General Comments :
1 . Document :
a. Section 22-2-60 : Natural resource goals and objectives : Preservation of wetlands and
critical habitats. Are there or will there be any requirements for ecological reports or
mitigation requirements when development is proposed in areas of ecological
significance? This helps mitigate or aid in protecting unique habitat and migration
patterns.
b . Section 22-4- 10 : Comprehensive plan map . Opportunity zones are mentioned below.
Townsites/Residential Constraints layers are not visible with the City Layer on top.
Staff recommends that you move the order of the layers so that these are visible .
Please show the IGA boundaries on each map. This will facilitate reviews for all
municipalities that have an IGA with the County .
c . Opportunity Zones :
i . Are essential , but the methodology may counter long-term goals of the County
and the City in two manners : 1 ) An overconcentration of
industrial/commercial corridors such outdoor storage or RV parks lessens the
opportunity for employment centers along these corridors. Objective GC- 1 . 1
of the Imagine Greeley Comprehensive Plan states that the City must manage
growth to maintain or improve quality of life for Greeley ' s residents by
helping fortify the employment base in these corridors, and 2) Having an
overconcentration of industrial uses may visually impact the entryway

corridors of the City as well as minimizing impacts to the natural environment
and enhancing natural features
ii The "opportunity zones" called out in the comp plan may conflict with access
control along arterials
iii It may also conflict with future land use opportunities Stripping out
commercial/industrial uses only along these corridors may incentives
undesired uses along said corridors, especially if they are meant to be
preserved
d Appendix 22-B Subarea Planning Will there be any school dedication sites in large
residential projects within the County If for example, a large subdivision project is
proposed within the County, but also lies within the District 6 boundaries, how will that
coordination take place to ensure that the developer dedicates land/cash-in-lieu for
school Greeley has recently adopted school dedication requirements within its
municipal boundaries to ensure that schools are constructed to keep up with the demand
of the population growth

Dear Mr. Flesher and Mr. Pinkham :
Thank you for the opportunity to comment on both the Weld County 2020 Comprehensive Plan Update
and the 2045 Transportation Plan . After reviewing both plans and comparing these with our adopted
long range planning documents, the City of Brighton has the following comments and suggestions :
Draft Comprehensive Plan / Draft Comprehensive Plan Map
1 . We generally agree that intensive land uses should be located within municipal boundaries and
appreciate the efforts you have made to create the Comprehensive Plan Map and associated
guidelines . One concern we had with the map is whether prospective buyers or developers will
understand that development within the city is not guaranteed . We suggest adding language
that indicates annexation , development approval , or service provision by the city is not
guaranteed and the applicable city should be consulted .
2 . The opportunity zones identified on the map cover every major transportation corridor in Weld
County . Focusing commercial and industrial uses along these major transportation corridors
makes sense from an infrastructure perspective, but can also change the character or perceived
character of an area . Highways and arterials are gateways to Weld County and the communities
within . We suggest the inclusion of design standards for the opportunity zones that address
landscaping, buffering, fencing, and screening . Design standards can allow businesses to be
conveniently located on major transportation corridors , but also improve the visual character of
these corridors . In addition , the inclusion of design standards would contribute to the land use
goals and objectives stated in the draft plan including :

Draft 2045 Transportation Plan
1 . Looking at the draft Functional Classification Map as it pertains to Brighton ' s growth area ( WCR
2 to WCR 6 between WCR 19 and WCR 33 ) , the only north -south connections shown are WCR 19
and Main Street/Denver Avenue . We would appreciate your consideration in adding a few
important north -south connections that are already included in our Transportation Plan :
a . Collector along the WCR 27 alignment
Main Street/Denver Avenue is located on the west side of the UPRR and Brighton is
planning for significant industrial and employment uses east of the UPRR. An additional
north-south collector in this area is vital for future business access to Highway 85. This
becomes particularly important once the access modifications proposed by the Highway
85 PEL are implemented (closure of Hwy 85 access at WCR 2. 5 and WCR 4), as the only
north-south connection to the remaining access points on Highway 85 ( WCR 2 and WCR
6) in this area is Main Street/Denver Avenue.
b . Collectors along the WCR 23, WCR 29, and WCR 33 alignments .
c . In addition , we already consider WCR 31 a collector.
2 . East-west streets on the Functional Classification Map on Weld County' s GIS are also in conflict
with our Transportation Plan . Please consider the following adjustments :
a . Collector along WCR 4 ( WCR 21 to WCR 23 ) .
b . Streets that we already classify as collectors include WCR 2 . 5 ( Hwy 85 to WCR 29 ) and
WCR 6 ( Hwy 85 to WCR 33 ) .
3 . On page 70 of the draft plan , a future access control plan is mentioned for WCR 2 between WCR
11 and Interstate 76 . Brighton ' s Transportation Plan shows a realignment of Highway 7 up to
WCR 2 east of WCR 23 . Realignment of Highway 7 is proposed to alleviate congestion on Bridge
Street, Brighton 's " Main Street . " Weld County' s proposed access control plan and Brighton ' s
plan to realign Highway 7 should work together to improve this major transportation corridor
and serve the needs of both jurisdictions, with significant participation from each jurisdiction in
both efforts .

( WELD COUNTY COMPREHENSIVE PLAN )
The Weld County Comprehensive Plan , incorporated in the Weld County Code as Chapter 22 , is intended to guide
land use decisions in the unincorporated area of the County . It was originally created in 1973 and has since been
updated in 1987 , 1995, 2002 , and 2008 . The Comprehensive Plan update contains 10 goals and 37 objectives that
follow the goals . Staff respectfully requests the Planning Commission ' s recommendation of approval on the
proposed updates .
Items Removed from the Comprehensive Plan
• Strategies — The Planning Department will maintain a list of actions in a strategic plan , which can be
updated annually and need not be adopted into County Code . Planning staff will work with our
commissioner coordinator in the new year regarding the strategic plan .
• Regional Urbanization Areas ( RUAs ) — The previous version contained provisions for amending RUAs as
well as several related goals and policies .
• Transportation Plan — The transportation plan goals and objectives are in a separate document now .
Additions to the Comprehensive Plan
• Recreation and Tourism Element ( Article III ) addresses the requirement in state statute for a Recreation
and Tourism Element and briefly describes recreational opportunities and seasonal activities such as those
centered around harvest time .
• Subarea Planning Guide ( Appendix 22 - B ) outlines a typical subarea plan process and purposes .
• Comprehensive Plan Map (Article IV and Appendix 22 - D ) to guide rezoning and subdivisions and includes :
• Opportunity Zones — preferred locations for potential rezoning to commercial and industrial zones
based on proximity to railroads, highways , and higher classified intersections
• Appropriate Development Scale — areas for townsite, urban , non - urban and rural development;
current water districts
• Site Constraints — areas near residential subdivisions and floodplains that will require increased
mitigation measures
As stated in Section 22 -4- 10, designation on the map "does not guarantee a zone change application will be
approved . All applicable criteria in Chapters 23 or 27 of the Weld County Code must be satisfied in order for the
Board of County Commissioners to approve a zone change application , including location -specific attributes such
as surrounding land uses, topography, and availability of utilities . "

Thank you for providing Boulder County with the opportunity to participate in Weld
County ' s Comprehensive Plan update . Boulder County strongly supports and encourages
the comprehensive planning efforts of local jurisdictions which serve to guide development
in accordance with that community ' s vision for its future .
The Comprehensive Plan draft identifies several areas where Boulder County and Weld
County share similar goals, for example the preservation of agriculture . Boulder County also
recognizes the regional nature of development impacts, for example the number of trips
between Boulder County and Weld County are projected to double between now and 2040
and today, approximately 30% of people traveling on SH 1 19 between Longmont and
Boulder are from Weld and Larimer Counties . In recognition of these shared goals and
interconnectedness of the region Boulder County looks forward to deepening the
intergovernmental understanding of these areas of overlapping interest and developing
collaborative efforts between the counties as opportunities arise .

