The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for an Oil and
Gas Support and Service (Outside Storage of Oil Field Support Equipment and Supplies) in the A
(Agricultural)Zone District.
This project is south of and adjacent to CR 36 and is west of CR 33.
Parcel number 121110100026.
Access is from CR 36 via Parcel 121110100025 to the west.
ACCESS
Weld County Public Works has reviewed the application materials related to access. Access for this site
will be from the applicant's existing, permitted access (AP19-00314) on County Road 36, located
approximately 1,160 feet west of County Road 33. This access currently serves the applicant's diesel
mechanic shop located on the adjacent parcel to the west(Parcel No. 121110100025). To ensure that the
subject property will forever have legal access via the aforementioned access, the applicant shall create
and record a license agreement (in perpetuity and signed by all property owners) providing an easement
for ingress and egress. The easement shall run from the existing access on County Road 36 to the subject
project site, and shall have a minimum width of 30 feet. The applicant shall delineate and label the
easement on the USR map and reference the creating document.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure
the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there shall be no
net increase in the number of accesses to a public road. Minimum access spacing are shown in Weld
County Code, Sec. 8-14-30 Table 1. Please refer to Chapter 8 of the Weld County Code for more
information regarding access.
ROADS AND RIGHTS-OF-WAY
County Road 33 is a gravel road and is designated on the Weld County Functional Classification Map(Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way(along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required
setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered
in the right-of-way. This road is maintained by Weld County.
County Road 36 is a gravel road and is designated on the Weld County Functional Classification Map(Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way(along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1-90, the required
setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered
in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way
or easement. Right-of-Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 36 counted 65 vpd with 27% trucks. The 85'" percentile speed is 51 mph.
According to the application materials there will be up to 200 truck trips (50 truck roundtrips for initial
incinerator deliveries and 50 truck roundtrips for incinerator removals once storage is no longer required).
Up to 5 roundtrips per week may occur as the incinerators are being delivered. Deliveries will occur during
daylight hours only.
The haul route will consist of County Road 36 (from the access to County Road 33), County Road 33(from
County Road 36 to County Road 42), and County Road 42 (from County Road 33 to Highway 85).
TRACKING CONTROL
Because of the limited number of trips being generated by this project, no upfront tracking control is
required.
ROAD MAINTENANCE AGREEMENT
Public Works is requiring a Road Maintenance Agreement including, but not limited to, dust control and
damage repair to specified haul routes.

DRAINAGE REQUIREMENTS
This area IS within a Non-Urbanizing Drainage Area: Non-Urbanizing Drainage Areas typically require
detention of runoff from the 1-hour, 100-year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1-hour, 10-year storm falling on the undeveloped site for NON-
URBANIZING areas.
Detention pond waived and a simple drainage narrative:
In accordance with Weld County Code, Section 8-11-40.1,the applicant has submitted a drainage narrative
with a qualifying exception to stormwater detention which reads, "13. A parcel greater than 5 gross acres
in size is allowed a onetime exception for a new 4,500 sq. ft. building or equivalent imperviousness."
This project qualifies for Exception 13 providing the following seven (7) conditions (which were agreed to
by the applicant in the September 11, 2020 Rocky Ridge Civil Engineering Drainage Memorandum) are
met:
1. The project area will be approximately two (2) acres in size.
2. The placing of gravel will be confined to the approximately 6,300 sq. ft. storage area (30' X 210').
3. The portion of the two (2) acres falling outside of the 6,300 sq. ft. storage area will remain unused
throughout the life of the USR.
4. No grading of the loading/unloading area will occur.
5. The applicant will install a perimeter fence on the south and east sides of the two (2) acre project
site to prevent vehicles from traveling outside the project area.
6. After all incinerators have been delivered in place, the applicant shall till and reseed the ground
surface disturbed during the delivery process. 70%vegetative cover will be required for acceptance
by Public Works.
7. The applicant shall till and reseed the disturbed/compacted area (approximately 26,000 sq. ft.)
south of the project site. Again, 70% vegetative cover will be required for acceptance by Public
Works.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
CONDITIONS OF APPROVAL
A. A Road Maintenance Agreement is required at this location. Road maintenance includes, but is not
limited to, dust control and damage repair to specified haul routes. (Department of Public Works)
B. The applicant shall submit a recorded copy of the access license agreement signed by all owners of
the property crossed by the access. The easement shall be for ingress and egress. It shall be
delineated and labeled on the USR map and reference the Weld County Clerk and Recorder's

C. The plan shall be amended to delineate the following:

delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way) and the physical location of the road. All setbacks

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road,including damages
and/or off-site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Department of Public Works)
5. The Property Owner shall comply with all requirements provided in the executed Road Maintenance

