WHEREAS, a public hearing was held on Monday, April 12, 1971 at
two o'clock P. M. in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing the petition of Everett
D. Motz, Rt. 4, Box 115E, Longmont, Colorado, requesting approval of
site for a dog kennel operation on the following described property, to-wit:
A tract of land located in the Southeast Quarter (SE ') of
Section Twelve (12), Township Two (2) North, Range
Sixty-eight (68) West of the Sixth P. M. , Weld County,
Colorado, more particularly described as follows:
Beginning at a point on the east line of said Section 12
(which East line is used and described as N 000 00'
East, all bearing herein used in relation thereto) from
which the Southeast corner of said Section 12 bears
South 824. 0 feet, thence North 330. 0 feet along the east
line of Section 12, thence S 89° 15' 30" West, 1328. 61
feet, thence South 000 08' 33" West, 330. 0 feet, thence
North 89° 15' 30" East, 1329. 42 feet more or less to
the point of beginning, containing 10. 06 acres, more or
less, and
WHEREAS, the petitioner was not present but was represented by
his wife, Mrs. Everett D. Motz, and
WHEREAS, there was some opposition to the request of petitioner
for the location of a dog kennel operation, and
WHEREAS, the said requested location for a dog kennel operation
is located in an agricultural zone as set forth by the Weld County Zoning
Resolution, and
WHEREAS, according to Section 3. 3(3) of the Zoning Resolution
of Weld County, said dog kennel operation may be authorized on the
approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of the
petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, that the application of Everett D. Motz, Rt. 4, Box 115E,
Longmont, Colorado, to locate a dog kennel operation on the premises
indicated above be, and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. That said dog kennel operation shall not contain more than
thirty-five dogs at any one time.

3. That petitioner shall proceed with due diligence to effect
said dog kennel operation and that he shall have up to one year from
date hereof to begin construction of said dog kennel operation.
4. That all applicable sub-division and zoning regulations
shall be followed and complied with in accordance with the Zoning
Resolutions of Weld County, Colorado.

lot at the last meeting , subject to a proper legal description
being submitted , maximum of 35 animals and construction to be
completed within on year of approval . The use has been approv-
ed by the Health Department. Mrs . Motz agreed to submit the
necessary legal description .
RESOLUTION :
Be it therefore resolved to recommend approval to the Board
of County Commissioners subject to Mr . Lorenson ' s requests .
Motion by Mr. Watson , second by Mr . Anderson . A vote of "Aye"
by Anderson , Nix , and Watson . "Nay" by Bowles .
SUBJECT : Scheduling of hearings and procedure
DISCUSSION : Mr. Lorenson discussed the scheduling of hearings and
procedure between the Planning Commission and the County Com-
missioners . A proposed zoning application flow sheet has been
submitted to the County Commissioners . The flow sheet has been
approved by the County Commissioners . These items will have to
be followed before a zoning request is placed on the agenda .
Mr. Lorenson presented a procedural guide and a new zone app-
lication form . A procedural guide will be given to the applicant
to be returned 21 days before the hearing date .
MOTION : By Mr . Watson that the rezoning application and procedural
changes as presented by the Planning Director be apprpoved .

being duly sworn, deposes and says:
1. That he is the Owner and Publisher of The Greeley Booster
a weekly newspaper printed and published in the City of Greeley,
County of Weld and State of Colorado, which has been admitted
to the United States Mails as second class matter under Act of
Congress, of March 3, 1879.
2. That the said The Greeley Booster is printed and published
at regular intervals, one time each week, on Friday, and that it
has a general circulation in the County of Weld, and elsewhere.
3. That the said The Greeley Booster was established and has
been printed and published in said county uninterruptedly and
continuously during a period of at least fifty-two consecutive weeks
next prior to the first issue thereof containing said
Notice Docket No. 23
a copy of which is hereunto attached.
4. That the said The Greeley Booster is a weekly newspaper
of general circulation, and is printed and published in whole or in
part in the said County of Weld in which said
Notice Docket No. 23
is required by law to be published, a copy of which is hereto at-
tached.
5. That the said The Greeley Booster is a weekly newspaper
within the meaning of "An Act Concerning Legal Notices, Adver-
tisements and Publications and Fees of Printers and Publishers
Thereof and to Repeal all Acts and Parts of Acts in Conflict with
the Provisions of this Act," being Chapter 139 of the Session Laws
of Colorado of 1923 as amended by Chapter 113 of the Session
Laws of Colorado of 1931, and later amended by Chapters 155 to
156 of the Session Laws of Colorado of 1935.
6. That the said annexed

was published in the regular and entire edition of The Greeley
Booster, a duly qualified weekly newspaper for that purpose,with-
in the terms and meanings of the above named Acts.
