We represent Hobe Minerals LLC ("Hobe") who owns the fee miner

potential well site locations to develop such minerals.

Dear Board Members:
We represent Hobe Minerals LLC ("Hobe") who owns the fee minerals in the NE/4 of
Section 1-T2N-R63W and the appurtenant right to make reasonable use of the surface to develop
oil and gas.
Hobe desires to reach an agreement with Applicants for the compatible development of the
mineral and surface estate but to date Hobe and the Applicants have not reached an agreement.
The Applicants' proposed surface development will impact Hobe's access and use of
available drilling windows for the Greater Wattenberg Area established by Colorado Oil and Gas
Conservation Commission's Rule 318A: the 800' x 800' drilling window in the center of the NE/4
and the 400' x 400' drilling window in the center of the NENE, Section 1-T2N-R63W. Because
the Applicants' proposed project would impinge on Hobe's right to use these drilling windows, it
would require the directional drilling of wells from other locations to access bottom -hole locations
in the established drilling windows at significantly increased costs. In addition, the proposed
development may adversely impact Hobe's ingress and egress rights across the property to reach
potential well site locations to develop such minerals.

While Hobe recognizes the proposed surface development is not a "qualifying surface
development" under C R S § 24-65 5-102 (5 7) (defined to be a surface development of at least
160 acres) under which the County would be required under C R S § 24-65 5-103 3(1)(b)(I1I) to
condition approval on the applicant's certification that it has deposited incremental drilling costs
described in C R S 24-65-5-103 7 ($87,500 per well, adjusted by the CPI index) in an escrow
account with an approved commercial financial institution to defray the additional costs of having
to directionally drill wells to a bottom hole location within the established GWA drilling windows,
the proposed development will cause Hobe the same type of harm the statute is designed to protect
against
Hobe notified the Weld County Planning Commission and the Applicants of Hobe's
concerns and objections by letter dated April 23, 2020 and has contacted the Applicants'
consultant, Western Engineering Consultants, and Applicants' attorney, Lance Astrella, about
Hobe's desire to reach an agreement with the Applicants, such as an agreement that the
Applicants/Owners agree to waive certain setbacks beyond the minimum set -backs currently in
place with respect to future oil and gas development in the area Applicant's counsel
acknowledged that the proposed development will impact at least one of the established GWA
drilling windows But to date, Applicants have not extended any offer of any accommodation of
any kind whatsoever to Hobe, despite the fact that the proposed development infringes on Hobe's
right to make reasonable use of the surface of the proposed development area
For the above reasons, Hobe objects to the Application and requests that any approval be
conditioned on the Applicants reaching an agreement with Hobe In the alternative, and in absence
of such agreement, Hobe requests that the Board, in the exercise of its discretion, condition
approval of the Application upon the Applicants depositing incremental drilling costs for one well
in an escrow account in the amount of $87,500, adjusted by the CIP index, pursuant to the terms
and requirements of C R S § 24-65,5-103 3 & 103 7 While Hobe recognizes such a condition is
not mandatory given the Application does not fall within the definition of a "qualifying surface
development," Hobe's position is that the Board has the discretion to impose such a condition, and
submits such a condition is appropriate under the circumstances here where the Applicants
acknowledge that at least one GWA drilling window will be impacted and have failed to make any
offer of accommodation to Hobe
Hobe requests that this letter be included as part of the official record of the hearing before
the Weld County Board of County Commissioners, and preserves all of its rights and remedies
associated with the Applicant's infringement on Hobe's right to make reasonable use of the surface
of the development area to develop its fee mineral interests
