RE: APPROVE GRANT APPLICATION FOR CORONAVIRUS (COVID-19) EMERGENCY
SUPPLEMENTAL FUNDING (CESF) PROGRAM AND AUTHORIZE ELECTONIC
SUBMITTAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Grant Application for the Coronavirus
(COVID-19) Emergency Supplemental Funding (CESF) Program from the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Sheriff's Office, to the U.S. Department of Justice, Office of Justice Programs, Bureau of
Justice Assistance, commencing January 20, 2020, with further terms and conditions being as
stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Grant Application for the Coronavirus (COVID-19) Emergency
Supplemental Funding (CESF) Program from the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, to
the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
authorized to electronically submit said application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

Brief description of the problem/issue: DRAFT
The WC Sheriff's Office requests approval to submit an application for the FY 2020 Coronavirus Emergency Supplemental Funding
Program. Weld County has received notice that it is eligible for an award of $39,047. The application for the funds needs to be
submitted by 11:59 p.m. eastern time on May 29, 2020 via the Grant Management System (GMS). We are also requesting that the
BOCC delegate authority for the Clerk to the Board to submit the grant application via GMS on behalf of the Chairman.
The Coronavirus Emergency Supplemental Funding (CESF) Program provides funding to assist in preventing, preparing for, and
responding to the coronavirus. Allowable projects and purchases include, but are not limited to, overtime, equipment (including law
enforcement and medical personal protective equipment), hiring, supplies (such as gloves, masks, sanitizer), training, travel expenses,
and addressing the medical needs of inmates in state, local, and tribal prisons, jails, and detention centers.
The Weld County Sheriff's Office would like to apply for $39,040 to purchase Medical Personal Protective Equipment, including face
masks, eye protection glasses and gloves.
The PPE will assist in preventing and fighting the outbreak of the Corona Virus by protecting staff, citizens, arrestees and inmates if
social distancing is not manageable, and infection might be present.
Sheriff Reams is in support of this application.
A copy of the Budget detail is attached for your review.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
• Authorize the Chair to sign the FY 2020 Coronavirus Emergency Supplemental Funding grant application for $39,040, along
with supporting grant documents.
• Deny the grant application. This will lead to either increased general fund dollars to fight the Corona Virus outbreak.
• Schedule a work session to discuss further.
Recommendation:
Authorize the Chair to sign and approve the FY 2020 Coronavirus Emergency Supplemental Funding grant application for $39,040.

Program Narrative
Problem
Corona Virus Outbreak
Project Scope and Objectives
The scope of this proposal is to minimize the exposure and infection with Coronavirus within the Weld
County Sheriff's Office by providing the staff with face masks, eye protection and disposable gloves.
The objectives are to 1) protect the employees from Coronavirus infections and 2) prevent spreading
the Coronavirus amongst staff, citizens, arrestees and inmates.
Project Design and Methodology
For both objectives, the grant will provide the sources to purchase Personal Protective Equipment
(PPE) for the Weld County Sheriff's Office staff who might be in close contact with individuals
confirmed or suspected to be infected with COVID19. The additional PPE will allow the Weld County
Sheriff's Office staff to follow Center for Disease Control and Prevention guidance for Law Enforcement
to prevent and fight the spread of the Coronavirus.
Under their guidance, the CDC recommends, among other PPE, the use of any NIOSH-approved
particulate respirator (i.e., N-95 or higher -level respirator) and eye protection (i.e., goggles or
disposable face shield that fully covers the front and sides of the face). The proposed budget
includes N99 masks, eye protection and medical exam gloves which will assist the prevention of
Coronavirus spread and therefore minimize the infection rate.
The Weld County Sheriff's Offices will use $39,040 of the grant funds to purchase 816 "N99"
masks at a total of $29,066, which will provide 2 masks for the 336 Sworn Officers and 1 mask
for each of the 105 civilian staff members plus 5% or 39 masks to cover breakage. In addition,
the funding will provide 441 protective safety glasses for all Sheriff's Office staff at a total of
$8,375 and 25 units of disposal medical gloves at a total of $1,599.
The funds are of critical importance to keep the staff, citizens, arrestees and inmates of the Weld
County Sheriff's Office protected.
Measurable impact
Weld County COVIDI9 data is currently being collected and will be analyzed over the next months
and years. The PPE will have a direct effect on flattening the infection rate curve.
Sustainability after the funding ends
Weld County Sheriff's Office will budget general funds in future years to have an adequate PPE
inventory for regular day to day operations.

