNTY,
1968, ATTACHED)
C. Governor approves request and directs State Controller to make such
funds available.
D. The Department of Agriculture has, in the meantime, submitted an .
inquiry to all prospective bidders for aerial and insecticide firms
to see whether they are interested in bidding. (SEE PROSPECTUS ATTACHED)
E. The Department of Agriculture negotiates a Memo of Understanding with
the federal government which is a supplement to the overall Memo of
Understanding for the specific program or programs involved. In this
agreement the federal government agrees to provide 1/3 of the cost for
rangeland which will be treated, along with such technical personnel,
etc. , as are available.
F. The State of Colorado, through the Purchasing Department, issues invita-
tions to Bid to all applicators and suppliers of insecticide who have
indicated their interest. The state is the prime contractor. Each bid
must be accompanied by a bid bond.
G. The stateand federal plant pest control groups define the areas of
responsibility for each to carry out.
H. Location of airfields are established. These usually will require
leases whether established airfields or pastures are used.
I. Contracts are let and processed by the State Purchasing Department, as
well as other state officials who must sign.
a. Each bird must be accompanied by a performance bond. This amount

G.
b. Contractors must have Workmen's Compensation and Public
Liability insurance: Certification of these must be
given by the underwriter in writing to the State Depart- r
ment of Agriculture.
c. Daily flight and insecticide records, according to pre-
scribed forms, must be processed for each plane. These
must contain the flight number, volumes, etc. , as are
listed on established forms.
d. All expenditures involved must be accompanied with invoices.
Wherever possible these expenditures must have had prior
auorowl by the Purchasing Agent.
IV, Final Computations for Payments
A. These will be made by the state with joint approval by both f state and federal governments. These list all expenditures t
involved plus the proportionate cost to be borne by the !
ranchers, the state, and the federal government. (SEE 1968
COST ANALYSIS AS AN EXAMPLE)
B: Vouchers then are written and final payments made.
C. Any overpayments by ranchers in the initial collections are
reimbursed to the individuals involved.

We, the undersigned petitioners, constituting at least twenty-five
per cent of the resident landowners within a contiguous territory in said
county, and being desirous of forming a pest control district pursuant to
the provisions of Chapter 6, Article 5, Colorado Revised Statutes of 1963,
as amended, do hereby petition said Board of County Commissioners for that
purpose and represent as follow•:
1. That the proposed district is to be known: es the
Eastern Weld Pest Control District Pest Control District.