Comments on survey of 10 draft Comprehensive Plan goals
1 . I don ' t know much about the conservation/energy goals , but Goal #4 seems like a no-brainer !
Ault has added a huge development in the Conestoga neighborhood , but Highway 14 is in
such disrepair and in need of expansion that it makes me wonder why this isn ' t a priority ? This
road is a main Highway linking commercial transport from Highway 1 -25 to Highway 85 , it is
essential for many daily commuters yet it remains one lane each way with very little
opportunities to safely pass going 65 miles an hour up and down hills . Please , please update
this Highway !
2 . We need to focus on the diversification of our economy and less so on industry that is on its
way out . The future in 2050 is not that of fossil fuels , and we cannot let our energy workers be
left behind with our negligence . We need to attract industries that pay well to our regions and
adapt our economy to prepare for 2050 .
3 . Less emphasis on oil and gas development . It' s necessary to move forward into the 21st
Century with appropriate sustainable and non - polluting forms of energy . Greeley has been
hijacked long enough with the oil and gas industry ' s ( in some cases ) blatant disregard for
people and environment . I know it' s been a huge money- maker for Weld County but that' s
changing and Weld County needs to hurry that along . At the same time , we need a re-
education and re-skilling of the oil and gas workers so the county does not let them down now
that oil and gas are depleting . Those workers have been the ones making money for this
county .
4 . Please preserve agriculture in Weld County ! It' s beyond important !
5 . These were trick questions--can ' t support careful use of water without simultaneously
supporting water availability & availability of other resources for fracking , You Devils ! I want
you to protect clean air, clean water & clean soil by banning fracking !
6 . Keep our weld County weld County ! ! Do not develop on our farm and ag lands . . keep people in
greeley .
7 . Windsor is already turning into a crammed version of Loveland . Kersey is headed that same
way and so I s eaton Please stop building and destroying our beautiful County . We don ' t want
people moving here .
8 . Just say no to agenda 21 or agenda 2030 . If we can do some of these things without taking on
that agenda that would be great but It sounds very similar.
9 . Ensure that every acre of unincorporated arable land is protected which allows oil and gas
away from neighborhoods to embolden the backbone of Weld ' s economy - ag & oil .
10 . Would like to see additional comprehensive goals , regarding land use types , community
health , etc . Please consider explaining in the document the formal relationship between the
Comp Plan and other County comprehensive/master plans ( such as , health , environmental ,
transportation , etc . ) . Thanks !

1 . Don ' t plan a built out county . Protect Agricultural land and activities .
2 . Keep development to a minimum . . . where is the water going to come from for new developments?
3 . We moved out of Thornton to get some space . There are too many people on the roads there that
it is unsafe to drive . Keep people spread out and don ' t move a bunch of commercial property here .
I love the family residential feel of my town .
4 . Weld County needs to diversify its economy , protect its agricultural roots , stop relying on revenue
from the oil and gas industry and prepare for a fossil free future .
5 . Residential development as well as commercial development needs to be a priority .
6 . Quit planning around locations where commissioners live . Batch plant would have never been
approved next to Kirkmeyer. Just like she . made sure that storage facilities were not approved
because of traffic
7 . Would love to see greener areas in east Weld county .
8 . Slow down development .
9 . We need to migrate away from oil and gas operations across the county and focus on other
commercial and industrial development, for the health and wellbeing of our communities . Please
balance development and design of land use with the built environment , respecting citizens' air,
water and soils . I ' m gravely concerned about the plumes of thick , black smoke that I see all day ,
every day from construction equipment in my neighborhood (Colliers Hill in Erie ) . We can and
must insist on better environmental standards for these construction companies . "
10 . Maintain our agricultural heritage .
11 . Prevent the urban sprawl from Brighton , boulder and ft . collins from creeping into weld county .
12 . I believe that open space needs to stay open . I feel that farm /ranch land need to stay farm /ranch
land not turned into housing developments . Not all roads need to be paved . You can develop a
county by reusing empty building . There does not always need to be a building on every inch of
property .
13 . I would like to see it go back to that land in the country can not be used for developers to make
small subdivisions , as people move out here thing they live in the city do not obey the speed limits
(they think they are nonexistent and last maybe 2 -3 yrs then house sit empty and crime goes up .
More development means more need for police and we don 't have enough to cover what we have
now . Stop trying to get rid of our country properties and make it harder for development to
happen . Weld County is fine with what we have and do not need to grow any more
14 . affordable housing : over- inflating housing market does not match the salary range/job- base of the
population . If people cannot afford a home in this , they will move away . . . you lose your
employment base .
15 . We have a tremendous amount of growth and economic development , especially related to oil and
gas industries . It will obviously slow somewhat with the current slump , but it will continue for the
foreseeable future . It is imperative that Weld County balances this development, and the
accompanying population growth , with protecting agriculture . We don ' t want to become
Bakersfield CA .
16 . I would love to see the county prioritize trail and recreational development .
17 . Affordable housing . Smart development . Investment in infrastructure as growth happens not
reacting after the fact . These are all very important to keeping Weld County a desirable place to
live and work .
18 . I believe metro districts are not the right way to pay for growth . Way too much power/money is
given to ' a ' developer with not enough accountability ! My metro tax is more than my town tax . My
town could use the tax money to benefit the whole , with much more accountability .
19 . The turn around time to get applications approved for planning and zoning are lengthy . Expediting
the process would be an improvement .

20 Population is growing and economy, but I want to have clean air, a healthy community and
enough water in the future Please take care of natural resources by improving public
transportation and promoting recycling, increase green areas and supporting healthy living
21 Provide more single family homes To many apartments going in which makes for more
congestion with transportation and parking
22 Stay close to our agricultural roots It truly sets Weld County apart from the rest of Colorado
23 I thought Evans had done a pretty good job of planning for future growth in 2001 by putting in 4
lane roads, etc Who could have known that this area would grow so much? Now those same
roads are congested during rush hours I don't know how one looks into a crystal ball and plans for
the future However, planning more roundabouts and 4 -lane roads is a must At least, Weld
County can "keep up" with the growth without overspending and never seeing the return Along
with growth has to come industry, otherwise, in an economic downturn, Weld County will suffer I
hate to see growth replace our wide-open spaces, but if it's going to happen then we should
balance housing with business and still give plenty of incentive to the farmers and ranchers I
noticed that in Wiggins, there are expensive houses being built Well, that's just dandy for doctors
and lawyers, but the more of them move up there, the more they will demand other business to
move there and where are the workers going to live? I have seen subdivisions in which there are
a mix of residential housing so that all economic classes can benefit from the same resources
This is a good idea, I think
24 We moved here because of it being a Right to farm and the oil and gas
25 Don't negatively impact existing residential or prime agricultural lands with industrial
developments
26 Weld county has a lot to offer, but I am reluctant to buy a house there because there is no
guarantee that an oil development won't go up nearby or next door I think there is an opportunity
to realize trail corridors and use them as a way to preserve some visually appealing swaths of
land
27 I moved to weld from boulder, what I see in Boulder is too much development which in turn brings
too many left wing ideas And get more developers to help with road expansion
28 Development should be kept in the bigger cities Keep the rural parts rural
29 Weld County is a place very unique compared to our counterparts along the Front Range This
uniqueness comes from our strong ties to agriculture and our history with the Cache la Poudre
River However, our development seems to emulate that of much more urban areas, with a total
disregard to what makes Weld County and Greeley unique If we lose that history completely, we
will have failed our ancestors and our future generations at the same time
30 Slow the expansion of housing and industry, because farmers are already talking that there is not
enough water to go around

