The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for six (6) cargo
containers in the A(Agricultural) Zone District
This project is north of and adjacent to 175th Avenue.
Parcel number 146733101003.
Access is from 175th Avenue.
ACCESS
Weld County Public Works has reviewed the application materials related to access.
Parcel has existing unpermitted access onto 175th Avenue approximately 1,000 feet west of the intersection
of 175th Avenue and County Road 7. Applicant shall obtain access permit for a location that meets minimum
spacing criteria as specified in Table 1 below and that meets the appropriate geometric design.

An access approach that is gated shall be designed so that the longest vehicle (including trailers) using the
access can completely clear the traveled way when the gate is closed. In no event, shall the distance from
the gate to the edge of the traveled surface be less than 35 feet. (Department of Public Works)
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure
the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there shall be no
net increase in the number of accesses to a public road. Minimum access spacing are shown in Weld
County Code, Sec. 8-14-30 Table 1. Please refer to Chapter 8 of the Weld County Code for more
information regarding access.
ROADS AND RIGHTS-OF-WAY
175th Avenue is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County
Code, Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that
physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way
or easement. Right-of-Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No traffic counts are available for 175th Avenue. However, for County Road 7,the latest average daily trips
(2017) counted 1,788 vehicles per day with 10%trucks. The 85th percentile speed is 52 miles per hour.
The traffic information submitted with the application materials indicated that there will be approximately 6
daily passenger car roundtrips. On County Road 7, 50% of the traffic will be going to the north and 50% of
the traffic will be going to the south.
No additional traffic information appears needed.
DRAINAGE REQUIREMENTS
This area IS within a Non-Urbanizing Drainage Area: Non-Urbanizing Drainage Areas typically require
detention of runoff from the 1-hour, 100-year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1-hour, 10-year storm falling on the undeveloped site for NON-
URBANIZING areas.
Detention pond waived and a complete drainage narrative shall be submitted:
The applicant has requested an exemption but has not provided the complete required drainage narrative
substantiating that the site meets drainage exception 8. Development of sites where the change of use
does not increase the imperviousness of the site. Located in Sec. 8-11-40. Drainage Policy.
Submit a complete Drainage Narrative. The Drainage Narrative must describe at a minimum:
A. Any existing and proposed improvements to the property.
B. The exception being requested for consideration.
C. Where the water originates if it flows onto the property from an off-site source.
D. Where the water flows as it leaves the property.
E. The direction of flow across the property.
F. Previous drainage problems with the property, if any.
G. The location of any irrigation facilities adjacent to or near the property.
H. Any additional information pertinent to the development.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. A complete Drainage Narrative shall be submitted. (Department of Public Works)
B. The plan shall be amended to delineate the following:
1. 175th Avenue is a paved road and is designated on the Weld County Functional Classification Map

2. Show and label the approved access locations, approved access width and the appropriate turning
radii on the site plan. The applicant must obtain an access permit in the approved location prior to
operation. (Department of Public Works)
3. Show and label the entrance gate if applicable.An access approach that is gated shall be designed

4. Show and label the drainage flow arrows. (Department of Public Works)
DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Department of Public Works)
5. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public
Works)
6. Weld County is not responsible for the maintenance of onsite drainage related features. (Department
of Public Works)

Environmental Health Services has reviewed this proposal for a Site-Specific
Development Plan and Use by Special Review Permit for six (6) cargo
containers in the A (Agricultural) Zone District.
Left Hand Water District and an on-site wastewater treatment system (OWTS)
permitted for two bedrooms serve the existing residence (SP-0400159).
The application indicates the containers are used for personal storage.
We recommend that the following requirements be incorporated into the permit
as development standards:
1 . Any On-site Wastewater Treatment System located on the property
must comply with all provisions of the Weld County Code, pertaining to
On-site Wastewater Treatment Systems.
2. A permanent, adequate water supply shall be provided for drinking and

Subject: USR20-0016 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV19-00151)was noted. This
violation was initiated due to the presence of more than 1 (one) Cargo Container within a recorded
subdivision(Ranch Eggs)without first completing the necessary Weld County Zoning Permits. This case
has been forwarded to the County Attorney's Office; therefore, an investigation fee IS required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff-initiated complaints. I do believe there to be multiple complainants.
Approval of this application by the Board of County Commissioners would correct the zoning violation;
however, building permits would need to be submitted after approval to avoid a building violation.
Additionally, neither the zoning violation case (ZCV19-00151), nor the associated court case (19-C-
37271) can be dismissed until the Conditions of Approval have been completed and the final map has
been recorded.
If this application is denied,this case will continue through the Violation process in County Court, Division
C (19-C-37271). The following conditions were called out on the court ordered Motion and Stipulated
Agreement.
Defendant agrees to diligently pursue the Use by Special Review (USR) application
process and attend all associated hearings, which should be scheduled on or before
October 28, 2020. Furthermore, Defendant agrees to supply any missing or additional
paperwork as necessary to complete the application process.
Defendant also agrees to provide evidence of ownership of all on-site vehicles stored
within the Screened area on or before September 18, 2020.
Our next County Court hearing is scheduled for November 2, 2020, Division C.

DEAR Mr. Nader:
I wish to submit the following information regarding the above referenced project.
The concerns of Farmers Reservoir and Irrigation Company are in the area of
encroachment to the Right of Way of the canal . FRICO requires a minimum of 25 ' on
each side of the canal for a maintenance road plus the distance to the toe of the ditch
embankment . The boundaries of the Right of Way must be agreed upon.
Drainage is another concern that must be addressed as FRICO does not allow any
developed storm flow into our canals . This will apply if any development happens .
Property concerns need to be resolved .
No construction of any structure can be put on our ROW. No use of any sort
including pedestrian or vehicle on our ROW is approved.
Please send drainage study and additional information regarding your project so
that we may complete our review and that review criteria can be sent to you , if
applicable .
FRICO does not accept retention ponds adjacent to our facilities , however , we
may grant a variance with submittal of application and engineering deposit for review of
drainage plan and other documents .
Canal road may not be used for access without approval and executed agreement.
FRICO will require a license agreement

We request to comment again .
The applicant has or X has not completed a Project Review Application and

Dear Mr. Nader:
I have reviewed the submitted material pertaining to the Special Use Review and Site Specific
Development Plan for 6 cargo containers at 2831 17511' Avenue for the storage of personal property (Case
Number: USR2.0- 0016 , Case Name : Edwards) .
The Fire District does not object to the use of the cargo containers provided they are used solely by the
owner for personal storage of personal property and no hazardous materials will be stored within the
containers. Storage shall be limited to the owner' s own property as indicated in the planning
questionnaire and the containers shall not be used to provide storage to outsiders wishing to lease
storage space.
Nothing in this review is intended to authorize or approve of any aspect of this project that does not
comply with all applicable codes and standards . We appreciate being involved in the planning process .
