RESOLUTION
WHEREAS, a public hearing was held on June 24, 1974, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of Zack McKinley, 397 Bush Street,
Brighton, Colorado, requesting a change of zone from "A" Agricultural
District to "C" Commercial District, Planned Unit Development, and
CD
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;

NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Zack McKinley, 397 Bush Street,
Brighton, Colorado, for change of zone from "A" Agricultural District
to "C" Commercial District, Planned Unit Development, said area being
more particularly described as follows:

6th P. M. , County of Weld, State of Colorado, more particularly
described as follows:
Commencing at the Northeast Corner of said Section 31; thence

is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning reso-
lutions of Weld County, Colorado.
3. That said change of zone herein granted is conditional only
for a period of twelve months from date hereof, on condition that
developer proceed with due diligence to begin development of the area
rezoned and submit plans for such development for the approval of the
Weld County Planning Commission and subsequent recording of said
plans in the office of the County Clerk and Recorder of Weld County,
Colorado; and that major construction shall commence thereon within
said twelve month period; otherwise, the County may take action to
rezone the property to its present classification.

In _reply to your telephone request of April 30 , 1974-, re-
garding the Brighton Planning Commission' s opinion of the re-
quested Commerci-al Unit -Development zoning on -th.e property lo-
cated at the Southeast corner of the Weld County Road lying
one mile North al the Adams-Weld County line and U.S. No . 8-5,
the site was inspected by me and found that grading was in
progress. Many storage tanks are now on the property.
I relayed to the Planning Commission that the request was
for a truck storage and repair. This use would comply to Brigh-
tons Industrial-One zone, which is the projected use according
to our Comprehensive Plan.
The Planning Commission's comments were to recommend that
access should be limited -to the County Road and that at least
25 feet in width -along the Highway and County Road should be re-
quired to be landscaped by the applicant .
Of course, the Planning Commission would prefer a cleaner
type of industry that would be more esthetically pleasing, but
we do realize the necessity of this type of business being lo-
cated close to major transportation _routes .

Mrs Clyde Malara was in the office on October 30, to Ale-
cuss a rezoning request which he will submit to the Weld
County Planning -Commission.
Based upon an on site inspection the _following recom-
mendations are forwarded -from the Brighton Planning Commis-
sion.
1, Commercial zoning is consistent with the existing
land use in the area.
2� -There is adequate access for commercial vehicles
from this property to U .S. B5.
3. Commercial zoning of this area is consistent with
• projected land use plan.
Based upon this on site inspection, the Brighton Plan-
ning Commission would recommend that Weld _County proceed
with format consideration of the request for rezoning.