Keenesburg) seem to think they have all the right of way on our county roads and the people have
no rights to drive on them at all It does no good to talk to the Sheriffs office ---they will do

restrictions and lack of support to get through the process It almost takes professional help to
complete the necessary paperwork, which can be cost prohibitive for some We had to hire an
outside consultant to help us navigate the process and help us get our USR completed It was
very costly and stressful even though we had a consultant It takes too long to go through all the
steps to get it approved I feel that county staff is so geared to identifying ways to deny a use, that
they aren't willing to help or suggest possible alternative ways to meet compliance

supposed to be restricted to domestic use only, the first thing the buyers do is buy a bunch of
animals Doesnt seem like anyone is monitoring or enforcing that designation

oil runs out By all means get some good road grader operators that know how to cut ruts out and
fix a road Quit pulliing all the trash out of the ditch I'm tired of replacing tires

that is increasing congestion on county roads that don't seem to be keeping pace with the growth
I expect traffic in areas of growth, but it doesn't seem like roads are keeping up If a developer is
going to put in several hundred houses, it is most definitely going to increase traffic What worked
before safety -wise for the area before development is not adequate to handle that increased flow
As much as I hate them, a few well placed traffic lights and additional lanes would seem to cut
down on the dangerous stunts impatient people pull

lessen traffic jams and congestion
8 county roads are getting so narrow that it is dangerous for trucks passing each other and with
larger farm equipment much harder to get over to let vehicles pass

9 I believe that establishing effective public transportation throughout Weld County is going to be
imperative Specifically routes that encompass the whole county so all residents can easily get to
and from all areas of the county
10 Roads need to be maintained better Overall they are in decent shape, but there are certain roads
that have a lot of traffic and refilling potholes year after year doesn't always do the trick, especially
in the winter when the road freezes and plows go over the surface
11 I think the roads really need improvement specially in residential area The county road also
really needs more color ( lines) to help us to drive at night The white lines is fading away
12 There is no reason that the county cant address the rural roads We've put in thousands of dollars
to try to fix the road and it's barely made a dent

23 There have been some county roads annexed by the adjacent town/city which are in very poor
condition Example the county road south of the river by La Salle (Godfrey Bottom Road as the
locals refer) that is an Evans, CO responsibility Others personally experienced are CR 20 north
of CR 18 now maintained by Fort Lupton These towns gathered the tax revenue by annexation
for different reasons One for the taxes from a gravel mine, the other as I understand for future
residential and commercial growth The money isn't being spent on these roads to maintain them
properly Would think the Commissioners and Staff could come up with something short of
legislation which would make the towns keep these roads a priority Farmers have used these
roads, been spoiled with the good maintenance of the County, and the roads are in such bad
shape it is hard on vehicles and equipment
24 As for transportation - keep improving County roads and perhaps increase the number of roads
treated with dust retardant
25 You need to pay more attention to the roads that set already there, not to building more
26 stop putting in so many lights and stopsigns you ruin the flow of traffic in rural areas im sorry there
are bad accidents but we need better drivers not a stopsign every 2 miles As far as development
we need to slow down because western weld is going to become just like Lar?mer and Boulder
and this will become a blue county and you will all be out of jobs

spend more money on adding side walks that are never used, to more stop lights and adding
more roads and taking farm land and farm homes from people but we don't take care of the roads
we already have We have pot holes every where, weeds that block sidewalks so people walk on
the roads, to constantly making wider roads but more than half the area is decorative displays with
flowers or grass Reduce this area focus on using less land, work at picking up trash in areas to
keep the county clean We have over populated this area and only looks like trash any more We
have given up on caring for what our environment looks like
28 Highway 14 East has improved so far Highway 34 needs to be reworked to handle truck traffic,
cars, and visitors

hopes of urban renewal downtown Why do we invest so much in brand new land when we
already have so many parts of our city in downtown that could be great with a little more

Several people who completed surveys did not live in Weld County but said they owned land in Weld County (from Larimer and Morgan )
Several people commented on the good survey questions - said it really made them think (especially the questions asking them to prioritize)
Posters worked but not how we initially expected them too. They were more of a conversation starter - people stopped to look at them, which opened up disucssion

Several people commented on the 51st State - is it still a thing (KGAB recently ran an online poll which has gained attention)
Many people expressed concern about water and the future of water in this county; what are the plans to ensure we have enough water to accompany the growth

What Worked :
Easels were great ! Map of county drew people in so we could start a conversation.
Paper survey worked perfectly for ag crowd. (it actually took less time to do the paper survey)
People liked swag and some were inclined to take survey based on receiving swag.
Giving away free candy helped draw attention.
Helpful being by restrooms, ATM, concessions — people often waited by our booth.
Having chairs for residents to sit in while filling out the survey was good .
What Didn't Work:
fable was too big for booth — smaller table next time? Prevented people from interacting with all materials
Survey being two-sided was a bit of a hinderance; a lot of people thought the survey was one-sided. Number questions to minimize confusion as well.
Group rankings where 1 is most important and 3,4, or 5 is least important. See marked up survey for proposed order of questions.
First question should be worded: Where is your primary residence or property located in Weld County?
A lot of people asked what "unincorporated" meant. We should explain this on survey.
Instead of saying "other (list municipality)," it might be easier to say, "other (list town/city)."
iPads — didn't stay connected to network, screen protector was too thick. Hindered people's enthusiasm because they became frustrated with it.
People asked what "roadway infrastructure" meant — adding examples would be helpful .
If we keep paper surveys, we need at least three clipboards for times of heavy traffic.
Ideas for Future Events:
Infographic or flyer showcasing comp plan details — what it is, why we do it, key bullet points.
Consider putting survey online. Approx. six people didn't want to fill it out right then, they wanted to take it home and mail it back.

COUNTY COMPREHENSIVE PLAN UPDATE
The Weld County Comprehensive Plan , incorporated in the Weld County Code as Chapter 22 , is a policy
document intended to guide land use decisions in the unincorporated area of the County . It was originally
created in 1973 and has since been updated in 1987, 1995 , 2002 , and 2008 .
One of the main differences between the current Comprehensive Plan update and prior versions is that the
update is much shorter and more concise , which makes for a more readable and useable document .
ITEMS REMOVED FROM THE COMPREHENSIVE PLAN
• Strategies — The Planning Department will maintain a list of actions in a strategic plan , which can be
updated annually and need not be adopted into County Code . Planning staff will work with our
commissioner coordinator in the new year regarding the strategic plan . Most of this strategic plan
will likely consist of review and revisions to Weld County Code provisions relating to development,
though the Board may also want to begin conducting subarea plans . Coordinated Planning
Agreements with municipalities may be another primary focus .
• Regional Urbanization Areas ( RUAs ) — The previous version contained provisions for amending RUAs
as well as several related goals and policies . The RUAs are being eliminated by separate ordinance .
• Transportation Plan — The transportation plan goals and objectives are in a separate document now .
ADDITIONS TO THE COMPREHENSIVE PLAN
• A Recreation and Tourism Element ( Article III ) addresses the requirement in state statute for a
Recreation and Tourism Element and briefly describes recreational opportunities and seasonal
activities such as those centered around harvest time .
• A new Comprehensive Plan Map ( Article IV and Appendix 22 - D ) to guide rezoning and subdivisions
depicts :
• Opportunity Zones — preferred locations for potential rezoning to commercial and industrial
zones based on proximity to railroads, highways , and higher classified intersections .
• Appropriate Development Scale — areas for townsite , urban , non - urban , and rural development;
current water districts . This relates to the update of Chapter 24, Subdivisions , by separate
ordinance .

