Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and Use by Special Review for a Small Scale Solar Facility in A(Agricultural) Zone District This project is south of and adjacent to County Road 36 and is east of and adjacent to County Road 31. Parcel number 121110200018. Current access is from CR 36. ACCESS Weld County Public Works has reviewed the application materials related to access. The parcel has an existing permitted oil and gas access onto County Road 36 approximately 1,170 feet east of the intersection of County Road 36 and County Road 31 (AP19-00169). The parcel has an existing unpermitted access onto County Road 36 approximately 150 feet east of the intersection of County Road 36 and County Road 31. This access does not meet the minimum spacing criteria as included in the Table 1 below. The applicant shall obtain an access permit for a location that meets the minimum spacing criteria. The existing access shall be closed and reclaimed. The applicant has proposed an access onto County Road 31. This access shall be sited to meet the minimum spacing criteria as specified in Table 1 below. ACCESS Sec. 8-14-30. We strongly encourage you to discuss your access location with Public Works prior to laying out your site plan. All"preliminarily approved" accesses are subject to change during the access permitting process. Per Sec. 24-8-40, when feasible,there shall be no net increase in the number of accesses to a public road. Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHTS-OF-WAY County Road 36 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. County Road 31 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at https://www.weldgov.comidepartments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC Latest ADT (2013) on CR 31 counted 156 vpd with 31%trucks. The 85th percentile speed is 53 mph. Latest ADT (2013) on CR 36 counted 67vpd with 26%trucks. The 85th percentile speed is 51 mph. The traffic information submitted with the application materials indicates that during construction there will be approximately 38 vehicles per day (30 heavy trucks and 8 passenger vehicles). 100 % of the traffic will be going to the north on County Road 31 and west via County Road 36 to access Highway 85. The traffic information submitted with the application materials indicates that during operation there will be approximately 1 utility vehicle per month. This vehicle will have the same travel route as the construction traffic. TRACKING CONTROL Tracking control is not required for this project as there will be no access or travel onto paved County roads. ROAD MAINTENANCE AGREEMENT Public Works is requesting a Road Maintenance Agreement including, but not limited to, dust control and damage repair to specified haul routes during construction. DRAINAGE REQUIREMENTS The applicant has submitted a preliminary drainage report. A final drainage report that addresses the Weld County Solar Facilities Guidance Document shall be submitted. This drainage report must be stamped and signed by a professional engineer licensed in the State of Colorado. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL A. The applicant shall address the concerns of the Public Works Referral relating to the existing unpermitted access onto County Road 36 and the proposed access location onto County Road 31. (Department of Public Works) B. A Road Maintenance Agreement, during construction is required at this location. Road maintenance includes, but is not limited to, dust control and damage repair to specified haul routes during construction. (Department of Public Works) C. A Final Drainage Report that addresses the Weld County Solar Facilities Guidance Document and that is stamped and signed by a professional engineer registered in the State of Colorado is required. Show and label the approved access locations, approved access width and the appropriate turning radii on the site plan. The applicant must obtain an access permit in the approved locations prior to construction. (Department of Public Works) 4. Show and label the entrance gate if applicable.An access approach that is gated shall be designed so that the longest vehicle (including trailers) using the access can completely clear the traveled way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface be less than 35 feet. (Department of Public Works) 5. Show and label the drainage flow arrows. (Department of Public Works) 6. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. (Department of Public Works) Prior to Construction: A. The approved access onto County Road 31 shall be constructed prior to on-site construction. (Department of Public Works) B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Department of Public Works) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off-site tracking. (Department of Public Works) 3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. (Department of Public Works) 4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire an approved Right-of-Way Use Permit prior to commencement. (Department of Public Works) 5. The Property Owner shall comply with all requirements provided in the executed Road Maintenance Agreement. (Department of Public Works) 6. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public Works) 7. Weld County is not responsible for the maintenance of onsite drainage related features. Please refer to the proposed requirements listed below. Site Considerations 1. If the current site is vegetated ground or in a stabilized condition, minimize earth disturbance during construction. Maintain ground cover in good condition, during and after construction. 2. If proposed site slopes exceed 5%, energy dissipation or other erosion protection measures may be required. On steep sites, provide a vegetative buffer 1/6 width of the flow length of the panels at the downstream edge of the solar field for sediment/pollutant removal. 3. If on-site vegetation is not properly established and maintained to prevent erosion, additional erosion control measures may be required by the County. 4. Detention/Water Quality Pond Design Requirements 1. Type A/B Soils a. If the application is not proposing additional imperviousness other than the solar panels, the site meets the exception for not increasing the imperviousness of the site. b. Concrete pads, gravel roads, graveled storage areas/laydown yards, structures, and any large concrete bases/foundations will count towards impervious areas in the drainage design. c. Impervious areas larger than allowed in the Weld County Code Section S-11-40 (exceptions) may trigger the requirements of a drainage report and detention pond design. 2. Type C/D Soils a. The solar panels will be counted towards the overall impervious area for the site. The solar panels fields (panel area and rows between panels)should be calculated using a 25% imperviousness value. b. Concrete pads, gravel roads, graveled storage areas/laydown yards, structures, buildings and any other site features should be calculated using the Urban Drainage recommended imperviousness percentages. 3. MS4 a. Sites within the MS4 boundary may trigger water quality and other MS4 requirements. Report Information 1. If topsoil is being disturbed, indicate how is the impact being addressed: a. Reseeding b. Mulching c. Use of Hydraulic Growth Medium — i.e. Biotic earth d. Seed mix e. Irrigation during initial phase of establishment of vegetation f. Estimated time for establishment of vegetation 2. Site Design a. Provide information on the horizontal spacing of the panels and rows between panels. Verify the spacing is adequate to promote vegetative growth beneath the panels. b. Verify the vertical height of the panels is adequate to promote vegetative growth beneath the panels. c. Provide plan of site layout with information on row spacing and ground cover materials between rows. Show the layout of access roads, concrete pads, solar panel foundations, buildings or other site features on map. As no employees will be located at the site, permanent water and sewer is not required. Screened portable toilets, hand washing units and bottled water can be utilized during construction. We recommend the following requirements are incorporated into the permit as development standards: 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. During construction, adequate toilet facilities and handwashing units shall be provided. Portable toilets shall be serviced by a cleaner licensed in Weld County, contain hand sanitizers, be screened from public view and removed when construction is completed. 6. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Hello
