Staff receive one phone call from a surrounding property owner who was in support of the USR. The Department of Planning Services recommends approval of this application with the attached conditions of approval and development standards. The Chair asked Staff if there are any geological hazards on this site. Mr. Hall said there are none. Staff said there was a mine shaft opening on Lot 6. The Colorado Geological Survey did have comments to place a structure buffer around the mine shaft opening. Mr. Hall said the old coal mine depths are approximately 400 ft deep. Hayley Balzano, Public Works, reported on the existing traffic, access to the site and drainage conditions for the site. Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on -site dust control, and the Waste Handling Plan. Staff suggested removing Development Standard 24 because it is the same as Deve opulent Standard 26. Commissioner Johnson indicated he had a previous appointment and requested to be excused. He left at 3:50 pm. Planning staff is asking for recommendation of approval on a resolution regarding Ordinance 2019-19, which contains amendment to three sections in Chapter 23 and two sections in Chapter 26. Mr. Flesher told the Planning Commission that the changes were described in the staff memo that was presented during today's lunch meeting. Commissioner Stille stated that staff has done a superb job of research and explanation to the Board. The Chair asked if there was anyone in the audience who wished to speak for or against these proposed code changes. No one wished to speak. For second reading, staff would like to propose addin , two additional revisions : 1 . For Sec . 23 - 5 -4300A regarding exceptions to the minimum lot sizes in historic townsites, instead of leaving:, the remainder after Subsection 5 unchnged , we would propose revising Subsecion c . as follows : " Of requested by the WCDPHE , :a master site plan of the HISTORIC TOWNSITE showing iocati . ns of wells and septic systems on all adjacent properties within the HISTORIC TOWNSITE , and " . Re wiring a plan of the entire townsite seemed to staff as overly burdensome on the applicant who may be applying for a waiver or one lot . 20 Staff also discovered a mistake that was made with the zoning code update ( Ordinance 2029 -02 ) . In Sec . 23 - 1-90 in the definition of "CRITICAL FACILITY" in aa1 ) e ) , "SEWAGE T * EATMENT PLANTS" should be "treatment plants" because this is in reference to water treatment plants, and it a02 ) , "wastewater treatment plants" should be "SEWAGE TREATMENT PLANTS" . These changes are shown in more detail following this memo . The following is a summary of the revisions presented at the worksession on November 4, 2019 : o Subsection 23 -4- 290 . B : Add a sentence allowing the Board of County Commissioners to authorize sand and gravel mining operations to operate outside of daylight hours . 20 Subsection 23 -4- 1100 . C : Insert a provision allowing cargo containers to be stacked if they are incorporated into a structure . 30 Subsection 23 - 5 -4300A05 : insert a provision ailowing the We d County ** epartment of Public Health and Environment ( WCDPHE ) to grant exceptions for historic townsite lots on public water . Currently the code only mentions exceptions for lots on Weil water . 4s Subsection 26- 1 -50 . B : Regional Urban Areas ( UAs ) require new development to be approves: oy Planned Unit Jeveioprnent, with certain exceptions . Staff proposes the foliawing updates to the exceptions : a. Repeal Subsection Lc., which refers to certain USRs in the Agricultural zone district and which is now outdated due to Ordinance 2019-02. Many of the uses are now approved by zoning permit (ZPAG). (See below.) b. Add domestic water pipelines, which may cross RUA boundaries and may be located in right-of-way. A USR is required in all zone districts. c. Repeal 2.a., Recorded Exemptions. This was proposed by the Board at the November 4 worksession. d. Change "mobile homes" to "manufactured homes" to match the term now used in Chapter 23. a Repeal 2.d., "Certificate of compliance", which refers to agricultural buildings that are exempt from certain building code requirements and which fall under uses by right and accessory uses, below. f. Remove the reference to geologic hazard permits, which were eliminated with Ordinance 2019-02. g. Insert "1041" before "WOGLA" to reflect the changes made with Ordinance 2019-10. h. Add zoning permits for uses permitted under the new Division 17, Article IV, Chapter 23 (ZPAGs). Many of these were formerly USRs in the Ag zone and were excepted from the PUD requirement. i. Add uses by right and accessory uses. These have not required a PUD in the past but were not listed in this subsection. 5. Finally, a minor error was found in Section 26-4-50.D.1.e), which is in the subsection on Suburban Neighborhoods but contains a reference to "Neighborhood Mixed Use," which is the subject of the prior subsection (26-4- 500C).