The U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice
Assistance (BJA) is seeking applications for the Coronavirus Emergency Supplemental Funding
Program.
This solicitation incorporates the OJP Grant Application Resource Guide by reference. The OJP
Grant Application Resource Guide provides guidance to applicants on how to prepare and submit
applications for funding to OJP. If this solicitation expressly modifies any provision in the OJP
Grant Application Resource Guide, the applicant is to follow the guidelines in this solicitation
as to that provision.
Eligibility
The following entities are eligible to apply:
* States, U.S. Territories, the District of Columbia, units of local government, and federally
recognized tribal governments that were identified as eligible for funding under the Fiscal Year
(FY) 2019 State and Local Edward Byrne Memorial Justice Assistance Grant (JAG) Program
are eligible to apply under the Coronavirus Emergency Supplemental Funding (CESF)
Program solicitation. NOTE: Only the State Administering Agency that applied for FY 2019
JAG funding for a state/territory may apply for the state allocation of CESF funding.
The eligible allocations for the FY 2020 CESF Program can be found at:

For the purposes of the CESF Program, please note the following:
• The term "states" includes the District of Columbia, the Commonwealth of Puerto Rico,
the Northern Mariana Islands, the U.S. Virgin Islands, Guam, and American Samoa.
(Throughout this solicitation, each reference to a "state" or "states" includes all 56
jurisdictions.)
• The term "units of local government" includes a town, township, village, parish, city, county,
borough, or other general purpose political subdivision of a state, or a federally recognized
Indian tribal government that performs law enforcement functions (as determined by the
Secretary of the Interior). A unit of local government also may be any law enforcement district
or judicial enforcement district established under applicable state law with authority to
independently establish a budget and impose taxes; for example, in Louisiana, a unit of local
government means a district attorney or parish sheriff.
• All recipients and subrecipients (including any for-profit organization) must forgo any profit or
management fee.

A. Program Description
Overview
The Coronavirus Emergency Supplemental Funding (CESF) Program will provide funding to
assist eligible states, local units of government, and tribes in preventing, preparing for, and
responding to the coronavirus.
Statutory Authority: The CESF Program is authorized by Division B of H.R. 748, Pub. L. No. 116-
136 (Emergency Appropriations for Coronavirus Health Response and Agency Operations); 28
U.S.C. 530C.
Permissible uses of Funds
Funds awarded under the CESF Program must be utilized to prevent, prepare for, and respond
to the coronavirus. Allowable projects and purchases include, but are not limited to, overtime,
equipment (including law enforcement and medical personal protective equipment), hiring,
supplies (such as gloves, masks, sanitizer), training, travel expenses (particularly related to the
distribution of resources to the most impacted areas), and addressing the medical needs of
inmates in state, local, and tribal prisons, jails, and detention centers.
Expenditures which require prior approval — There are no specific prohibitions under the CESF
Program other than the unallowable costs that are identified in the DOJ Grants Financial Guide;
however, the following items should be identified during application and appropriately justified as
noted:
• Individual items costing $500,000 or more — if the recipient intends to purchase an
individual item that costs $500,000 or more, those item(s) should be identified and
thoroughly justified by the grantee and receive written prior approval from BJA post -award
through the submission and approval of a Grant Adjustment Notice (GAN). Costs must be
reasonable to receive approval.
• Unmanned Aerial Systems (UAS), Unmanned Aircraft (UA), and/or Unmanned Aerial
Vehicles (UAV) — if the recipient requests to purchase an UAS, UA, and/or UAV, Federal
Aviation Administration approval must be obtained as outlined here:
https://www.faa.gov/news/fact sheets/news story.cfm?newsld=22615. Documentation
related to these purchases should be included with the application or the applicant must
receive written prior approval from BJA post -award through the submission and approval
of a GAN.
Draw -down — Consistent with the CESF Program's purposes, which involve assistance in
responding to the present national emergency in connection with the coronavirus, OJP has
determined that eligible states (or State Administering Agencies) or units of local government
may draw down funds either in advance or on a reimbursable basis. To draw down in
advance, funds must be placed in an interest -bearing account, unless one of the exceptions

in 2 C.F.R. § 200.305(b)(8) apply. This interest -bearing account must be dedicated
specifically for the CESF Program award, and funds other awards or sources may not be
commingled with the funds in the account established for the CESF Program award. It is not
necessary that the interest -bearing account be a "trust fund." For additional information, see
2 C.F.R. § 200.305.
Prohibition of supplanting — Funds may not be used to supplant state or local funds but must
be used to increase the amounts of such funds that would, in the absence of federal funds, be
made available.
Limitation on direct administrative costs — Funds may not be used for direct administrative
costs that exceed 10 percent of the total award amount.

