ARCHIVE BOX MISSING AS OF 12/ 19/2017 RESOLUTION WHEREAS, a hearing was held on January 14, 1974, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of David Camenisch, Route 4, Longmont, Colorado 80501, requesting permission for expansion of a dairy operation on the following described property, to-wit: South Half of the North Half of the Northwest Quarter of the Northeast Quarter (SzN4NWIINE±) and the North Half of the South Half of the Northwest Quarter of the Northeast Quarter (NZSZNW.NE4-) of Section 10, Township 2 North, Range 68 West of the 6th P. M. , Weld County, Colorado, and, WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to expand said dairy operation on the above described premises, and WHEREAS, the said requested dairy operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of David Camenisch, Route 4, Longmont, Colorado, for expansion of a dairy farm operation on the premises indicated above be, and it hereby is granted under the con- ditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect expansion of said dairy operation and shall have up to one year from date hereof to begin expansion of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when expansion of said dairy operation facility is completed, same shall be limited in pen size and bunk space in accordance with plans as submitted, and that said dairy operation shall not exceed 750 head at any one time. 4. Subject to application being submitted to the State Highway Depart- ment for change of access; for curbing of present access and constructing curb returns of a 31 foot radius for the new access which will be no greater than 30 feet; also paving of access to the right of way of Colorado Highway PL0768 740280 No. 119; additionally, providing for off-street parking. 5. That petitioner shall construct a retention pond which shall be approved by the State Health Department. 6. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Water Conservancy District SUBJECT : Maps of Utility Lines Tape 514 DISCUSSION : Mr . Lorenson stated that the Planning Office had been working with the utility companies and the Utility Board in an attempt to show the locations of all types of utility lines and all public right-of-ways . The area surrounding Frederick , Fire- stone and Dacono has been picked as a "test" area to see if the mapping system could be used effectively . Mr . Lorenson explained what some of the symbols meant . It is intended to show line sizes and whether or not it is an overhead line or underground . There was some discussion as to the priority basis of doing these maps now. Most felt it could be accomplished without too much trouble . SUBJECT : Rur' ; Addressing Tapes 514 & 515 DISCUSSION : Mr . Ray Allen , Mountain Bell , opened the presentation by noting that in a day ' s time , the State of Colorado loses i,he productivity of about 38 men . This is caused by being unable to locate the subscriber for a repair call or a new installation . It was decided , then , that possibly a better addressing system was needed . Public Service and Mountain Bell are working together to try and set up a system that will be the most efficient . They checked with the fire department and found them also anxious to set up a good system . Then the Post Office expressed their interest . The State Highway Department was contacted for maps and they too expressed a desire for a new system . They started with the fire department ' s numbering system and came up with two different types . One is a grid system and the other is a mile marker system . The State Highway Department goes for the mile marking system. Eventually , all the county roads will have a mile marker. So , a system was set up to incorporate 964 an addressing system with a mile marker system . This system will also expedite the job of the State Patrol in reporting accidents . Nationwide , the addressing is from south to north or west to east . Mountain Bell re- quests that the County put up the road signs and fur- nish them with maps of whatever may be in the county as well as subdivision plats . They take a subdivision and address every lot after a system is set up . After addressing the subdivision , the plats will be returned to the County for their files . They are presently making a book up that will show every address issued in the County . Mr . Allen had a map to illustrate an example of addressing . There will be a five-digit number . The first and second digits show the mile the person is in ; third digit shows the tenth of a mile ; the last two digits are the address . The reason for this system is because of so many houses close together . They will use the county road numbers in connection with the address . Mountain Bell will do all the actual addressing , including furnishing the signs to be put up . Permission will be obtained from each resident where the number will be attached to the house . Most will be put on the residence , others will be put up out at the road on a post . Mr . Allen passed around samples of the address plates . They will also have . each new addressee fill out a form in order to update the records on new addresses . There will be no more rural route and box numbers in Weld County . RESOLUTION : Be it therefore resolved to recommend to the Board of County Commissioners that we cooperate to the fullest extent and endorse the program offered by Mountain Bell . Motion by Mr . Camenisch DISCUSSION : Mr. Camenisch stated they would like to expand their dairy herd and eventually put in a dairy processing plant . Expand from 500 to 700 head . Planning Com- mission member , Mr . Clark , made field check , and seemed to think everything looked ok . -Planning staff recom- mends approval as it agrees with the Comprehensive Plan ; agrees with surrounding land use and zoning ; Health Dept . recommends approval and Extension Office finds expansion sound with regard to pen size , bunk a� space and retention pond . Approval subject to appli - cation to State Highway Dept . for change of access ; curbing present and constructing curb returns of a 31 ' radius for new access which will be no greater than 30 feet; paving access to the right-of-way of Colorado 119 ; providing off-street parking and con- struction beginning within one years ' time from date of approval by Board of County Commissioners and limited to plans submitted and 750 head . Mr . Camenisch stated he had visited with Mr . Graham and he suggested they move the driveway 325 ' instead of 272 ' west . There was a little misunderstanding concerning the time in which Mr. Camenisch had to start construction . Straightened itself out . The plans do show an ex- panded milk barn and a proposed processing plant ap- proximately 100 ' off ' ie existing right-of-way . Mr . �.orenson asked Mr . Camenisch about his plans for sale of animals . He has no plans of this nature at present. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff recommendations . Motion by Mr . Weigand , second by Mr . Clark . A vote of "Aye" by Watson , Anderson , Weigand , Clark and Rothe . SUBJECT : New Special Use Permit Application Procedure Tape 515 DISCUSSION : Mrs . Lee presented a new application procedure that would reduce the time element by two to four weeks . This new proposed method would be used only in cases that were not controversial and only in S . U . P . cases . Mrs . Lee presented a chart showing the present process and time lapse from the receipt of application until heard by County Commissioners (approximately 7-9 weeks ) . Under the proposed procedure , the time lapse would be about five weeks . The main change would be sending it on for publication after it receives legal approval , 966 before the Planning Commission would hear it . Now it ' s published after the Planning Commission hearing . People would be told at the time of submittal that they would automatically be heard by the County Commissioners . Mr . Telep had been consulted and he felt there would be no problems . Mr . Weigand re- quested that a copy of all these applications be sent to each board member in order to have a better knowledge of each case . Mr. Lorenson brought up the only problem as being non-payment of advertising fees . The Planning Office will not be charged with the responsibility of collecting these fees . MOTION : By Mr. Anderson , To adopt the new format for processing Special Use Permit Applications providing the County Attorney ' s office concurs . Said procedure being ( 1 ) receipt of application ; (2 ) legal approval ; (3 ) publication ; (4 ) Planning Commission hearing ; and ( 5 ) County Commissioners ' hearing . Second by Mr . Weigand . A vote of "Aye" by Watson , Anderson , Clark , Weigand and Rothe . Motion carried . DISCUSSION : Mrs . Lee announced further that she was presently scheduled to present this proposal to the County Commissioners tomorrow. SUBJECT : Building Permit Check List Tape 516 DISCUSSION : Mr. McKee , Chief Building Inspector , resubmitted the proposed form for the Boards ' approval . Question on well permits (exactly what is required? It would be well receipt number issued by the State ) . It was felt that it would be important to also know the use of the well . Mr . Watson raised the question concerning road access . It was asked if the number of road ac- cesses could be controlled with the issuance of building permits . No definite answer . Under the pro- posed zoning , a building permit could be denied on the basis of not enough acreage . Under the present zoning , however , the .nly penalty is a fine of $500. MOTION: By Mr. Weigand , To have road accesses controlled by issuance of building permits , first checking if we can legally do it . Second by Mr . Anderson . DISCUSSION : Mr . McKee wanted time to research with the Public Works Director , exactly what laws there were covering the limiting of raod accesses . In subdivision regu- lations , they are only allowed one access every quarter of a mile. VOTE : A vote of "Aye" by