The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for farming and
gardening including structures for storage of agricultural equipment and agricultural products (storage and
distribution of bagged seed, grain and equipment storage) and accessory buildings with gross floor area
larger than four(4) percent of the total lot area in subdivisions and historic townsites in the A(Agricultural)
Zone District.
This project is north of and adjacent to Elm Street and is east of and adjacent to Railroad Avenue.
Parcel number 080318003002.
Access is from Elm Street.
ACCESS
Weld County Public Works has reviewed the application materials related to access. According to the
application materials the access for this project will be on Elm Street. Because this property is a corner lot
in a subdivision, no location on Elm Street will meet the minimum access spacing requirements for a local
road prescribed in Table 1 of Weld County Code, Sec. 8-14-30. The applicant shall contact Tiffnee Lamb
of Public Works (at 970-400-3718)to discuss acceptable access locations and secure an Access Permit, a
requirement for accessing a Weld County maintained roadways. Please refer to Chapter 8 of the Weld
County Code for more information regarding access.
ROADS AND RIGHTS-OF-WAY
Railroad Avenue is a paved road and is designated on the Weld County Functional Classification Map
(Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. According to the original
"North Greeley, Weld County, Colorado" plat dated March 16, 1892, there is an existing 200-foot Union
Pacific Railroad right-of-way, measured from the center of the railroad tracks extending eastward to the
western property boundary of the subject parcel. Railroad Avenue falls within the 200-foot right-of-way. It
is possible that the County has/had a long-term lease with the railroad company granting the County
permission to locate Railroad Avenue within their right-of-way; however, no lease has been discovered.
The applicant shall delineate and label on the site map the existing right-of-way (along with the creating
documents) and the physical location of the road. Pursuant to the definition of setback in the Weld County
Code, Sec. 23-1-90, the required setback is measured from the right-of-way line. This road is maintained
by Weld County.
Elm Street is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. According to the North Greeley
plat Elm Street has a 75-foot right-of-way. The applicant shall delineate and label on the site map the
existing right-of-way (along with the creating documents)and the physical location of the road. Pursuant to
the definition of setback in the Weld County Code, Sec. 23-1-90, the required setback is measured from
the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This
road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way
or easement. Right-of-Way Use Permit instructions and application can be found at
https://www.weldgov.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No traffic counts are available in the vicinity of this project.
According to the application materials, there will be two (2) semi truck roundtrips per week and two (2)
pickup truck daily roundtrips. All semi truck traffic will come/go from/to the north on Railroad Avenue
TRACKING CONTROL
Due to the limited traffic generated by this project, no upfront tracking control is required.
ROAD MAINTENANCE AGREEMENT
Due to the limited traffic generated by this project, no Road Maintenance Agreement is required.
DRAINAGE REQUIREMENTS
This area IS within a Non-Urbanizing Drainage Area: Non-Urbanizing Drainage Areas typically require
detention of runoff from the 1-hour, 100-year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1-hour, 10-year storm falling on the undeveloped site for NON-
URBANIZING areas.
Detention pond waived and a simple drainage narrative:
Per Weld County Code, Section 8-11-40.1., this project qualifies for an exception to stormwater
detention. The qualifying exception reads, "10. Parcels with total area less than, or equal to, 1.0 gross
acre."
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist
from the property.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
This site is located in a Municipal Separate Storm Sewer System (MS4)Area. However, per Lyndsay
Holbrook, the Weld County MS4 Administrator, no MS4 measures will be required due to the subject
property being less than one (1) acre in size and there being no development of surrounding lots during
the construction phase of this project.
CONDITIONS OF APPROVAL
The plan shall be amended to delineate the following:
1. Railroad Avenue is a paved road and is designated on the Weld County Functional Classification Map
(Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. According to the
original "North Greeley, Weld County, Colorado" plat dated March 16, 1892, there is an existing 200-

map the existing right-of-way(along with the creating documents)and the physical location of the road.

3. Show and label the approved access location, approved access width and the appropriate turning radii
(60') on the site plan. The applicant must obtain an access permit in the approved location prior to

5. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the

Prior to Construction:
The approved access shall be constructed prior to on-site construction. (Department of Public Works)
DEVELOPMENT STANDARDS(NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road,including damages
and/or off-site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Department of Public Works)
5. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

6. Weld County is not responsible for the maintenance of onsite drainage related features. (Department

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for farming and gardening
including structures for storage of agricultural equipment and agricultural
products (storage and distribution of bagged seed, grain and equipment
storage) and accessory buildings with gross floor area larger than four (4)
percent of the total lot area in subdivisions and historic townsites in the A
(Agricultural) Zone District.
One building will be constructed for storage of agriculture products and
equipment.
The applicant is proposing that employees utilize the restroom facilities located
at 33041 Railroad Ave, which is also owned by Lucerne, Inc. The system that
serves the office is permitted as G19909083.
We recommend that the following requirements be incorporated into the permit
as development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,

and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations.
5. Any On-site Wastewater Treatment Systems located on the property
must comply with all provisions of the Weld County Code, pertaining to
On-site Wastewater Treatment Systems. A permanent, adequate water
supply shall be provided for drinking and sanitary purposes.
6. Adequate drinking, hand washing, and toilet facilities shall be provided
for employees and patrons, at all times. The parcel addressed as
33041 Railroad Avenue, which is also owned by Lucerne Inc., can be
utilized for sanitary accommodations providing the property is owned or
rented by the applicant. Otherwise a portable toilet is required for this
facility.
7. For employees or contractors on site for less than 2 consecutive hours
a day, and 2 or less full-time employees on site, portable toilets and
bottled water are acceptable. Records of maintenance and proper
disposal for portable toilets shall be retained on a quarterly basis and
available for review by the Weld County Department of Public Health
and Environment. Portable toilets shall be serviced by a cleaner
licensed in Weld County, contain hand sanitizers and be screened from
existing adjacent residential properties and public rights-of-way.
8. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.
