The request is to amend Section IX "Fees" to Subdivision Reguations. Mr. Telep: Thank you Mr. Chairman let the record show that this cause came on for a heaing this day, March 8, 1971 at 11:00 o'clock A. M. on the application of the Weld County Planning Commission requesting an amendment to Section IX entitled "Fees" to the Subdivision Regulations to read as follows: There shall be required by the Planning Commission a fee for each plat submitted for approval to help defray the expenses of the County in chekcing such plats. Such fee not to exceed the following: 1. Preliminary Plats: $25.00 for the first fifty acres and $1.00 for each additional acre up to $100.00 maximum 2. Final Plats: $25.00 for each filing - Amend Section X "Penalities (change number only) Amend XI Repeals (change number only) Amend Section XII "Effective Date" (change number only) Let the record further show that this request to amend the zoning resolution in said respect was duly published in the Greeley Booster on January 29 and February 26, 1971 respectively as required by law. Mr. Chairman I believe we are ready to proceed and in as much as this is a unique hearing in that the r≥quest to amend the zoning resolution I believe that the Planning Director is filled with the subject and will be able to explain to the Commissioners the necessity and the wisdom of amending the zoning resolution. Mr. Lorensen: Mr. Chairman, this addition was made for the purposes of attempting to defray the cost that we are experiencing in chekcing out subdivisions and the work that the staff has to do. Previously to this therehas not been any charge and there has been in many others areas a standard fee attached to this type of operation. It does take man power we check such things as the soils on the sight, we will check it, we do a lot of redesign work, it does go through the Planning Commission where 2 there are hearings, it also goes to the Utility Board, where there are hearings and it also comes to the County Commissioners so there is a large amount of expense that can build up against each subdivision andthe work that has to be accomplished, before final decision is made. So it was my recommendation to the Planning Commission that we adopt a fee and after due study we recommend the fees that are before you and the Planning Commission did recommend approval. We would insert this and in Section IX, which is currently titled penalities and we did move those sections from penalities repealed ani effective date down or one additional section number to insert this because we thought this would be the best place in the regualtions for this. This is about all I have. Mr. Anderson: This is in order to sort of up-date our rules and regulations, is that right? Mr. Lorensen: Yes sir. Mr. Anderson: Are there any questions? Mr. Billings: No questions. Mr. Ashley: No questions. Mr.Billings: I move we approve the Planning Commission Rules and By-laws. Mr. Ashley; I second it Mr. Anderson: How do you vote in favor of it? Mr. Billings: I vote in favor of the motion. Mr. Ashley: Yes. Mr. Anderson: The chair votes yes. Let the record show that the amendment will be approved and the changes will be made. COLORADO SUBDIVISIONS REGULATIONS 13 UNRECORDED PLATS Section VII It shall be unlawful for the owner, or the agent of the owner, of any unplatted or unsubdivided land located within the unincorporated area of Weld County to transfer, sell, agree to sell, or negotiate to sell any such land by reference to, exhibit of, or by the use of a plan or plat of a subdivision which has not been approved.by the Board of County Commissioners and the Planning Commission and has not been recorded in the office of the Weld County Clerk and Recorder.