Watson , Anderson , Weigand , Clark and Rothe . Motion carried . SUBJECT : Rural Addressing Tape 516 DISCUSSION : Mr. Watson and Mr . Lorenson explained briefly (for the benefit of the press ) what Mountain Bell had pre- sented earlier regarding the new proposed rural ad- dressing . Motion was remade and seconded (as origi - nally stated on pages 964 and 965 ) and duly voted on . SUBJECT: Mathis Land Splits Tape 516 DISCUSSION : Mr. Lorenson showed the map with all the property owners listed . There was some question as to exactly 967 what the Planning Commission had wanted to do regarding this illegal subdivision . Letters were to be sent to each owner , however , the County Attorney requested the letter not be sent until County Commissioners were checked with concerning legal action . Minutes of pre- vious meeting regarding Mr . Mathis ' illegal splits were read . Mr . Cornett , an owner of one of the par- cels , had intended to sell his parcel . This is what brought it to our attention . They would like to know what they can do now . Does the Planning Commission want to follow Mathis into Wyoming and press charges? And , what happens concerning building permits to purchasers of the parcels . These are in violation of old subdivision regulations . All parcels were sold prior to Senate Bill 35 . Two have been resold . Mr. Hellewell stated that we could not force the present owners into subdividing . Mr . Lorenson felt the Board could take two steps : ( 1 ) If the Board does want to take the remedies available , recommend to the Board of County Commissioners that action be taken against Mr. Mathis ; and ( 2 ) Request that the County Attorney 's Office provide us with a statement which , if it is the Boards ' desire , that building permits can be used as a control in addition to existing remedies in our zoning resolution and initiated as soon as possible , to make an amendment to our present zoning . Should have a generalized statement to cover all zones . MOTION : **By Mr. Weigand that necessary steps be taken to make the amendment. Second by Mr . Rothe. A vote of "Aye" by Watson , Anderson , Weigand , Clark and Rothe . DISCUSSION : Mr. Lorenson stated that this motion only took care of the change in the Resolution ; did the Board want to take any action against Mr . Mathis . Mr . Watson asked a question of Mr. Hellewell as to what action had already been started , and what the County Attorney ' s feeling was concerning this . Mr. Hellewell stated it was not the Planning .;mmissions ' duty to threaten people with legal action . Instead , it should be recommended to the County Commissioners to authorize legal action . ** Mr. Weigand stated that he intended his motion to mean that this be called to the attention of the County Commissioners and they , at that time , make the decision of what they wanted to do and coordinate the necessary steps . Mr. Weigand further clarified his motion to cover both things - ( 1 ) calling it to their (Co . Com- missioners ) attention ; and ( 2 ) the amendment to stop it from happening again . Records stand corrected . SUBJECT: 1974 Budget Tape 516 DISCUSSION : Since the funds have been cut for the Open Space Study something needs to be arranged in order to cover the costs . It is very important to keep the intern stu- dent presently working on this study . We would lose too much if another person was assigned to this study from the Planning Office staff. The County has con- tracted to do this study , and 50% funding will be lost 968 if the Study can ' t be finished . The Finance Director indicated that when the funds were transferred from Regional to County , they weren ' t aware that this was what had happened . However , no alteration was made before the final budget approval . It was felt that a meeting should be set up between Planning Commission and County Commissioners before any definite action was taken on this matter. SUBJECT : Existence of Established Irrigation Facilities Tape 516 & DISCUSSION : Mr . Lorenson read a letter from Greeley-Loveland 517 Irrigation Co . regarding the problems arising from the existence of established irrigation facilities . It does affect the zoning and planning and the develop- ment of land adjacent to and also above and below the irrigation facility. The letter further stated that under new construction standards , the reservoirs will have to be able to contain a "dream storm" (one that would happen once in a 1 ,000 years , or a 25" rain in 6 hours ) . The letter was concerned with not only the type of development up above the reservoir , but also below. Possibly need more land designated as flood plain areas to decrease the damage to property . Mr. Rothe suggested that Mr. Lorenson visit with the State Engineer ' s Office and find out exactly what the requirements are . Mr. Lorenson stated they have to be very careful what they designate as flood plain . So far , the only acceptable source is the Corps of Engineers (of what a flood plain is ) .
