Home My WebLink About20203122.tiff/ 9 4,2O WELD COUNTY CODE ORDINANCE 2020-18 :__= IN THE MATTER OF REPEALUNG AND REENACTING, WITH AMENDMENTS, CHAPTER 6 LAW ENFORCEMENT, OF IFFEIW _ ID COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY C .MSAONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code o rdinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that Chapter 6 of the Weld County Code be, and hereby is, repealed and re-enacted, with amendments, to read as follows. CHAPTER 6 LAW ENFORCEMENT ARTICLE I - Adoption of Model Traffic Code Division 1 - General Provisions Amend Sec. 6-1-10. - Adoption of Model Traffic Code for Colorado, 204-0 _ 0 ! ev0Sed Et0t0on. Pursuant to Part 4 of Article 15 of Title 30, and Part 1 of Article 4 of Title 42, C.R.S., as amended, there is hereby adopted by reference Articles I and II, inclusive, of the 20--020 Revised Edition of the Model Traffic Code for Colorado (hereinafter referred to as the Model Traffic Code), promulgated and published as such by the Colorado Department of Transportation, Traffic Engineering and Safety Branch, 2829 W. Howard °Dace, Denver, CO 80204Staff Traffic and Safety Proj-e s Bran- ,420 --as- ,rkansas A e-n-ue,Denver, Coloraco 80222. The subject matter of the Model Traffic Code relates primarily to comprehensive traffic control regulations for the County. The Fine Schedule found at Appendix 6-A to this Chapter shall be valid and enforceable for all corresponding offenses adopted in this Article. Offenses which lack a corresponding fine in the Fine Schedule shall have a fine as established in the state statutes, which is incorporated herein by reference. The purpose of this Article and the •c -Code adopted herein is to provide a system of traffic regulations in the County which are consistent with state law and generally conforming to similar regulations througnout the state and tie nationtt-o-se found elsew --re-- n -lorado and the United —S -4 —es. Deletions to the Model Traffic Code, as adopted for o, are the following Sections and Parts found thereinThe 2020 edition of the Model Traffic Code is adopted as if set out at length, save and except the following articles and/or sections which are declared to be inapplicable to this County and are, therefore, expressly deleted: Sections 101, 102, 104, 111, 113, 804, 1203, 1410, 1701, 1706, and as otherwise stated in this Article, and Parts 3, 4, 13, 16 and 18. Amend Sec. 6-1-30. - Additions or modifications. 7 the followingThe said adopted Code is subject to the following additions or modifications: A. The Model Traffic Code, Section 1204, Parking, is hereby amended to add the fo lowing subsections (69) and (710): "1204. Stopping, standing or parking prohibited in specified places. "(69) As the unregulated parking of oversized vehicles in residence districts within the County creates a public safety hazard and a public nuisance in that the parking of such vehicles diminishes parking availability, inhibits through access and sight visibil ty and limits access of emergency vehicles to property, no person shall park any oversized vehicle upon any County -maintained public street or highway within any residence districts within the County, except for the purpose of loading and unloading. "(710) For the purposes of this Section, only: Remainder of Section — No change. Amend Sec. 6-1-40. - Procedures and penalties. Sections 1709 and 1710 of the Model Traffic Code are modified, as follows: A. thru D.2. — No change. 3. A seventeentwenty-two-dollar ($22.00) surcharge shall be added to tickets for which a defendant is charged with speeding no more than twenty-four i24 miles per hour over the posted maximum speed limit, fifteentwenty dollars ($1520.00) of which shall be transmitted to the State Treasurer for deposit in the Colorado Traumatic Brain Injury Trust Fund created pursuant to Section 26-1-309, C.R.S., as required by Section 42-4- 1701(4)(e)(ii), C.R.S., and two dollars ($2.00) of which shall be left deposited in the County's General Fund. Remainder of Section — No change. Amend Sec. 6-1-50. - Application. This Article shall apply to every street, alley, sidewalk area, driveway, park and to every other public way, public place, or public parking area within the boundaries of Weld County, the use of which this county has jurisdiction and authority to regulate. The provisions of Sections 1401, 1402, and 1413 of the Model Traffic Code, respectively governing reckless driving, careless driving and eluding a police officer, shall apply not only to public places and ways but also throughout Weld County. AMEND APPENDIX 6-A — MODEL TRAFFIC CODE FINE SCHEDULE BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Municode to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid.