• Site Constraints — areas near residential subdivisions and floodplains that will require increased
mitigation measures
• A Subarea Planning Guide (Appendix 22-B) outlines a typical subarea plan process and purposes A
subarea plan may show more specific future land use categories than the Comprehensive Plan Map
based on analysis of existing conditions in the area and input from property owners and other
planning partners such as utility service providers
OPPORTUNITY ZONES
As stated in Section 22-4-10, designation on the Comprehensive Plan Map "does not guarantee a zone change
application will be approved All applicable criteria in Chapters 23 or 27 of the Weld County Code must be
satisfied in order for the Board of County Commissioners to approve a zone change application, including
location -specific attributes such as surrounding land uses, topography, and availability of utilities " The map
does not include the present zoning or uses of properties, so a zone change to commercial or industrial may
still be appropriate even if not shown as an Opportunity Zone, for example, if it is largely surrounded by
commercial or industrial uses or zone districts and it meets the other applicable criteria
Please note that the Opportunity Zones on the current draft Comprehensive Plan Map are based in part on
the existing Functional Classification Map, which Ordinance 2020-17 proposes to update The Comprehensive
Plan Map will be updated for second reading based on the draft Functional Classification Map update For
example, the Opportunity Zones on the north end of WCR 47 will need to be removed if this part of WCR 47
is downgraded to a local road

Public outreach for the Comprehensive Plan kicked off just before the Colorado Farm Show at Island Grove
at the end of January of this year The coronavirus outbreak limited opportunities for outreach at public
events after that but input was solicited online at www we1d2020vision com There participants could take
the same survey as was conducted at the Farm Show, as well as rate and comment on the draft goals of the
Comprehensive Plan Announcements regarding the webpage were sent out as a press release, on Facebook,
Twitter, the County Roots newsletter, and via postcard to people who had applied for a use by special review
within the last five years (508 postcards mailed) It was also mentioned in radio interviews with County
Commissioners
The webpage also informed people they could provide written comments via email, fax, or letter None have
been received Emails were also sent out to a number of people active in agriculture and development in the
County, in order to conduct "focus group" meetings both in person and via Skype
Staff also emailed all our referral agencies, which include Weld County municipalities, utility service
providers, fire districts, school districts, adjacent'counties, and many other agencies Mailed notice was sent
to the Air National Guard Base and the Department of Local Affairs in accordance with state statute
Comments were received from the cities of Greeley and Brighton and Boulder County and are available in
the supporting documents for this ordinance
SURVEY RESULTS
Responses to the surveys are also available in the supporting documents It is difficult to know if respondents
are referring to development in the unincorporated area in their comments, and it is nearly impossible to
know where municipal boundaries are without a map For example, there was a comment about too many
apartments being constructed, which clearly refers to development in a municipality since there are no
apartments in unincorporated Weld County Other comments conflict with each other, which is to be
expected Not everyone feels the same way about growth and development, though most people don't like
traffic
However, one theme in the comments is abundantly clear people value agriculture in Weld County While
the profitability of farming may be largely out of the County's hands and the County cannot stop municipal
annexations, the Comprehensive Plan update maintains a guiding principle based on the value of agriculture
Section 22-2-10 A states "Respecting Our Agricultural Heritage Weld County has an agricultural heritage
built upon the hard work of pioneers and farmers on traditional family farms Weld County is now one of the
most economically productive agricultural counties in the nation The Weld County Right to Farm Statement
and the goals and objectives in this Plan support the importance of agriculture in the County" The first of
the ten goals in the Comprehensive Plan is "Commit to the economic future of agriculture," and the Right to
Farm statement, which has not been changed, can be found in that section
To some extent, the other goals are also related to valuing agriculture in Weld County For example, the
Comprehensive Plan update encourages urban -scale development to occur in municipalities, encourages
development that preserves land for agriculture, encourages responsible and sustainable water usage, and
establishes a policy to "Require that energy and mineral resource development conserve the land and
minimize the impact on surrounding land and the existing surrounding land uses "
RECOMMENDATION
It is our hope and intent that the updated Comprehensive Plan, being a more concise document and focusing
on the value of agriculture to the County, will be referred to often and used to guide important land use
decisions Whereas the old Comprehensive Plan states that it will be updated at least every ten years, the
update says it will be reviewed annually or as warranted Keeping the Plan up to date will help ensure it
remains relevant and useful as the County continues to grow
The Weld County Planning Commission reviewed the proposed Comprehensive Plan update and
recommended approval on at its regular meeting on September 15, 2020 Staff also recommends approval

Staff has three changes to propose to the ordinance prior to adoption :
1 . Replace " shall " with "should " in Section 22 - 2 - 30 . A . 1 so that this provision will not be read as if it
were intended to prevent all land use changes to properties with existing agricultural
production /operations .

Dear Commissioner Freeman and Members of the Board :
On behalf of Beebe Draw Farms and Equestrian Center, a.k. a. "Pelican Lake Ranch," I have had
the opportunity to review the proposed Weld County Comprehensive Plan ("Plan") . As you know,
Pelican Lake Ranch is an approved Planned Unit Development with two metropolitan districts and
an Authority that provide utilities and amenities to 186 lots and 168 property owners and will
provide these services plus other amenities for existing and fu .u.re homeowners of this master
planned development. In light of the on-going development of Pelican Lake Ranch, my review of
the Plan is geared toward ensuring the continuation of the development in light of the substantial
investment on behalf of not only the owner of the undeveloped lots but the 168 Weld County
families that live in Filing # 1 . My comments follow
1 . Guiding Principle B- Respecting Private Property Rights The law favors unrestricted use
of private property . Zoning is a limitation of the foregoing principle and can only stand when
exercised to protect the public health, safety and general welfare. Zoning decisions are based on
consistency with a comprehensive plan. Any language in the Plan purporting to discourage the
continuation of Pelican Lakes Ranch under the approved PUD should be revised. With the
approval of the PUD, the County Commissioners approved two metropolitan districts and an
Authority that built roads, water infrastructure, drainage facilities and amenities (including pools,
tennis courts, recreational lake, playground, BBQ areas, riding arenas, and riding and walking
trails) for existing and future residents of Pelican Lake Ranch ("Improvements") . General
Obligation Bonds were sold to finance these Improvements and the existing residents paid a mill-
levy to retire the debt and continue to pay a mill levy for operations and maintenance . On-going
maintenance of the existing amenities and the construction of promised future amenities require
additional homes to be built to help off-set the cost. The existing homeowners have a property
interest in seeing the amenities improved and maintained and that requires the full development of
Pelican Lake Ranch.
2 . Guiding Principle C- Promoting Economic Growth and Stability The Plan advocates that
land use decisions should be consistent and promote fiscally responsible growth. The Plan needs
to reflect the unique nature of those few developments such as Pelican Lake Ranch where
development has commenced in reliance on county approvals and public money has been spent in

furtherance of a common plan that benefits existing County residents. Encouraging the build -out
of developments like Pelican Lake Ranch as originally envisioned, approved and financed is
fiscally responsible to both the County and the residents currently living there.
I would also suggest that language in the Plan that discourages quality development solely due to
its location to existing municipalities be re-evaluated. Central services are far more important to
fiscally responsible and sustainable development than simply adjacency to a municipality.
3. Finally, I would hope that the County would take the time to review the various land use
documents (Comprehensive Plan, Zoning Regulations, Subdivision Regulations and Planned Unit
Developments) to ensure consistency in definitions, especially urban -scale, non -urban scale so as
not to further confuse landowners. As I reviewed them I found discrepancies that could lead to
unintended issues in the future.
I have taken the liberty of providing a redline outlining proposed modifications to the Plan
addressing the foregoing comments

B . Locate urban development in urban areas .
1 . Encourage annexation of urban-scale development. Zone changes and subdivisions within one-quarter mile of
municipal limits are strongly discouraged. Property owners who want to rezone or subdivide their property are
encouraged to contact the municipality about annexation.
2. Urban-scale development shall only be placed where urban services, including public water, are available.
3 . Urban scale residential development belongs in municipalities, therefore the County shall discour`
developments with more than nine lots or an overall
areas.
Pursue Coordinated Planning Agreements with all municipalities within the County.
4. Recognize existing master planned developments where the County has approved metropolitan districts as an
-appropriate location for urban-scale development.
C. Harmonize development with surrounding land uses.
1 . Transition between land use types and intensities with buffers . Uses that are incompatible with existing uses must
be able to mitigate conflicts.
2 . hstablish residential development options based on compatibility, proximity to municipalities, and availability of
services that reflect the desired density and character of that location.

