RE: DECLARATION OF DISASTER EMERGENCY AND AUTHORIZE CHAIR TO SIGN ANY
NECESSARY DOCUMENTS - COVID-19 PANDEMIC HEALTH EMERGENCY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on March 10, 2020, Governor Polis declared a State of Emergency to exist
in the state of Colorado because of COVID-19, and on March 16, 2020, issued a Public Health
Order closing bars, restaurants, theaters, gymnasiums, and casinos in Colorado, and
WHEREAS, on March 16, 2020, Dr. Mark Wallace, M.D., Weld County Health Officer and
Director of the Weld County Department of Public Health and Environment declared a Pandemic
Health Emergency for Weld County because of COVID-19, and
WHEREAS, as a result of the restrictions placed on businesses and because of temporary
business and office closings, families in Weld County will be suffering economic hardships in the
next few weeks and months, and
WHEREAS, pursuant to C.R.S. §§ 24-33.5-701, et. seq. (the "Colorado Disaster
Emergency Act"), and Title VI of PL 93-288, as amended, The Robert T. Stafford Disaster Relief
and Emergency Assistance Act, Weld County's citizens and businesses suffering economic injury
as a result of the COVID-19 Pandemic Health Emergency may qualify for Federal disaster
assistance, or be eligible to apply for SBA Economic Injury Disaster Loans because of a Small
Business Administration (SBA) disaster declaration, as long as the Board declares there exists in
Weld County a disaster emergency.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a state of disaster emergency is in effect within Weld County, Colorado,
because of the COVID-19 Pandemic Health Emergency.
BE IT FURTHER RESOLVED by the Board that it requests the Governor of the State of
Colorado to do whatever is necessary to seek Federal funds for disaster emergency relief for
Weld County and its citizens, including, but not limited to, requesting the SBA to declare small
businesses in Weld County eligible to apply for SBA Economic Injury Disaster Loans.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign any and all documents for the purpose of defining and communicating the existence of
said disaster emergency.
