RESOLUTION WHEREAS, a public hearing was held on April 30, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Lochbuie Develop- ment, c/o Gordon McLain, Route 1-0100, Brighton, Colorado, requesting approval of site for a sewage treatment facility on the following described property, to-wit: A tract of land located in the NW4 of Section 31, Township 1 North, Range 65 West of the 6th P. M. , Weld County, Colorado, and more particularly described as being approximately the South 1600 feet of the following described parcel, to-wit: Beginning at the North 4 Corner of said Section, thence, South 272 feet, thence South 36° 19' East, 627 feet, thence South 51° 51' West, 232 feet, thence South 22° 31' West 567 feet, thence South 16° 15' West, 182 feet, thence South 3° 40' West 407 feet, thence South 10° 58' West, 900 feet, thence South 76° 35' West, 112 feet, thence North 26° 41' West, 411 feet, thence North 12° 12' West, 842 feet, thence North 26° 06' East, 280 feet, thence North 43° 59' East, 220 feet, thence North 24° 10' West, 430 feet, thence North 1° 55' East, 555 feet, thence North 9° 00' West, 380 feet, thence East 0° 00', 740 feet, to the point of beginning, containing 18. 35 acres, more or less. and, WHEREAS, the petitioner was present, and WHEREAS, there was some opposition to the request of petitioner, and WHEREAS, the said requested sewage treatment facility is to be located in an agricultural zone as set forth in the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County a sewage treatment facility is permitted upon approval of site by the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner; and studied the recommendations of the Weld County Planning Commission, and WHEREAS, the said Board has carefully considered the petition, evidence, testimony, petitions and remonstrances and given the same such weight as it, in its discretion, deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Lochbuie Development, c/o Gordon McLain, Route 1-0100, Brighton, Colorado, for site approval to locate a sewage treatment facility on the premises indicated above, be, and it hereby is granted under the conditions following: PL0737 /��7 p 730554 �, 1, 1. That any and all sewage treatment facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said sewage treatment facility and shall have up to one year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. SUBJECT: Sewage Treatment Facility LOCATION : Sec 31 Tl R65 APPEARANCE : Mr. McLain DISCUSSION : Mr . McLain presented the ,proposed sewage facility to serve Space City and future development . Mr. Paul stated it has been approved by the State and County Health Depart- ments and the State Water Pollution Commission . They will need to get a permit from the Corp of Engineers once a year. The design will take care of Space City where they are hav- ing many problems with their septic systems and an addition- al population of 5000. Mr. Lorenson stated it has been ap- proved by the Planning Commission. Mr. Mclaln stated he plans for the City to evenually own the facility rather than form a Sanitation District. On further discussion , Mr. Mauldin stated Colony Park had not been approved by the Utility Board as it was tabled when it was presented . Mr. Lorenson further stated , although it had been approved by the Planning Commis- sion and the County Commissioners , it had not been recorded as the Commiss-ioners required signed water and sewer con- tracts . Also if this proposal is approved , the Planned Unit Development will have to be altered as this facility does not comply with the plat that has been approved . Mr. . Lupton below the 52 highway to to an existing pipeline north which is east of Ione corner. Gas from this well will be delivered to Western Slope Gas through this sys$tem. They are acquiring private ROW all the -. ,way through , ther'S permit from the State Highway for cross- ing and from the County. Mr. Nix stated he felt performance should be in less time . Mr. Connell stated the only reason it is in there is not to initiate performance , it is simply to give the Com- missioners a tool and a position time limit , if necessary , to cancel the permit. Mr . Miller stated he could comply with the requests . Mr. Ohi stated there are several quest- ions posed by the Health Dept . that should be answered . Melvin Dinner reviewed the past history of the feeding operation and presented the plans for the proposed expansion . A petition signed , by surround- ing property owners approving the project was presented . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the approval of the , Health Department and the Planning staff' s recommendations . Brig Watt stated his mother-in-law owns property across the road from the project and is concerned regarding the • County road running north and south to the west of the pro- ject and the dust problem that would be created by the con- struction . .Asked if any one could enlighten, him on when this would be paved . , Mr. Glenn Billings stated they are having a study done on it at this time but could not give any specified time when it would be paved. Mr . ' Freemyer stated very little grading will be necessary on the site , mainly to stabalize . Mr . Dinner stated the construction will involve very little traffic on the road. Construction to begin within one year of approval by the Board of County 662 Commissioners and limited to