C.R. S .) . Weld County is home to the Pawnee National Grasslands, the Pawnee Buttes, and Crow Valley Recreation Area, as well
as state wildlife areas, lakes, rivers, and streams, and commercial facilities that support recreation and tourism uses. The Pawnee
Buttes and other areas offer hiking and bird-watching without the crowds of people found in Rocky Mountain

A regular meeting of the Weld County Planning Commission was held in the Weld County Administration
Building, Hearing Room, 1150 O Street, Greeley, Colorado This meeting was called to order by Chair,
Elijah Hatch, at 12 30 pm

IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS,
CHAPTER 22 COMPREHENSIVE PLAN, OF THE WELD COUNTY CODE
Tom Parko, Planning Services, presented Ordinance 2020-13 and stated that the last update to the
Comprehensive Plan was in 2008 He said that the kick-off to the public process was held at the Farm
Show and then the pandemic hit, and it changed the way they held outreach He added that they had to
switch gears and do everything more virtual Additionally, the Board of County Commissioners hired a
consulting firm to help with the County's Public Information Officer and start putting things on our website
Mr Parko said that they wanted to be as transparent as possible but the county is a very large county, so
it is just not possible to hit everybody He added that they tried to do a lot of outreach and had focus groups
Mr Parko said that they met with a lot of the big players in the agricultural industry and municipalities,
surveyors, realtors, and consultants that do a lot of work in the planning department and solicitated
feedback through them
Jim Flesher, Planning Services, said that the Comprehensive Plan is included in the Weld County Code
Chapter 22 and was originally created in 1973 It has since been updated in 1987, 1995, 2002 and 2008
The current update includes 10 goals and 37 objectives
Some items removed from the current code were the strategies and instead the Planning Department will
maintain a list of actions in a strategic plan that can be updated annually and need not be incorporated in
the Weld County Code The Regional Urbanization Areas (RUAs) will also be removed Mr Flesher said
that in 2008 when the Comprehensive Plan was adopted it included transportation plan goals and in 2010
it was separated out as you saw in Ordinance 2020-17
The additions to the Comprehensive Plan are a Recreation and Tourism Element which addresses a
statutory requirement, a Subarea Planning Guide (Appendix 22-B) and a Comprehensive Plan Map
(Appendix 22-D) The Comprehensive Plan Map includes opportunity zones, appropriate development
scale, and site constraints Mr Flesher said that when the Planning Commission sees a change of zone
application Staff will refer to the proposed Comprehensive Plan Map
Commissioner Cope asked if the change of zone will be an automatic exclusion if it is not shown on the
Comprehensive Plan Map Ms Snyder, Planning Services, said that the commercial and industrial
opportunity zones are intended to show ideal locations based on a formula She said that if you were to
use that formula and show that another location was a satisfactory commercial or industrial location then
you could turn in an application for a change of zone and justify it with other means She provided Tire
Mountain as an example or areas of the county that are already zoned industrial that are not shown on this
map and they would want to consider land uses and the Comprehensive Plan Map Mr Parko added that
we still have a lot of agricultural activity and wanted to make it clear that those activities (such as dairies)
are still allowed in the agricultural zone district

Commissioner Mellon asked if any input is given to natural geographic features like the Pawnee Grasslands
where a broad brush might not be appropriate Ms Snyder said that they have some of those things like
floodplain, but the prairie and other things are covered by other criteria in the county code
The Chair asked if there was anyone in the audience who wished to speak for or against this application
Bill Jerke, 22911 CR 39, LaSalle, Colorado, stated that his last year as County Commissioner was in 2008
when they had the last update to the Comprehensive Plan He provided an overview of how the County
had conducted outreach and set up a technical advisory group that created an update to the
Comprehensive Plan Mr Jerke expressed concern that this update process is a top -down approach and
he had difficulty making any input to the update at all He suggested that this process slow down and be
widened it so that more people would have an opportunity to have more input
Commissioner Ford asked how he would recommend these landowners be notified Mr Jerke said it should
be bottom -up and it is up to the County Commissioners to decide if they want to open it up again or not and
if it is there should be community meetings and they should create a study group
Commissioner Gluck said that timing is pretty poor because harvest is starting and there won't be a lot of
farmers coming in September and October He suggested that Staff try to accommodate that
Erin Barkey, 34630 CR 19, said she received a postcard from Mr Pmkham about the meeting today and
the postcard showed that the meeting started at 1 30 p m Ms Barkey expressed frustration that she came
to the meeting at 1 30 p m and the Transportation Plan had already been discussed She said that she
wasn't able to hear what is going to happen to County Road 19, so she had to talk to Mr Pinkham in the
back of the room She said that she has a little acreage that she wants to keep in agriculture and she is
not hearing a lot of positivity from this Board which is disheartening She added that she hopes the Planning
Commission will take time to realize what the agricultural industry contributes to Weld County
Commissioner Mellon asked if this is a flawed public notice and does it impact the validity of the hearing
Bob Choate, County Attorney, stated that it is unfortunate that there were two people that came in after the
meeting had started at 12 30 pm because of the misprint However, there is a three -reading process that
the Board of County Commissioners will have, and he verified that those dates and times on the postcard
are still accurate
Commissioner Gluck said that it is unfortunate, but he agrees that they didn't get adequate notification as
well
Commissioner Holland said that they have had a number of meetings talking about the update to the
Comprehensive Plan and referred to Mr Jerke's comments about not being aware of the update He asked
Staff to address this issue Mr Parko said that in 2008 it was a completely different Board of County
Commissioners and they set out what they wanted to accomplish with setting up a Technical Advisory
Committee of people that they would like to see involved in the Comprehensive Plan He added that this
is a whole new Board of County Commissioners that has provided direction to staff on how to mOve forward
with this approach Mr Parko said that prior to Covid-19 they did intend to have a bunch of community
meetings but then that all changed, and they had to go through a more virtual platform He added that
through some of the focus group meetings and trying to solicit information, they didn't get a lot of feedback
Mr Parko said that they actually got a ton of feedback from people that went online He added that they
received a lot of input using a consultant that helped put the surveys together and he thinks that they were
able to get some good feedback He said that you can't reach everyone, and he would love to send a
postcard to every citizen but how many look at it and throw it away, not to mention the expense involved
He added that there is a three -reading process with the Board of County Commissioners Mr Parko stated
that Mr Jerke did reach out to him via email as well as to other County Commissioners and he did provide
Mr Jerke with information on where to go to get information on the Comprehensive Plan
Commissioner Holland asked if the three -reading process gives this important agriculture culture the
opportunity to express themselves Mr Parko said that it is advertised in the paper and a lot of it is through
word of mouth and online and through social media He added that there is a lot of opportunity to still
comment before the final reading at the end of November

