RE: ACTION OF BOARD CONCERNING CHANGE OF ZONE, COZ19-0002, FROM THE
R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT TO THE C-3 (BUSINESS
COMMERCIAL) ZONE DISTRICT - DANIEL AND JANNA MILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of
October, 2019, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing
the application of Daniel and Janna Miller, 470 E. 18th St., Greeley, Colorado 80631, for Change
of Zone, COZ19-0002, from the R-1 (Low Density Residential) Zone District to the C-3 (Business
Commercial) Zone District on the following described real estate, to -wit:
Lot 1 Resubdivision RES19-0008 of Lot 3, Union
Colony Land Subdivision; being part of the SE1/4
SW1/4 of Section 9, Township 5 North, Range 65
West of the 6th P.M., Weld County, Colorado
WHEREAS, at said hearing the Board deemed it advisable to continue the matter to
November 27, 2019, to allow the applicants adequate time to complete the Conditions of Approval
and record the plat for Resubdivision, RES19-0008, and
WHEREAS, at said hearing, on November 27, 2019, the Board deemed it advisable to
continue the matter to January 15, 2020, at 10:00 a.m., to allow the applicants adequate time to
record the plat for Resubdivision, RES19-0008, which is contingent on the results of a soils test
and the revision of the Drainage Report, and
WHEREAS, at said hearing, on January 15, 2020, the Board deemed it advisable to
continue the matter to April 1, 2020, at 10:00 a.m., to allow the applicants adequate time to
address drainage issues that are prohibiting the recordation of the plat for Resubdivision,
RES19-0008, and
WHEREAS, at said hearing, on April 1, 2020, because of the COVID-19 event and to
protect the health, safety, and welfare of the general public, the Board deemed it advisable to
continue the matter to April 22, 2020, at 10:00 a.m.

WHEREAS, at said hearing, on April 22, 2020, because of the ongoing COVID-19 event
and to protect the health, safety, and welfare of the general public, the Board, having been fully
informed, finds that this matter should be continued to May 6, 2020.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the abovementioned matter be, and hereby is, continued to May 6,
2020.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of April, A.D., 2020.