the pens shown on the submitted plan . Mr. Jacobucci stated they were in accord with the holding pond requirement and will follow through as directed . Mr. Ohi stated a copy of the application had been submitted to Adams County but no comment had been received . Ohi gave the recommendations of the staff that they recommend approval as it complies with the land use policy , it is compatible with surrounding land use and zoning . The ddsign is judged adequate by the Extension Ser- vice and is reommended , for approval by the Health Dept. If approved it should be subject to a set-bask of 600 ft. as re- quired by the Zoning Resolutions , holding ponds if required by the Health Dept . , and construction to begin within one yr. of approval by the County Commissioners and limited to the size shown on the submitted plans . Mr. Paul stated the hold- ing pond is taken care of with cement pits . There was dis- cussion regarding the 600 foot set-back . It was agreed if the open pens meet the 600 ' requirement , the enclosed far- rowing buildings can be within the 600 ' . Mr. Dreiling agreed . DISCUSSION : Mr. Ohi read the recommendations of the staff that the application be tabled for the following reasons : The Colorado Geological Survey has determined that the application contain- ed insufficient geological investigation and has requested a complete geological report be made and submitted to their office for evaluation . The geological report and geological maps submitted after the scheduling of this hearing has been submitted to the Colorado Geological Survey for review. The Soil Conservation District has evaluated the application and has found that 21 acres of contributory off-side drainage has not been taken into account in the drainage plan . A decision regarding this application will be affected by a meeting to be held between the Greeley Water Board and the 863 Greeley City Council concerning amendment of the Greeley Comprehensive Planning area and should await the outcome of this meeting . The subdivision as proposed is in direct op- position of the Greeley Comprehensive Plan according to the Greeley Planning Coordinator. The West Greeley Soil Con- servation District has requested that the developer propose a wind and water erosion control plan because of soil topo- graphy and drainage conditions . The West Greeley Soil Con- servation District feels that existing small dam is in the high hazard classification and should be redesigned . Mr. Ohi submitted letters to the members from these various agencies . Mr. Bigbee presented an exhibit showing the prop- erty and the adjoining property that has been previously plat- ted . Three of these lots have been recorded but are being replatted . The dam was built according to engineering spec- ifications . Mr. Ohi stated the concern is no emergency spill - way. There are 21 acres that was not included in the drainage report . There was discussion regarding the erosion . Mr. Ohi thought there should also be a grading plan . MOTION : By Mr. Weigand to table the application and. a field trip by the Planning Commission be made to the site . Second by Mr. Heitman . Ohi stated the staff recommends approval as it agrees with the land use policy to the extent that it would improve services in the area . • It would upgrade sewage systems from individual septic tanks to a collection and treatment system. It has been approved by the State and County Health Departments . Approval of this system should not imply ap- proval of expansion of the area for housing . Mr. McLain stated the system would be an aerobic digestion system. The criteria that has been set up by the EPA for the 1975 and 1978 criteria on sewage treatment plants have been met and sur- passed by the plant that is proposed for this area . The water that is treated will go to Farmer' s Reservoir and Irrigation Company. They plan to install sewer and mains throughout the Space City area . Mr. Meyers explained the operation of the plant . It will be very much over designed for the first few years . The design is set up to accomodate a future popula- tion of 7000 people . Mr . Gary Fortner presented a progress report on programs being funded through the Larimer-Weld Regional Planning Commission. Housing Study - The study is a more detailed survey of housing needs and housing economies than the one prepared by A. M. Vorhees and Associates, which was primarily a compilation of i970.U.S: .Census: data. A questionaire has been prepared and field .interviews will begin soon in the Greeley area. Those to be interviewed were selected by a random numbering process. Once housing needs are surveyed and compiled, realtors , contractors, bankers, and others involved in providing; housing will be interviewed in an effor to de- termine how supply may more adequately meet demand and need. 865 i Drainage Study: The study concentrates on the Greeley, Windsor and Tri- town (bacon°, Frederick, Firestone) areas , our major growth area. Drain- age basins in these areas have been defined and run-off potential for them determined. Policies applicable to drainage have been proposed. Open Space Study: Project staff have almost completed compilation and supply of open space in the two county region. The next step will be determination of methods to obtain needed open space in conjunction with planned growth in the two-county region. Soils Classification: Progress