Commissioner Holland asked if they could suggest something to the County Commissioners of what they
might do to invigorate this input coming from the communities Mr Mellon said that there is never an
opportunity for input outside the working day of the county He added that there is never an evening hearing
and that is one thing that he has hated how Weld County runs If he could make one change to the whole
process, he would make it so that at least one of the three meetings are held in the evening
Ms Snyder said that they put this information out in the County newsletter, Facebook, Twitter and on the
County website She added that they had multiple meetings with the ag industry people from lists obtained
from the Agricultural Extension Office Additionally, they held meetings during the day and night and
sometimes people still don't hear She said if there is something that you think we haven't done, we can
still do that before the Board of County Commissioners meeting Commissioner Cope suggested placing
radio ads that indicates the Comprehensive Plan is being revised, and please go to the Weld County
website Commissioner Ford suggested placing an ad in the Fencepost He said that he lives in rural Weld
County and doesn't subscribe to the Greeley Tribune, but he does get the Fencepost
Commissioner Barclay said that there is no way to reach everybody and there is no doubt that the
information is out there He added that there is still time for people to comment before the County
Commissioner's first reading It is tough to get everyone to see it and comment
Commissioner Cope commended Staff on the Comprehensive Plan Map and added that this should have
been done years ago He added that this is a good tool to be able to look at the map and consider if a
proposed application is located in a reasonable location
Motion Forward Case Ordinance 2020-13 to the Board of County Commissioners along with the Planning
Commission's recommendation of approval, Moved by Gene Stifle, Seconded by Dwaine Barclay
Commissioner Mellon referred to the opportunity zones and expressed concern regarding the location of
the opportunity zones along railroads He has a hard time expecting somebody to consider a piece of
property an opportunity zone just because it is a quarter -mile from a railroad, but one and one-half miles
from a surface road Commissioner Cope said that an opportunity zone is probably a good wording for it
because it is not dictating or stating that this is what has to be done, but rather stating that you have this
opportunity or option to possibly use this He said that adequate water and sewage is probably a bigger
issue than surface transportation He added that this is just saying that these are areas that possibly could
handle this and now the applicant would have to come in with more details on whether this is really an
acceptable site or not
Commissioner Cope asked how important it is to get this done in the next two months or can we slow this
down He asked if maybe the County Commissioners should slow it down and say that they want to review
this once they really have an opportunity to do what was intended with all the outreach and meetings He
added that he thinks it is a good plan Mr Parko said that it is up to the Board of County Commissioners
and that discussion will take place on September 30th at the first reading, especially if there is more public
comment at that time He added that no one knows how long this pandemic will continue

Commissioner Cope said that he would like to see this process go forward with more of how it was intended
to go forward and be heard and receive comments from the public He added that it is important to look at
more than just strictly daytime meetings to allow full participation of the citizens

The Comprehensive Plan includes all unincorporated geographic areas of the County and establishes
policy guidelines for land use decisions . The Plan serves as the foundation of all land use and development
regulations . The Comprehensive Plan is adopted by the Board of County Commissioners as an ordinance

Weld County is located in the northern Front Range of Colorado between the Rocky Mountains and the

metropolitan Denver to the Wyoming state line , the County is approximately 4 , 000 square miles in size — over
twice the size of Delaware . Weld County is the most productive county in the state , and one of the most