Recipients have the option to request a one-time, up to 12 -month extension. The extension must
be requested via GMS no fewer than 30 days prior to the end of the performance period.

All awards are subject to the availability of appropriated funds and to any modifications or
additional requirements that may be imposed by statute.

Award recipients and subrecipients (including recipients or subrecipients that are pass -through
entities) must, as described in the Part 200 Uniform Requirements2 as set out at 2 C.F.R. 200.303,
comply with standards for financial and program management. See OJP Grant Application Resource
Guide for additional information.
Budget Information
This solicitation expressly modifies the OJP Grant Application Resource Guide by not incorporating
the "Limitation on Use of Award Funds for Employee Compensation; Waiver" provision in the
"Financial Information" section of the OJP Grant Application Resource Guide.

An applicant must submit its application through GMS, which provides support for the application,

E. Application Review Information
Review Process
BJA reviews the application to make sure that the information presented is reasonable,
understandable, measurable, achievable, and consistent with the solicitation. See the OJP Grant
Application Resource Guide for information on the application review process.
In addition, if OJP anticipates that an award will exceed $250,000 in federal funds, OJP also must
review and consider any information about the applicant that appears in the nonpublic segment of the

(currently, the Federal Awardee Performance and Integrity Information System, FAPIIS).
Important note on FAPIIS: An applicant, at its option, may review and comment on any information

assessment of the risk posed by the applicant.
Absent explicit statutory authorization or written delegation of authority to the contrary, the Assistant

Any recipient of an award under this solicitation will be required to submit the following
reports and data:
Required reports. Recipients typically must submit quarterly financial status reports, semi-
annual progress reports, final financial and progress reports, and, if applicable, an annual
audit report in accordance with the Part 200 Uniform Requirements or specific award
conditions. Future awards and fund drawdowns may be withheld if reports are delinquent.
(In appropriate cases, OJP may require additional reports.)

Background
Recipients' financial management systems and internal controls must meet certain requirements, including those
set out in the "Part 200 Uniform Requirements" (2.C.F.R. Part 2800).
Including at a minimum, the financial management system of each OJP award recipient must provide
for the following:
(1) Identification, in its accounts, of all Federal awards received and expended and the Federal programs under
which they were received. Federal program and Federal award identification must include, as applicable, the
CFDA title and number, Federal award identification number and year, and the name of the Federal agency.
(2)Accurate, current, and complete disclosure of the financial results of each Federal award or program.
(3) Records that identify adequately the source and application of funds for Federally -funded activities. These
records must contain information pertaining to Federal awards, authorizations, obligations, unobligated
balances, assets, expenditures, income, and interest, and be supported by source documentation.
(4) Effective control over, and accountability for, all funds, property, and other assets. The recipient must
adequately safeguard all assets and assure that they are used solely for authorized purposes.
(5)Comparison of expenditures with budget amounts for each Federal award.
(6)Written procedures to document the receipt and disbursement of Federal funds including procedures to
minimize the time elapsing between the transfer of funds from the United States Treasury and the disbursement
by the OJP recipient.
(7) Written procedures for determining the allowability of costs in accordance with both the terms and conditions of
the Federal award and the cost principles to apply to the Federal award.
(8) Other important requirements related to retention requirements for records, use of open and machine readable
formats in records, and certain Federal rights of access to award -related records and recipient personnel.