has been limited by problems obtaining soil photos at appropriate scale from the Soil Conservation Service. Comprehensive Plan Update: Revised future land-use plans for Ft. Lupton and Platteville are being prepared. The towns are also receiving help from staff members to revise or adopt zoning and subdivision regulations so that the revised comprehensive plans may be implemented. The Weld County Comprehensive Plan was discussed. Several members of the Planning Commission expressed their concern about the unavailability of copies of the Plan for public distribution. They also would like to discuss the fetter written by Bill Southard concerning the .Plan with the Planning Director at the next executive meeting. John Watson briefed the members of the Planning Commission on recent proposed legislation related to the Regional Transportation District. He asked for the sentiment of Commission members concerning a proposal to form a council of governments for Larimer and Weld Counties that would create a regional transportation plan for the two-county area. . This regional transportation plan would be funded by the two counties and would concentrate on the needs of the two-counties with the Regional Transportation District. During the site application review of your community' s collection facilities, I met, with Mr. William R. Kelly o£ ARIX to discuss the total project. During the review I studied past records and determined a Special Use Permit had been issued in December of 1973. Said permit is number SUP-189 . The permit granted by the County is still active. According to the permit, however, the Board of County Commissioners, for good cause shown, may on motion revoke the permit i£ construction is not commenced twelve months from date of approval. Based upon my conversations with Mr. Kelly, the facilities proposed by the Town of Lochbuie are substantially the same as approved in the 1973 permit. As a result of the above, the only action required for Weld County is the obtaining of building permits. Gordon McLain and in cooperation with his land planning consultant, Mr. Jack Herklotz, we investigated the engineering geologic and ground water condi- tions in the vicinity of the Ez of Section 36, T. 1 N. , R. 66 w. , Weld County, Colorado. The area studied is approxi- mately 300 acres and is located about five miles southwest of Hudson, Colorado and five miles northeast of Brighton. . It is• our understanding that the property is to be developed into a mobile home park with a central water supply system. We understand also that sewage treatment facilities are to be located to the northeast in Section 31. The purpose of our investigation is to determine the i availability of ground water supplies and to delineate any engineering geologic problems that might be encountered during development and construction. A preliminary soils and foundation investigation by Robert W. Thompson, Inc. , disclosed that the soils conditions are favorable for the proposed development. Mr. Thompson's report, dated November 30, 1972, delineates site conditions with respect to soils and includes recommendations relative to building foundations, pavements and shallow ground water conditions . SUMMARY OF CONCLUSIONS The geologic environment in which the proposed Lochbuie l • - Development is located is favorable for the proposed develop- ment. The hydrologic characteristics of the area are favora- ble from a-geologic standpoint and flood potential and exces- sive soil erosion potential are remote. See Figure 1. ' Proper storm drainage and runoff control systems are being planned . • by Frasier & Gingery, Inc. Soil conditions have been delineated • from a preliminary standpoint by Robert W. Thompson, Inc . , and • no soils and foundation problems will be encountered if Mr. • Thompson' s recommendations are followed. . Existing .irrigation wells on or immediately adjacent to the property are available as sources of ground water sup- • Janes . See Figure 2. Adjudication of two of the wells and filing for adjudication with the water court of the remaining three wells can be expected to substantiate the legal availa- bility of the water supply. Domestic, commercial and munici- pal uses have been filed for and accepted by the Colorado Division of Water Resources, as shown on the well permits, and • by the Water Courtcas shown on the adjudication proceedings. • No water suit relative to change of use or change o£ point of diversion is anticipated. • The impact of the proposed project on the hydrogeologic • environment can be expected to be favorable. Irrigation of lawns and parks—will improve the existing nearly barren land • - scape. The return of treated sewage affluent to the surface • • . water system will be beneficial to the junior and senior water rights within the ground water-surface water system. . • • -2- • The water table beneath the property is sufficiently low,_ and ground water withdrawals are anticipated, so no pollution of the ground water-surface water system is expected. ENGINEERING GEOLOGIC CONDITIONS Lochbuie is underlain by interbedded clay, silt, sand and gravel alluvium to a depth of 50 to 90 feet . The allu- vium lies in a relatively deep channel two miles wide that extends from a point over six miles southwest of the property northeastward to the South Platte River. This alluvium-filled valley is fairly well defined in various