Development Report , which is updated annually by the Weld County Department of Planning Services and is
made available to the public on the Planning Services webpage . Also available on the County ' s website are
maps , including zoning , uses by special review , subdivisions and exemptions , geologic and floodplain hazard
areas , and other geographic information . Weld County history and other information are also available on the
Weld County website .
The Population and Development Report is an administrative supplement to the Comprehensive Plan
that describes the physical characteristics of the County along with most recent demographic data available
from the U . S . Census Bureau and the Colorado Demography Office . In addition , it contains data from the
most recent USDA Census of Agriculture and economic indicators from the U . S . Bureau of Economic
Analysis and the Colorado Department of Labor and Employment . Other data presented include statistics on
housing , real estate . and foreclosures , land use cases processed , and lots created , building permits issued ,
and various other information . Refer also to the Weld County Transportation Plan adopted by reference in
Chapter 8 of the Weld County Code for more information on the existing conditions in Weld County .
Division 2 - General Provisions
Sec . 22-1 - 100 . - Definition and purpose of Comprehensive Plan .
The Comprehensive Plan , contained in this Chapter, is the document intended to fulfill the master plan
requirement pursuant to state law ( Section 30-28- 106( 1 ) , C . R . S . ) and the mineral extraction master plan
requirement pursuant to state law ( Section 34- 1 - 304 , C . R . S . ) and , in part , to set land use policy pursuant to
the Home Rule Charter. The Comprehensive Plan is intended to be used for the general purpose of guiding
development of the unincorporated County .
Sec . 22 -1 -110 . - Relationship to planning documents .
A . The Comprehensive Plan identifies guiding principles , goals , and objectives to provide direction for land
use decisions . The documents used by the County to carry out the Goals and Objectives of the
Comprehensive Plan are contained in Chapters 19 , 21 , 23 , 24 , and 27 of this Code . Article III of Chapter
2 , Administration , contains regulations relating to planing and zoning as well . In the event of any conflict
between the Comprehensive Plan and any land use regulations set forth in this Code , the land use
regulations , including , but not limited to those for zoning and subdivision , take priority .
B . Chapter 19 contains Coordinated Planning Agreements between the County and various municipalities .
C . Chapter 21 regulates areas and activities of state interest in unincorporated Weld County .
D . Chapter 23 contains the Zoning Ordinance , which defines land use application procedures and
responsibilities , standards , and regulations pertaining to zone districts and overlay districts ,
nonconforming uses , enforcement , vesting of rights , and the Board of Adjustment .
E . Chapter 24 contains the Subdivision Ordinance used to regulate subdivision development and contains
the procedures for subdividing a parcel of land and design standards for facilities , utilities , and other
improvements .
F . Chapter 27 provides a site- specific subdivision mechanism , Planned Unit Development , used to provide
for creativity and which can be used to allow uses from multiple zone districts .
G . The Weld County Transportation Plan is adopted in Chapter 8 of the Weld County Code .
Sec . 22- 1 - 120 . - Reserved .
Sec . 22 - 1 -130 . - Plan components .
Article II contains the Principles , Goals , and Objectives of the Comprehensive Plan . The Goals are
desired ambitions and results to be pursued diligently by the County . Each Goal contains one or more
Objectives , which are more specific than the Goals and help clarify the Goal ' s intent.
Sec . 22 -1 - 140 . - Planning process .
The official kickoff for the 2020 Comprehensive Plan update was the Annual Farm Show at Island Grove
in Greeley on January 28 , 29 , and 30 . Not long after that , the novel coronavirus outbreak reached the United
States and public meetings were postponed .
The Board of County Commissioners met with staff every two weeks to review the old Comprehensive
Plan and draft a new Comprehensive Plan . One goal of this update was to reduce the length of the
Comprehensive Plan to make it more readable and usable . For this reason . the strategies were eliminated
from the body of the Comprehensive Plan . Instead the Planning Department will maintain a separate Strategic
Plan for implementing the Comprehensive Plan that will be updated at least annually .
The Guiding Principles were consolidated to four and moved from the middle of Article Ito the beginning
of Article II . The Goals were simplified to 10 overarching aims further clarified by 37 objectives .
Sec . 22 -1 -150 . - Comprehensive Plan amendment procedure .
A . Adoption of the Comprehensive Plan as contained in this Chapter 22 of the Weld County Code is a
legislative process of the Board of County Commissioners . Any member of the Board may propose an
ordinance to update . amend , or revise this Chapter in accordance with Section 3- 14 of the Home Rule
Charter.
B . Prior to adopting an ordinance on final reading to revise or amend this Chapter, the proposed change
shall be considered by the Planning Commission following a public hearing on the matter. The Planning
Commission shall vote on a resolution adopting the amendment and the secretary to the Planning
Commission shall forward the resolution , if adopted , to the Board on County Commissioners .
C . The Department of Planning Services shall notify any municipality with a cooperative planning agreement
in Chapter 19 of the Weld County Code at least ten ( 10 ) days prior to the Planning Commission hearing .
Notice of the proposed ordinance shall also be posted on the County website and in accordance with
notice requirements for ordinances . The Board may direct the Director of Planning Services to issue a
press release regarding the proposed change(s) .
D . The Board of County Commissioners shall consider the resolution of the Planning Commission , the
recommendations of the Department of Planning Services , and any comments received from
municipalities and the public prior to adopting an ordinance to amend this chapter. The Board shall take
public testimony prior to each of the second and third readings of the ordinance .
E . The Board of County Commissioners and Planning Commission shall review the entire Comprehensive
Plan annually or as changing demographics , conditions , and policies warrant . The Board may direct the
Planning Commission , an ad hoc appointed committee , and/or the Department of Planning Services to
conduct the review and report its findings to the Board .
ARTICLE II - Principles , Goals , and Objectives
Sec . 22 -2 - 10 . - Guiding Principles .
The following Guiding Principles are the foundation for land use policy in the County . All of the Goals and
Objectives within the Weld County Comprehensive Plan are adopted with the intent that they are consistent
with the Guiding Principles .
A . Respecting Our Agricultural Heritage . Weld County has an agricultural heritage built upon the hard work
of pioneers and farmers on traditional family farms . Weld County is now one of the most economically
productive agricultural counties in the nation . The Weld County Right to Farm Statement and the goals
and objectives in this Plan support the importance of agriculture in the County .
B . Respecting Private Property Rights . One of the basic principles upon which the United States was
founded is the right of citizens to own and utilize property so long as that use complies with local
regulations and does not interfere with or infringe upon the rights of others .
C . Promoting Economic Growth and Stability . Land use policies have a significant impact on economic
conditions in the County and should be structured to encourage economic prosperity . To ensure the
continued strength of Weld County' s economy , land use processes and decisions based on this plan shall
be consistent and promote fiscally responsible growth .
D . Protecting Health , Safety , and General Welfare . Land use regulations and policies will protect and
enhance the health , safety , and general welfare of the citizens of Weld County .
Sec . 22-2 -20 . - Goals and Objectives .
The goals of this Comprehensive Plan should be continuously pursued and implemented in County
regulations and procedure . They are directions for elected and appointed officials and staff to consider when
making land use decisions . The goals are divided into categories of Land Use Goals , Economic Development
Goals , Environmental Goals , and Natural Resource Goals . Each goal is followed by objectives that help
define and clarify the intent of the goal .
Sec . 22-2 -30 . - Land Use Goals and Objectives .
A . Commit to the economic future of agriculture .
1 . Land use changes shall not inhibit agricultural production nor operations .
2 . Limit the density and intensity of development to maintain agricultural areas .
3 . Respect agricultural practices regarding water resources .
4 . Farming or ranching operations are not considered a nuisance as long as they employ common or
reasonable agricultural practices .
a . Weld County Right-to- Farm Statement :
Weld County is one of the most productive agricultural counties in the United States , typically
ranking in the top ten counties in the country in total market value of agricultural products sold .
The rural areas of Weld County may be open and spacious , but they are intensively used for
agriculture . Persons moving into a rural area must recognize and accept there are drawbacks ,
including conflicts with long-standing agricultural practices and a lower level of services than in
town . Along with the drawbacks come the incentives which attract urban dwellers to relocate to
rural areas : open views , spaciousness , wildlife , lack of city noise and congestion , and the rural
atmosphere and way of life . Without neighboring farms , those features which attract urban
dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area . Well- run agricultural
activities will generate off- site impacts . including noise from tractors and equipment : slow- moving
farm vehicles on rural roads ; dust from animal pens , field work , harvest . and gravel roads : odor
from animal confinement , silage , and manure ; smoke from ditch burning ; flies and mosquitoes ;
hunting and trapping activities ; shooting sports , legal hazing of nuisance wildlife : and the use of
pesticides and fertilizers in the fields , including the use of aerial spraying . It is common practice
for agricultural producers to utilize an accumulation of agricultural machinery and supplies to
assist in their agricultural operations . A concentration of miscellaneous agricultural materials
often produces a visual disparity between rural and urban areas of the County . Section 35- 3 . 5-
102 , C . R . S . , provides that an agricultural operation shall not be found to be a public or private
nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that
are commonly or reasonably associated with agricultural production .
Water has been , and continues to be , the lifeline for the agricultural community . It is unrealistic to
assume that ditches and reservoirs may simply be moved " out of the way" of residential
development . When moving to the County , property owners and residents must realize they
cannot take water from irrigation ditches , lakes , or other structures , unless they have an
adjudicated right to the water .
Weld County covers a land area of approximately four thousand (4 , 000 ) square miles in size
(twice the size of the State of Delaware) with more than three thousand seven hundred ( 3 , 700 )
miles of state and County roads outside of municipalities . The sheer magnitude of the area to be
served stretches available resources . Law enforcement is based on responses to complaints
more than on patrols of the County , and the distances which must be traveled may delay all
emergency responses , including law enforcement , ambulance , and fire . Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to emergencies .
County gravel roads , no matter how often they are bladed , will not provide the same kind of
surface expected from a paved road . Snow removal priorities mean that roads from subdivisions
to arterials may not be cleared for several days after a major snowstorm . Services in rural areas ,
in many cases , will not be equivalent to municipal services . Rural dwellers must , by necessity , be
more self-sufficient than urban dwellers .
People are exposed to different hazards in the County than in an urban or suburban setting .
Farm equipment and oil field equipment , ponds and irrigation ditches , electrical power for pumps
and center pivot operations . high- speed traffic , sand burs , puncture vines , territorial farm dogs
and livestock , and open burning present real threats . Controlling children ' s activities is important ,
not only for their safety . but also for the protection of the farmer' s livelihood .
B . Locate urban development in urban areas .
1 . Encourage annexation of urban -scale development . Zone changes and subdivisions within one-
quarter mile of municipal limits are strongly discouraged . Property owners who want to rezone or
subdivide their property are encouraged to contact the municipality about annexation .
2 . Urban-scale development shall only be placed where urban services , including public water, are
available .
3 . Urban- scale residential development belongs in municipalities , therefore the County shall discourage
residential developments with more than nine lots or an overall density of more than one unit per acre
in unincorporated areas.
4 . Pursue Coordinated Planning Agreements with all municipalities within the County .
C . Harmonize development with surrounding land uses .
1 . Transition between land use types and intensities with buffers . Uses that are incompatible with
existing uses must be able to mitigate conflicts .
2 . Establish residential development options based on compatibility , proximity to municipalities , and
availability of services that reflect the desired density and character of that location .
3 . Encourage development that preserves land for agriculture , rangeland , wetlands , and critical
habitats .
4 . Require access easements and privately maintained rights-of-way to have recorded maintenance
agreements to ensure adequate access .
5 . Encourage consolidation of nonconforming lots .
6 . Encourage the preservation , restoration , and reuse of historical structures and landmarks .
7 . Encourage subarea planning and collaboration to enhance certain areas of the County .
D . Collaborate on County -wide transportation and land use plans .
1 . When the comprehensive plan is updated , the transportation plan should be updated as well .
2 . Ensure that land use change proposals comply with applicable transportation plans , functional
classifications , and access control plans adopted by the County .
Sec . 22 -2 -40 . - Economic Development Goals and Objectives .
A . Support compatible economic development opportunities .
1 . Identify target areas where the County is able to encourage shovel -ready commercial and industrial
development .
2 . Foster partnerships that increase the predictability or certainty of economic development and limit
jurisdictional competition .
3 . Plan and invest in a robust transportation system that connects markets and population centers .
4 . Innovate , develop , and capitalize on the necessary tools and funding mechanisms to incentivize
economic development .
5 . Encourage agglomeration economies of synergistic businesses .
6 . Promote small business incentive programs to encourage small business owners .
Sec . 22-2 -50 . - Environmental Goals and Objectives .
A . Encourage responsible and sustainable water usage .
1 . Connection to public water and sewer services shall be taken into consideration for development
approval .
2 . Promote alternative conservation strategies and tools to minimize water usage , such as recycling and
reuse .
B . Protect water quality within the County .
1 . Support the reduction of stormwater erosion and runoff.
2 . Encourage development of master drainage plans and regional detention facilities .
3 . Prevent surface and groundwater contamination .
C . Minimize flood losses .
1 . Identify flood- prone areas of the County that are not already designated on a Flood Insurance Rate
Map ( FIRM ) .
2 . Encourage development to locate outside of flood- prone areas to reduce the loss of life and property .
Sec . 22 -2-60 . - Natural Resource Goals and Objectives .
A . Preserve wetlands and critical habitats .
1 . Wetlands and critical or unique habitat areas , such as habitats of endangered or unique species , and
migration , breeding , and spawning areas should be identified in application materials as potential
limiting site factors .
2 . Protect native plants by enforcing noxious weed removal .
B . Support responsible energy and mineral development .
1 . Ensure that surface development reasonably accommodates mineral extraction .
2 . Ensure that infrastructure , such as adequate roads and utilities , exists or can be made available prior
to development of energy and mineral resource production facilities .
3 . Require that energy and mineral resource development conserve the land and minimize the impact
on surrounding land and the existing surrounding land uses .
4 . Energy development should be coordinated with seasonal production schedules associated with
agricultural activities .
5 . Energy development facilities should preserve agricultural areas and enhance the rural landscape .
ARTICLE III - Recreation and Tourism Element
Sec . 22 -3 - 10 . - Recreation and Tourism Element.
This section is intended to address the recreation and tourism requirement pursuant to state law ( Section
30-28- 106 ( 5) , C . R . S . ) . Weld County is home to the Pawnee National Grasslands , the Pawnee Buttes , and
Crow Valley Recreation Area , as well as state wildlife areas , lakes , rivers , and streams , and commercial
facilities that support recreation and tourism uses . The Pawnee Buttes and other areas offer hiking and bird-
watching without the crowds of people found in Rocky Mountain National Park . Other recreational activities in
Weld County include horseback- riding , hunting , shooting , biking , cross-country skiing , boating , and fishing .
Private facilities offer opportunities for water skiing , shooting . hunting , motocross , and other sports .
Additionally , agritourism and agritainment have been growing in popularity over the years . These seasonal
events offer fun and education for visitors centered around harvest time and Halloween .
Many more opportunities for recreation and tourism can be found within the cities and towns of Weld
County , including numerous parks , museums , and historic sites, as well as festivals , parades , and other

