(The legal description is Lot B RECX19-0044, Part NE4NE4 Section 10, T3N, R66W of the 6th P.M.; Situs Address is 16955 CR 33) Background Information: The applicant is proposing to store up to 40 tanks on 5 acres of dirt and prairie grass on site. The tanks have a 20 -foot base and can be 35 feet or 55 feet tall. These tanks are stacks that are used to contain flares at oil and gas sites. Additionally, the trailers that transport these tanks will be stored on site. Building Department Building permits may be required, per Section 29-3-10 of the Weld County Code. Currently the following has been adopted by Weld County: 2018 International Residential Code, 2018 International BuildingCode, 2018 International Existing Building Code, 2018 International Mechanical Code, 2018 International Plumbing Code, 2018 International Fuel Gas Code, 2006 International Energy Conservation Code, and 2017 National Electrical Code. A building permit application must be completed and two complete sets of engineered and architectural plans bearing the wet stamp of a Colorado registered engineer or architect must be submitted for review for each structure. All Commercial Building Permit Applications require a complete code analysis prepared by a Colorado registered design professional and shall be submitted with application package to Weld County. All new Commercial Building Projects require Fire District Notification (letter or email form). Proof shall be submitted with Commercial Permit applications. Final Fire District Approval is also required prior to issuing a Certificate of Occupancy and or closing a building permit. A change of use, or a change of occupancy, of any structure may require a building permit and a certificate of occupancy prior to occupying the building. Pursuant to the definition of setback in the Weld County Code, Chapter 23, Chapter 23, Article I, Section 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. Per Chapter 8, Article 13, Section 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgovecomidepartments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. ACCESS According to the Pre -application Conference, access for this site will be from County Road 33. Per Chapter 8, Article XIV, Section 8-14-40, an Access Permit is required for access to Weld County maintained roadways. It is strongly recommended to discuss your access with Public Works prior to laying out your site plan to ensure the approved accesses are compatible with your layout. Per Chapter 24, Article VIII, Section 24-8-40►.C, when feasible, there shall be no net increase in the number of accesses to a public road. Minimum access spacing and geometric criteia are listed below in Tables 1 and 2. Please refer to Chapter 8 of the Weld County Code for more information regarding access. (Department of Public Works) Due to the commercial use of the site, tracking control is required at the access(es). Acceptable tracking control devices include: using an improved gravel surface on the drive and parking areas (since County Road 33 is a gravel road); double cattle guards; or 300 feet of asphalt or concrete pavement. Feel free to contact Public Works to discuss tracking control options. As part of the development review process, all new commercial or residential developments will be required to submit a TIS that is prepared, stamped, and signed by a professional engineer licensed in the State of Colorado, unless the TIS is waived by Public Works. Based on the traffic numbers in clude d in the application questionnaire, Public Works is only requiring a Traffic Narrative as detailed below. Traffic Narrative: 1. Describe how many raundtrips/day are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV (Roundtrip = 1 trip in and 1 trip out of site) 2. Describe the expected travel routes or haul routes for site traffic. 3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) 4. Describe the time of day that you expect the highest traffic volumes. Public Works will review the narrative and advise the applicant if more information or an engineered traffic study is required. Public Works may require an Improvements Agreement for one or all the following reasons: • Off -Site Public Improvements • Road Maintenance Agreement An Improvements Agreement is required for sites with required offsite improvements per Chapter 24, Article IX, Section 24-9-20.B. Collateral is required to ensure the improvements are completed, and maintained. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weldqov.com/UserFiles/Servers/Server 6/File/Departments/Public%20Works/DevelopmentRevie wlsprusr.pdf. It will detail the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. Per Chapter 20, Article I, Section 2g-1-90►, any person commencing development may► apply for credit against impact fees otherwise due, up to but not exceeding the full obligation for impact fees proposed to be paid pursuant to the provisions of this Chapter, for any contributions, construction or dedication of land accepted or received by the county for capital improvements of the same type as are eligible for expenditure of the impact fees. In order to receive the impact fee credit, a Front -End Contribution Agreement must be in place prior to approval of any land use case. Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section (Sec 8-11-40. Drainage Policy -Exceptions) To avoid holding up case processing, a minimum of either a preliminary drainage report or a drainage narrative with exception as shown below must be submitted with completeness review case submittal information. Detention Pond Requirements: 1. A Drainage Report and Detention Pond Design shall be completed by a Colorado Licensed Professional Engineer and adhere to the drainage related sections of the Weld County Code. The Drainage Report must include a Certification of Compliance, stamped and signed by the PE, which can be found on the engineering website. A general Drainage Report Guidance Checklist is available on the engineering website. A Preliminary Drainage Report or a qualifying exception and Drainage Narrative shown below must be submitted for review at the time of the application. OR 2. Drainage Narrative requirements with exception from detention pond. The Drainage Narrative must describe at a minimum: A. Any existing and proposed improvements to the property. B. The exception being requested for consideration. C. Where the water originates if it flows onto the property from an off -site source. D. Where the water flows as it leaves the property. E. The direction of flow across the property. F. Previous drainage problems with the property, if any. G. The location of any irrigation facilities adjacent to or near the property. H. Any additional information pertinent to the development. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4)areas remain applicable. Public Works will confirm if the development qualifies for an exception based upon the information provided by the applicant. DRAINAGE CODE EXCEPTIONS (informational only): Exceptions to the stormwater detention shall be limited to the following uses: 1. Use by Right or Accessory Use in the A (Agricultural) Zone District. 2. Zoning Permits for accessory storage, commercial vehicles, home occupations, or manufactured homes in the A (Agricultural) Zone District. 3. A second dwelling permit in the A (Agricultural) Zone District. 4. Towers including, but not limited to, wind and telecommunication towers. 5. Pipelines or transmission lines, excluding laydown yards, metering sites, substations, and any other above ground appurtenances. 6. Gravel pits if the stormwater drains into the gravel pit. Releases from the site shall comply with the Weld County Storm Drainage Criteria, including dewatering. Topographical information shall be provided. 7. Residential developments where all the following conditions exist. This exception shall be supported by calculations signed and stamped by a Colorado Licensed Professional Engineer a) Nine (9) lots or fewer. b) The average lot size is equal to, or greater than, three (3) acres per lot. c) Downstream roadway criteria are not exceeded. d) The total post -development imperviousness for the rural residential development does not exceed ten percent (10%), assuming that all internal roads and driveways are paved, or will eventually be paved. 8. Development of sites where the change of use does not increase the imperviousness of the site. 9. Non -Urbanizing areas where the total pre-existing and post development impervious area produces stormwater runoff of less than, or equal to, 5 cfs for the 1 -hour, 100 -year, storm event. This exception shall be supported by calculations signed and stamped by a Colorado Licensed Professional Engineer. 10. Parcels with total area less than, or equal to, 1.0 gross acre. 11. An individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FE MA) regulatory floodplain channel and the project. 12. A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is allowed a onetime exception for a new 2,000 sq. ft. building or equivalent imperviousness. 13. A parcel greater than 5 gross acres in size is allowed a onetime exception for a new 4,500 sq. ft. building or equivalent imperviousness. 14. Concentrated Animal Feeding Operation (CAFO), Animal Feeding Operations (AFO) and Housed Commercial Swine Feeding Operation (HCSFO) which are covered and approved by the Colorado Discharge Permit System (CDPS) regulations. These questions are found starting on page 4 of the letter. A. Property Description The proposed Site is 2 acres of the southwest corner of WCR 33 & WCR 36. This area has limited vegetation with no buildings or pavement area (see red outlined area below). The soils in this area are largely a sandy type, therefore, the Hydrologic Soils Group was classified as Type 'B'. The proposed improvements are to be 30 metal incinerators that are 12 feet in diameter to be located just south of WCR 36. There will be some gravel placed underneath this area which will amount to 30' x 210'. That is the only improvement proposed on this parcel. There is no intended/planned use for the remainder of the 2 acres. The owner is purchasing the materials for the 30' by 210' area on which to install the road base. He will personally be spreading the road base to insure that no additional space will be disturbed. The preparation of loading and unloading areas for the incinerators consists only of mowing of grass. There will not be any scraping or removing of top soil for the unloading areas for the incinerators. Similar to the parking area on the lot to the west (15784 Weld County Road 36), there will not be any road base in the drive area adjoining the two properties.