maps included in U.S . Geological Survey Water Supply Paper 1658 entitled Ground Water Resources of the South Platte River Basin in Western Adams and Southwestern Well Counties, Colorado. Much of the alluvium in the valley, which is cut into underlying shale bedrock, is water-saturated and is a good source of ground water supplies . The depth to the water table in the alluvium ranges from about 10 feet along the east edge ' of the property to over 40 feet along the west edge. The alluvium is underlain by the Arapahoe formation which is made up of soft blue to gray sandy shale and clay and con- tains a few lenticular sandstone layers. The lower portion of the Arapahoe formation contains white to yellow sand and gravel conglomerate with minor amounts of shale and clay. The Arapahoe formation is underlain by the Laramie formation which is, in turn, underlain by the Fox Hills sandstone. -3- • As shown by the results of preliminary test drilling by Robert W. , Thompson, Inc . , the proposed structures for the property will be founded upon loose to medium dense, clean to clayey sand which is underlain by stiff to very stiff sandy clays to depths of as much as 29 feet. Driller' s logs of water wells completed in the east 1/2 of Section 36 show that .the sandy and clayey subsoils are underlain by clay, sand and gravel alluvium to a depth of approximately 90 feet. The soils of the area are defined by the Soil Conservation Service as � - n "warm, deep, well drained, nearly level to sloping soils on upland plains . " The sandy soils of the area have a high precipitation infiltration rate and •surface water drainage is not well developed. The soils and general topographic features reflect ancient sand dune and blow out characteristics with a generally . northwest to southeast trend. The sandy soils at the surface are underlain •by sandy clays which apparently occur as lenses to a depth of at least 30 feet. As shown on Figure 1, the surface water drainage area is less than three square miles, including the property and the drainage area to the northwest. Surface water runoff within the drainage area is minor due to the sandy soils . Also, drainage is intercepted by east-west trending borrow ditches, the Speer Canal and West Burlington Extension Ditch. Although • the geologic conditions indicate no engineering geologic pro- blem with respect to surface water runoff, we understand that the storm drainage engineering is being done by Frasier & Gingery, Inc . ' -4- • ENGINEERING GEOLOGIC PROBLEMS • Our investigation disclosed that no engineering geo- - logic hazards exist at the present and none are anticipated in the future for the proposed development. Minor soil pro- blems that may be encountered are well defined in the preli- • minary report by Robert W. Thompson, Inc. Remedial measures with respect to soils and subsoils conditions should be taken as recommended in Mr. Thompson' s report and as a result of a \ detailed soils investigation recommend by Mr. Thompson. The withdrawal .of ground water through existing irriga- . • tion wells on the property will help in maintaining a water table well below the proposed foundation structures . We do not anticipate ground water withdrawals greater than historic withdrawals for irrigation and municipal purposes . • Much of-_the_property has been irrigated from wells on the_property_, and the application of water to the surface . _under the proposed_plan is expected to be less_ in quantity -- cc • I than_the historic application._Because of this, we do not _ -- - i anticipate excessive amounts of water,-to be_us.ed for _irriga- ` is tion of lawns which could detrimentally affect the proposed _development. Beebe draw which carries surface water and ground water northeastward toward the South Platte River. IMPACT ON HYDROGEOLOGIC ENVIRONMENT The project area is sufficiently_flat and the proposed project will create no soil erosion problems if surface drain- r age is properly designed and constructed. Surface drainage and subsurface drainage can be controlled easily by surface drainage system and tie use of subdrains within utility line trenches . Surface and subsurface drainage can be expected to conform to the natural surface and subsurface drainage which is to the east and northeast. _Utilization of ground water for irrigation of lawns and _park areas can be expected to improve the aesthetics of the landscape. The utilization of adequate sewage treatment rather than individual septic tank-leach field systems will be an asset to the ground water and surface water system in Beebe draw. We suggest that the many septic tank-leach field systems in, the area be replaced by connections to the proposed sewage treat- ment facilities : If coordination with the irrigation water conveyance system in the area can be accomplished, the effluent from the proposed sewage treatment plant could be used for irrigation purposes, off-season storage of irrigation water and recharge, • to shallow ground water aquifers in Beebe draw, the valley of Box Elder Creek and other tributaries of the South_Platte River. It is apparent that the proposed project will result in a much lower annual consumption of ground water than has been consumed historically. We recommend that consideration be given to future use of the excess available water within the ground water-surface water system within which the project area is located.