ARTICLE IV - Comprehensive Plan Map
Sec . 22-4- 10 . - Comprehensive Plan Map .
A . The Department of Planning Services shall maintain a map called the Comprehensive Plan Map based
on the criteria in this section . The Comprehensive Plan Map is adopted as Appendix 22- D and shows the
County ' s preference for areas for rezonings and subdivisions . The map has no bearing on uses allowed
by right , by permit , or by special review. It is made up of two main components :
1 . Areas of opportunity for commercial and industrial development . These are potentially logical areas
for rezoning land to C ( Commercial ) . I ( Industrial ) , and Planned Unit Development ( PUD ) containing
C and I uses based on transportation infrastructure of roads and railroads . The map is intended to
encourage rezoning in appropriate areas . Such a designation does not guarantee a zone change
application will be approved . All applicable criteria in Chapters 23 or 27 of the Weld County Code
must be satisfied in order for the Board of County Commissioners to approve a zone change
application , including location-specific attributes such as surrounding land uses , topography , and
availability of utilities .
2 . Areas of urban-scale development . nonurban-scale development , and rural -scale development .
These layers are based on municipal boundaries and water district boundaries and will change as
those boundaries change . See Section 24- 1 -40 for definitions of the different types of development .
B . Opportunity Zones . If in compliance with the other provisions in this section , zone changes to C
( Commercial ) . I ( Industrial ) , and Planned Unit Development ( PUD ) containing C and I uses are preferred
in the following locations :
1 . Within one mile of interstates ,
2 . Within one- half mile of U . S . highways ,
3 . Within one- half mile of the County Highway (Weld County Road 49 between 1 -76 and State Highway
392 ) ,
4 . Within one-quarter mile of railroads ,
5 . Within one- half mile of the following types of intersections :
a . Collector/arterial ,
b . Arterial/arterial ,
c . Collector/highway , and
d . Arterial/highway .
C . Development requiring rezoning is generally discouraged in the following locations :
1 . Within one-quarter mile of any municipality .
2 . Beyond three miles from a municipality , unless all or a portion of the property is located in an
Opportunity Zone on the Comprehensive Plan Map and the rezoning is to Commercial or Industrial .

APPENDIX 22 -B - Subarea Planning Guide
A . Subarea plans are intended to guide development in specifically defined areas . In order to analyze
conditions in an area and solicit input from property owners and other planning partners , the County may
conduct a subarea plan and further refine comprehensive planning for that area . Subarea plans shall be
incorporated into the Comprehensive Plan and adopted as appendices to this Chapter 22 ; however,
subarea plans that are conducted jointly with one or more municipalities with which the County has
entered into a Coordinated Planning Agreement may be adopted as appendices in Chapter 19 instead .
B . The reasons for conducting a subarea plan may include but are not limited to :
1 . Advancing economic development opportunities and reducing hindrances to new development .
2 . Adopting specific design standards to promote compatibility in the area .
3 . Promoting renewal of existing communities that lack infrastructure or have other challenges .
4 . Facilitating commercial growth in areas where it is deemed to be desirable — typically at major
transportation intersections that have public utilities available .
C . Subarea plans should include the following elements :
1 . Purpose of the subarea plan .
2 . Defined boundaries of the study area .
3 . Background information , which may include history , demographics , maps , land uses . existing
infrastructure , and other information about the area .
4 . Identification of properties or areas with development/redevelopment potential and analysis of its
constraints .
5 . Notification to and opportunities for input from :
a . Residents and owners of property within the study area ,
h . School districts , fire districts , and other governmental and quasi -governmental agencies within
the study area , including applicable state agencies ,
c . Upstate Colorado , and
d . Municipalities within three miles of the study area .
6 . Goals and objectives for the study area , such as maintaining or improving property values .
7 . A vision for the desired future of the study area .
D . The subarea plan may also contain a map of recommended general future land use categories that may
be used to support , but not guarantee , future zone changes .
APPENDIX 22-C - Right To Extract Mineral Resources Statement
Weld County has some of the most abundant mineral resources , including , but not limited to , sand and
gravel , oil , natural gas , and coal . Under Title 34 of the Colorado Revised Statutes , minerals are vital
resources because ( a ) the state' s commercial mineral deposits are essential to the state' s economy ; ( b) the
populous counties of the state face a critical shortage of such deposits : and (c) such deposits should be
extracted according to a rational plan , calculated to avoid waste of such deposits and cause the least
practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state .
Mineral resource locations are widespread throughout the County and people moving into these areas
must recognize the various impacts associated with this development . Often times . mineral resource sites are
fixed to their geographical and geophysical locations . Moreover, these resources are protected property rights
and mineral owners should be afforded the opportunity to extract the mineral resource .
