HomeMy WebLinkAbout20203422.tiffHEARING CERTIFICATION DOCKET NO. 2020-64.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0017, FOR OIL AND GAS SUPPORT AND SERVICE (THE PARKING, STAGING, AND STORAGE OF EQUIPMENT: SCRAPERS, DOZERS, ROAD GRADERS, COMPANY VEHICLES, SEMI -TRUCKS, AND ANCILLARY EQUIPMENT FOR PRODUCTION UNIT SET-UP [OIL AND GAS WELL PAD SET-UP] AND MAINTENANCE); A ROUSTABOUT; FOUR (4) CARGO (CONEX) CONTAINERS; AND THREE (3) 40 -FOOT BY 60 -FOOT STORAGE AND MAINTENANCE SHOPS OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - TEN SLEEP INVESTMENT GROUP, LLC A public hearing was conducted on November 25, 2020, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Chair Pro -Tern - EXCUSED Commissioner Scott K. James Commissioner Barbara Kirkmeyer Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Melissa King Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated September 11, 2020, and duly published September 16, 2020, in the Greeley Tribune, a public hearing was conducted on October 21, 2020, to consider the request of Ten Sleep Investment Group, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0017, for Oil and Gas Support and Service (the parking, staging, and storage of equipment: scrapers, dozers, road graders, company vehicles, semi -trucks, and ancillary equipment for production unit set-up [oil and gas well pad set-up] and maintenance); a Roustabout; four (4) cargo (conex) containers; and three (3) 40 -foot by 60 -foot storage and maintenance shops outside of subdivisions and historic townsites in the A (Agricultural) Zone District. On October 21, 2020, the matter was continued to November 25, 2020, to allow adequate time for the matter to be heard by the Planning Commission on November 3, 2020. Bob Choate, Assistant County Attorney, made this a matter of record. el Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and general location of site, and stated the Department of Planning Services sent out 14 referrals and ten (10) referral agencies responded. She provided the number of employees, hours of operation, described the landscaping and screening, the surrounding uses and the nearby residences. She outlined the required Plans/Agreements listed in the Conditions of Approval (COA), stated notice was sent to seven (7) surrounding property owners (SPOs) and one (1) letter Ce.PLC0ILIrP), PICJ(M►t_f0rs),-+`',i4(rte) 1zl1lo IZ,OZo 2020-3422 PL2766 HEARING CERTIFICATION - TEN SLEEP INVESTMENT GROUP, LLC (USR20-0017) PAGE 2 of concern was received, citing views, noise, safety, traffic and property values, as concerns. She indicated the site is located within the Coordinated Planning Agreement (CPA) and the three (3) mile referral area of the Town of Kersey, who requested the applicant appropriately screen outdoor storage. Ms. Aungst entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. e Melissa King, Department of Public Works (PW), stated the site has two (2) existing, unpermitted accesses onto County Road (CR) 50 and the applicant shall obtain an Access Permit for one (1) of the locations. She provided daily roundtrips and average speeds for CR 50 and the anticipated traffic associated with the site. She relayed PW is requiring tracking control and a Road Maintenance Agreement and presented the drainage and grading requirements. E Lauren Light, Department of Public Health and Environment, stated the Central Weld County Water District provides water to the property and a septic system, permitted for three (3) bedrooms, provides sewer for the existing residence. She indicated there are restrooms in the shop, serviced by an unpermitted septic system located under the concrete slab of the building, therefore, the applicant will have to install a need new septic system. She stated Development Standards (DS) #16-24 address Environmental Health items. e Rick Miller, applicant, stated he resides at the site. IR No public testimony was offered concerning this matter. El In response to Commissioner Kirkmeyer, Mr. Miller confirmed he has resided at the subject property for one (1) year, has had discussion with the neighbor to west and relayed the neighbor to the east is hard to get ahold of. He indicated the letter of concern was submitted by his son's uncle and suspected there had been misinformation communicated between the two men. Responding to Commissioner Kirkmeyer, Ms. Light confirmed a Noise Study had not been received and the Board agreed to delete DS #20 (permissible noise level), citing the lack of a Noise Study and given the site is in, and surrounded by, the A (Agricultural) Zone District. After discussion with the applicant regarding DS #3 (hours of operation) and DS #4 (number of employees), the Board changed the hours of operation to end at 6:00 p.m., and the number of employees to six (6). Commissioner Ross suggested adding "and downcast' to DS #25 and the Board agreed to all of the aforementioned changes. E No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. IR In response to Chair Freeman, Mr. Miller indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner James moved to approve the request of Ten Sleep Investment Group, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0017, for Oil and Gas Support and Service (the parking, staging, and storage of equipment: scrapers, dozers, road graders, company vehicles, semi -trucks, and ancillary equipment for production unit set-up 2020-3422 PL2766 HEARING CERTIFICATION - TEN SLEEP INVESTMENT GROUP, LLC (USR20-0017) PAGE 3 [oil and gas well pad set-upj and maintenance); a Roustabout; four (4) cargo (conex) containers; and three (3) 40 -foot by 60 -foot storage and maintenance shops outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Ross, and it carried unanimously. There being no further discussion, the hearing was completed at 10:21 a.m. This Certification was approved on the 30th day of November, 2020.
