Case # PRE16- 0060 was assigned. (April 1, 2016). • The proposed 2nd home was to be utilized by her son, Ian Jensen, to help Marie care for and live on the property. • In 2016, Alkire submitted the complete USR application to Chris. Case # USR16-0040 was assigned. (November 7, 2016). • In 2017, Alkire withdrew the application and received the application fee refund, because Ian was not ready to move to Colorado. (August 4, 2017). It is unclear why the case had not been processed from November 2016 to August 2017. • In 2018, Alkire received building permits (ASN18-0092) and constructed an accessory structure (approx. 850 sf) in the rear of her property (visible on map). This was going to be the 2"d home but instead it is an art studio/storage building. • In early 2019, Alkire contacted the Planning Department and wanted to continue the 2"d home process because now her son was ready to move to Colorado and to permit the new 850 sf structure as a 2"d home. • Alkire was incorrectly told by Planning staff about the pending zoning code change (Ordinance 2019-02) and that she could apply for a ZPAG to permit the second home, except she would have to wait until after July 25, 2019 to apply. • Alkire re -prepared her application documents and obtained a letter dated April 23, 2019 from the North Weld County Water District that allows her to share a water tap for both homes. This letter honors the 2016 water 3 service letter and waives the current NWCWD policy which requires all 2nd homes to have their own tap, a policy which began around 2017. • Alkire came into the Planning Department on July 26, 2019 to apply. I then explained to her that in fact, she was NOT eligible for a ZPAG as her property was located in Northwest Estates Subdivision which requires a USR permit. She had been given incorrect information as ZPAGs for 2nd homes are only permitted outside of subdivision per WCC Section 23-3-35.W. I also revealed to her that based of the new code change, she is only eligible to apply if her lot is at least 2.5 acres per WCC Section 23-4-600, a rule which became effective July 25, 2019. Her lot unfortunately is approximately 2.25 acres and therefore does not meet the new USR 2nd home requirement. • She was heartbroken and distraught after I told her the situation. She explained she would have applied before July 25 but thought she had to wait for the WAG. Would Planning staff, legal and the Commissioners support accepting the application due to extenuating circumstances?... It does not seem right to penalize Ms. Alkire and barring her from applying for the USR because 1. She already had a complete application ready in 2016. 2. The structure to be used for the second home is already built. 3. North Weld County Water District is allowing her to share one tap between both homes, because the request was reviewed prior to them requiring one tap per home. 4. She talked to Planning staff and was told to wait until after July 25, 2019 to permit the 2"d home as a ZPAG and this was wrong information. Based off the above situation, I believe we should process the application. If we are allowed to proceed with the USR application, I would request that I take over this case from Chris Gathman. See attached aerial map and Northwest Estates Plat for reference. Please advise.
