673/X/le- 7;17 f ,- i - RESOLUTION WHEREAS, a public hearing was held on Monday, April 10, 1972, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of J. R. Hasbrouch, Ault, Colorado, requesting permission for expansion of an existing feedlot operation on the following described property, to-wit: The North Half of the South Half of the Northwest Quarter (NzSzNW4) of Section Eighteen (18), Township Seven (7) North, Range Sixty-five (65) West of the Sixth P. M. , Weld County, Colorado, containing 40 acres more or less, and 7 WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the expansion of an existing feedlot operation, and WHEREAS, the said requested expansion of an existing feedlot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said feedlot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of J. R. Hasbrouch, Ault, Colorado, for expansion of an existing feedlot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by, the State Health Department. 2, That petitioner shall proceed with due diligence to expand said feedlot operation and that he shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said feedlot operation is completed, same shall not contain more than 8, 000 sheep at any one time. 4. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. It has been approved by the Health Department and there are favorable comments from the Extension office. There is no noted pollution problem and it is compatible with surrounding land use and zoning . If approved , it should be subject to approve' of the Larimer-Weld Canal , a maximum of 1000 head of cattle and construction to begin within one year of approval by the County Commissioners . Mr. Williams stated their facilities will accom- odate 1000 head . The drainage is toward the canal but because of the high ditch bank , there is no way for it go get into the canal . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr. Lorenson' s recommendations . Motion by Mr. Anderson , second by Mr. Nix . The site has been approved by the Health Department , there are no apparent soil , drainage or pollution problems . It is al- ready partially constructed . If approved , it should be subject to the approval of Ault , a maximum of 8000 sheep. Mr. Hasbrouch stated the request is for the expansion of the sheep corrals and not for an increase in the number of cattle. Mr. Nix stated he has observed the operation and felt it was a good location. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County. Commissioners subject to approval from the Town of Ault and a maximum of 8000 sheep . Motion by Mr. Anderson , second by Mr. Nix. A vote of "Aye" by Anderson , Heitman , Nix and Watson . SUBJECT : State Board of Land Commissioners DISCUSSION : Mr. Lorenson read a letter from the Dept. of Natural Resources regarding roads being built to new developments and subdivisions across state school lands without permits . 755 a They ask the cooperation of the County Commissioners in preventing the construction of such roads . SUBJECT: Colorado Information Bulletin DISCUSSION : Mr. Lorenson read an excerpt from the bulletin that the Colorado Environmental Commission recommended that the General Assembly enact a policy of revitalizing rural Colorado without stimulating in-migration . Coulson DISCUSSION : Mr. Lorenson stated Mr. and Mrs . Coulson have erected approx- imately 10 pens containing around 30 dogs at this time without applying for a permit. They knew the procedure to be followed as they had been denied on a previous application . Stated his first inclination is to recommend the application not be con- sidered until the violation is removed . However , if the Planning Commission approves the site , it would be a useless excerise to have them remove the existing facilities . It has been approved by the Health Department and there are no noted drainage or pollution problems . The nearest residence is 950 ' south . . Mr. Coulson stated he felt there was a misunderstanding . On the first appli- cation they had applied for a boarding and breeding kennel and understood they were denied on the boarding part of it. He was informed by his attorney that it was not necessary to get a permit for a breeding kennel . There was discussion regarding the number of dogs . RESOLUTION :- Be it therefore resolved to recommend approval to the Board of County Commissioners subject to a maximum of 250 dogs for a boarding and breeding kennel . The existing auto sales lot was estab- lished prior to zoning of the area and rezoning brings the zone into agreement with use . If approved , it should be subject to the approval by the Town of Milliken. The zoning inspector felt they were expanding and thought a zone change was necessary to bring the operation into conformance with the regulations . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the approval of the Town of Milliken . Motion by Mr. Watson, second by Mr. Anderson . It is the recommendation this application for an additional 20 ,000 head be approved . It has been approved by the Health Dept. and is compatible with surrounding land use and zoning. There was discussion regarding the run-off and the necessity of a lagoon. SUBJECT: 1972-73 Work Program DISCUSSION : Mr. Lorenson stated the State Planning Office has given us our budget for the next fiscal year for federal aid in planning . A list of work items had been submitted , primarily in the Regional work program . Mr. Lorenson read the information re- leased by the State Division of Planning . According to HUD re- quirements a 36 month work .program must be developed . It was agreed to schedule an all day work session to review the proposed zoning and subdivision regulations . DISCUSSION : Mr. Lorenson stated Bob Leigh , Gary Eastman and Jim Ohi have been working on the towns for the comprehensive planning portion as required by the State contract. Mr . Leigh stated there are two parts to the Comprehensive Plan , one is regional and the other deals with the individual communities . The reg- ional plan will set forth the relative roll of each of the communities and major cities in the region. If it does nothing more than define the area influence of the three major cities , it will be worthwhile . They are mapping the high quality class "A" agricultural soils , and determine where the conflicts will lie when the cities grow. The population projects show that each one will double in 20 years . The other part is to look at the flood plains , the sand and gravel resources , the whole area of agricultural land and the relationship of the various policies . At the town level , they are developing a comprehensive plan package for each one of the communities . This contains the basic statement of the town ' s own philosophy of it ' s self and it' s future . There will be a land use plan for the future and these are basically pegged to the population of the town itself. Based on the land use plan , the community and public facilities that are needed to support that plan will be ident- ified and laid out as well and formulated in the capitol improv- ment program so the town will know what it has to do and what the costs involved are and how it .can go about paying for the facil- ities . At the town level , a questionnaire has been prepared for their opinions to form the basis of the goals and objectives . These are being filled out by Gary and Jim through their meetings with the communities . They are preparing sketchs for land use plans for about 5 areas . By May they plan to get the whole thing finalized . There was discussion :regarding how the R. T. D.plans will mesh with the comprehensive plan .- Mr. Lorenson distributed Section V of the Subdivision Regulations that have been revised . Asked the members to review them before the work session is scheduled. Mr. Lorenson stated so far they could see no place that these regulations aren ' t following the States legislation that is being proposed. Mr. Cruce announced a meeting that has been scheduled to meet with the Fire Districts and the Water Districts regarding fire protection in new subdivisions and if the water. is available . Jim Ohi reported on the progress of developing comprehensive plans in the incorporated towns of the county. Mr. Anderson stated under the law , it will be mandatory for the school districts to work with the Planning Commission. Meeting adjourned .