(criminal intelligence systems), 38 (regarding faith -based or religious organizations participating in
federal financial assistance programs), and 46 (human subjects protection).
(6) I assure that the Applicant will assist the Department as necessary (and will require
subrecipients and contractors to assist as necessary) with the Department's compliance with
section 106 of the National Historic Preservation Act of 1966 (54 U.S.C. § 306108), the
Archeological and Historical Preservation Act of 1974 (54 U.S.C. §§ 312501-312508), and the
National Environmental Policy Act of 1969 (42 U.S.C. §§ 4321-4335), and 28 C.F.R. Parts 61
(NEPA) and 63 (floodplains and wetlands).
(7) I assure that the Applicant will give the Department and the Government Accountability Office,
through any authorized representative, access to, and opportunity to examine, all paper or
electronic records related to the award (if any) made by the Department based on the application.
(8) I assure that, if the Applicant is a governmental entity, with respect to the award (if any) made
by the Department based on the application --
a. it will comply with the requirements of the Uniform Relocation Assistance and Real
Property Acquisitions Act of 1970 (42 U.S.C. §§ 4601-4655), which govern the treatment of
persons displaced as a result of federal and federally -assisted programs; and
b. it will comply with requirements of 5 U.S.C. §§ 1501-1508 and 7324-7328, which limit
certain political activities of State or local government employees whose principal
employment is in connection with an activity financed in whole or in part by federal
assistance.
(9) If the Applicant applies for and receives an award from the Office of Community Oriented
Policing Services (COPS Office), I assure that as required by 34 U.S.C. § 10382(c)(11), it will, to
the extent practicable and consistent with applicable law --including, but not limited to, the Indian
Self- Determination and Education Assistance Act --seek, recruit, and hire qualified members of
racial and ethnic minority groups and qualified women in order to further effective law
enforcement by increasing their ranks within the sworn positions, as provided under 34 U.S.C. §
10382(c)(11).
(10) If the Applicant applies for and receives a DOJ award under the STOP School Violence Act
program, I assure as required by 34 U.S.C. § 10552(a)(3), that it will maintain and report such
data, records, and information (programmatic and financial) as DOJ may reasonably require.
I acknowledge that a materially false, fictitious, or fraudulent statement (or concealment or
omission of a material fact) in this certification, or in the application that it supports, may be the
subject of criminal prosecution (including under 18 U.S.C. §§ 1001 and/or 1621, and/or 34 U.S.C.

CERTIFICATIONS REGARDING LOBBYING; DEBARMENT, SUSPENSION AND OTHER
RESPONSIBILITY MATTERS; AND DRUG -FREE WORKPLACE REQUIREMENTS
Applicants should refer to the regulations cited below to determine the certification to which they are
required to attest. Applicants should also review the instructions for certification included in the
regulations before completing this form. The certifications shall be treated as a material representation
of fact upon which reliance will be placed when the U.S. Department of Justice ("Department")
determines to award the covered transaction, grant, or cooperative agreement.
1. LOBBYING
As required by 31 U.S.C. § 1352, as implemented by 28 C.F.R. Part 69, the Applicant certifies and
assures (to the extent applicable) the following:
(a) No Federal appropriated funds have been paid or will be paid, by or on behalf of the Applicant, to
any person for influencing or attempting to influence an officer or employee of any agency, a Member
of Congress, an officer or employee of Congress, or an employee of a Member of Congress in
connection with the making of any Federal grant, the entering into of any cooperative agreement, or the
extension, continuation, renewal, amendment, or modification of any Federal grant or cooperative
agreement;
(b) If the Applicant's request for Federal funds is in excess of $100,000, and any funds other than
Federal appropriated funds have been paid or will be paid to any person for influencing or attempting
to influence an officer or employee of any agency, a member of Congress, an officer or employee of
Congress, or an employee of a member of Congress in connection with this Federal grant or
cooperative agreement, the Applicant shall complete and submit Standard Form - LLL, "Disclosure of
Lobbying Activities" in accordance with its (and any DOJ awarding agency's) instructions; and
(c) The Applicant shall require that the language of this certification be included in the award
documents for all subgrants and procurement contracts (and their subcontracts) funded with Federal
award funds and shall ensure that any certifications or lobbying disclosures required of recipients of
such subgrants and procurement contracts (or their subcontractors) are made and filed in accordance
with 31 U.S.C. § 1352.
2. DEBARMENT, SUSPENSION, AND OTHER RESPONSIBILITY MATTERS
A. Pursuant to Department regulations on nonprocurement debarment and suspension implemented at
2 C.F.R. Part 2867, and to other related requirements, the Applicant certifies, with respect to
prospective participants in a primary tier "covered transaction", as defined at 2 C.F.R. § 2867.20(a), that
neither it nor any of its principals --
(a) is presently debarred, suspended, proposed for debarment, declared ineligible, sentenced to a
denial of Federal benefits by a State or Federal court, or voluntarily excluded from covered
transactions by any Federal department or agency;
(b) has within a three-year period preceding this application been convicted of a felony criminal
violation under any Federal law, or been convicted or had a civil judgment rendered against it for
commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or
performing a public (Federal, State, tribal, or local) transaction or private agreement or transaction;
(c) is presently indicted for or otherwise criminally or civilly charged by a governmental entity (Federal,
State, tribal, or local) with commission of any of the offenses enumerated in paragraph (b) of this
certification; and/or
(d) has within a three-year period preceding this application had one or more public transactions
(Federal, State, tribal, or local) terminated for cause or default.