6. The Property Owner shall comply with all seven (7) conditions required to qualify for an exception to
stormwater detention as identified in the Public Works referral response dated October 8, 2020. This
site may be reviewed on an annual basis, including a site visit, to ensure continued compliance with all

7. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

8. Weld County is not responsible for the maintenance of onsite drainage related features. (Department

Environmental Health Services has reviewed this proposal for a Site-Specific
Development Plan and Use by Special Review Permit for Oil and Gas Support
and Service (Outside Storage of Oil Field Support Equipment and Supplies) in
the A (Agricultural) Zone.
The applicant is proposing that employees utilize the restroom facilities on the
adjacent parcel, which is also owned by Joel Velasco and is permitted as
USR19-0045. The commercial system that serves the adjacent parcel is
permitted as SP-1900151 and is sized for 15 people. The individual well
permitted as 227143-A has not been repermitted to commercial according to the
Division of Water Resources which stated: "The well is currently permitted to be
used for fire protection, ordinary household purposes inside one (1) single family
dwelling, the watering of not more than four (4) large non-commercial domestic
animals and the irrigation of not more than 17,200 square feet of home gardens
and lawns. As permitted well permit no. 227143-A cannot be used to serve the
proposed business on the property. If the applicant plans to use well no. 227143
for commercial use, a well permit allowing for such use must first be obtained."
Portable toilets are acceptable for employees or contractors that are on site for
less than 2 consecutive hours a day in accordance with EH policy.
Storage will include incinerators that will not be cleaned on site and do not
contain residue.
We recommend that the following requirement be incorporated into the permit
as a condition that must be met prior to recording the plat:
1 . The well permitted as 227143-A shall be repermitted for commercial
use.

We recommend that the following requirements be incorporated into the permit
as development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,
and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations and the accepted dust abatement plan.
5. Adequate drinking, hand washing, and toilet facilities shall be provided
for employees and patrons, at all times. The adjacent parcel to the
north (p/n 105318200015) owned by Ensign United States Drilling, Inc.,
can be utilized for sanitary accommodations providing the property is
owned or rented by the applicant. Otherwise a portable toilet is
required for this facility.
6. For employees or contractors on site for less than 2 consecutive hours
a day, and 2 or less full-time employees on site, portable toilets and
bottled water are acceptable. Records of maintenance and proper
disposal for portable toilets shall be retained on a quarterly basis and
available for review by the Weld County Department of Public Health
and Environment. Portable toilets shall be serviced by a cleaner
licensed in Weld County, contain hand sanitizers and be screened from
existing adjacent residential properties and public rights-of-way.
7. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

The Applicant is requesting a Site Specific Development Plan and Use by Special Review Permit for
an Oil and Gas Support and Service ( Outside Storage Oil Field Support Equipment and Supplies ) in the
A ( Agricultural ) Zone District
This referral does not appear to qualify as a "subdivision " as defined in Section 30 - 28 - 101 ( 10 ) (a ) ,
C . R . S . Therefore, pursuant to the State Engineer' s March 4 , 2005 and March 11 , 2011 memorandums
to county planning directors , this office will only perform a cursory review of the referral information
and provide informal comments . The comments do not address the adequacy of the water supply
plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements . In addition , the comments provided herein cannot be used to guarantee a viable
water supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
A proposed water supply was not provided , however a copy of well permit no . 227143-A was included
in the referral material .
Well permit no. 227143 -A was issued on February 25 , 2016 pursuant to S 37-92- 602 ( 3 ) (c ) C . R . S . for
the replacement of the existing well , permit no . 227143 . Well permit no . 227143 was issued pursuant
to S 37 - f2 - 60 ( 3 ) ( b ) ( I ) C . R. • for the use of an existing well constructed under permit no . 2O2163
(canceled ), to withdraw up to 1 . 21 acre -feet of ground water from the nontributary ry Laramie- Fox
Hills aquifer underlying a 5 acre parcel known as Lot A, Recorded Exemption No . 1211 - 10- 1 RE-2031 .
The well is currently permitted to be used for fire protection , ordinary household purposes inside

The applicant should be aware that any proposed detention pond for this project must meet the
requirements of a "storm water detention and infiltration facility" as defined in section 37 -92 -
602 (8 ) , Colorado Revised Statutes, the structure may be subject to administration by this office.
The applicant should review DWR ' s Administrative Statement Regarding the Management of Storm
Water Detention Facilities and Post -Wildland Fire Facilities in Colorado to ensure that the
notification , construction and operation of the proposed structure meets statutory and
administrative requirements . The applicant is encouraged to use Colorado Stormwater Detention