B. Where the Applicant is unable to certify to any of the statements in this certification, it shall attach
an explanation to this application. Where the Applicant or any of its principals was convicted, within a
three-year period preceding this application, of a felony criminal violation under any Federal law, the
Applicant also must disclose such felony criminal conviction in writing to the Department (for OJP
Applicants, to OJP at Ojpcompliancereporting@usdoj.gov; for OVW Applicants, to OVW at
OVW.GFMD@usdoj.gov; or for COPS Applicants, to COPS at AskCOPSRC@usdoj.gov), unless such
disclosure has already been made.
3. FEDERAL TAXES
A. If the Applicant is a corporation, it certifies either that (1) the corporation has no unpaid Federal tax
liability that has been assessed, for which all judicial and administrative remedies have been
exhausted or have lapsed, that is not being paid in a timely manner pursuant to an agreement with the
authority responsible for collecting the tax liability, or (2) the corporation has provided written notice of
such an unpaid tax liability (or liabilities) to the Department (for OJP Applicants, to OJP at
Ojpcompliancereporting@usdoj.gov; for OVW Applicants, to OVW at OVW.GFMD@usdoj.gov; or for
COPS Applicants, to COPS at AskCOPSRC@usdoj.gov).
B. Where the Applicant is unable to certify to any of the statements in this certification, it shall attach
an explanation to this application.
4. DRUG -FREE WORKPLACE (GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug -Free Workplace Act of 1988, as implemented at 28 C.F.R. Part 83, Subpart F,
for grantees, as defined at 28 C.F.R. §§ 83.620 and 83.650:
A. The Applicant certifies and assures that it will, or will continue to, provide a drug -free workplace by --
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is prohibited in its workplace and specifying the actions
that will be taken against employees for violation of such prohibition;
(b) Establishing an on -going drug -free awareness program to inform employees about --
(1) The dangers of drug abuse in the workplace;
(2) The Applicant's policy of maintaining a drug -free workplace;
(3) Any available drug counseling, rehabilitation, and employee assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations occurring in the
workplace;
(c) Making it a requirement that each employee to be engaged in the performance of the award be given
a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of
employment under the award, the employee will --
(1) Abide by the terms of the statement; and
(2) Notify the employer in writing of the employee's conviction for a violation of a criminal drug statute
occurring in the workplace no later than five calendar days after such conviction;
(e) Notifying the Department, in writing, within 10 calendar days after receiving notice under
subparagraph (d)(2) from an employee or otherwise receiving actual notice of such conviction.
Employers of convicted employees must provide notice, including position title of any such convicted
employee to the Department, as follows:

Notice shall include the identification number(s) of each affected award;
(f) Taking one of the following actions, within 30 calendar days of receiving notice under subparagraph
(d)(2), with respect to any employee who is so convicted:
(1) Taking appropriate personnel action against such an employee, up to and including termination,
consistent with the requirements of the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation
program approved for such purposes by a Federal, State, or local health, law enforcement, or other
appropriate agency; and
(g) Making a good faith effort to continue to maintain a drug -free workplace through implementation of
paragraphs (a), (b), (c), (d), (e), and (f).
5. COORDINATION REQUIRED UNDER PUBLIC SAFETY AND COMMUNITY POLICING PROGRAMS
As required by the Public Safety Partnership and Community Policing Act of 1994, at 34 U.S.C. § 10382
(c)(5), if this application is for a COPS award, the Applicant certifies that there has been appropriate
coordination with all agencies that may be affected by its award. Affected agencies may include,
among others, Offices of the United States Attorneys; State, local, or tribal prosecutors; or correctional
agencies.
I acknowledge that a materially false, fictitious, or fraudulent statement (or concealment or omission of
