TO INCLUDE DOG DAYCARE AND BOARDING) IN THE A (AGRICULTURAL) ZONE
DISTRICT - TROY ANDERSEN
A public hearing was conducted on February 19, 2020, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 13, 2020, and duly published
January 17, 2020, in the Greeley Tribune, a public hearing was conducted to consider the request
of Troy Andersen, for a Site Specific Development Plan and Use by Special Review Permit,
USR19-0069, for a Kennel (up to 120 dogs six (6) months of age or older, to include dog daycare
and boarding) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made
this a matter of record.
VA Diana Aungst, Department of Planning Services, presented a brief summary of the proposal
and stated 16 referrals were sent out and 12 agencies responded. She indicated the existing
house will be used as the manager's residence and a new building and kennels will be
constructed. She noted there will be ten (10) full-time employees, provided the hours of operation,
and described the parking and surrounding uses. She stated no correspondence was received
regarding the application and the site is within the three (3) mile referral area and the Coordinated
Planning Agreement (CPA) of the City of Fort Lupton and the Town of Firestone. She reviewed
the referral comments and stated the City of Fort Lupton indicated they were interested in
annexing, but the Town of Firestone was not. She entered the favorable recommendation of the
Planning Commission into the record as written and provided images of the site and surrounding
views.
Zachery Roberson, Department of Public Works (PW), provided a brief overview of the
transportation plans and requirements, and stated the access is on County Road (CR) 19, and an
Access Permit had been granted. He provided traffic counts and average speed, stated a Traffic
Impact Study (TIS) had been submitted and provided details from the study. He stated PW is

requesting an Improvements and Road Maintenance Agreement with triggers and presented the
drainage and grading requirements. In response to Commissioner Kirkmeyer, Mr. Roberson
provided the anticipated daily round trip information.
Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions, stated water will be provided by the Central Weld County Water District (CWCWD)
and a commercial septic system will be installed. She indicated the applicant will need a Pet
Animal Care Facilities Act (PACFA) license from the Colorado Department of Agriculture, the
noise level is residential and Development Standards (DS) #21-29 address Environmental Health
items. In response to Commissioner James, Ms. Light indicated DS #27 addressed the disposal
of animal and feed waste because it is not addressed by the Colorado Department of Agriculture,
Division of Animal Industry regulations.
Troy Andersen, applicant, explained the need for the facility based on dog ownership
indicated in a population study for the area. He described the site plan and the design of the
kennels and reiterated the existing house will be the manager's residence. In response to
Commissioner Moreno, Mr. Andersen provided the square footage of each building and indicated
he has been in communication with the Platteville/Gilcrest Fire Protection District regarding the
installation of one (1) fire hydrant and confirmed the turning radii accommodates a fire truck. In
response to Commissioner James, he stated a noise study was not completed and the closest
neighbor resides 600 feet to the north.
No public testimony was offered concerning this matter.
In response to Commissioner Kirkmeyer, Mr. Andersen confirmed the parking lot is crushed
concrete, is over one (1) acre in size, and has room for 58 parking spots. He indicated there is no
existing landscaping, and Ms. Aungst confirmed the Department of Planning Services is
requesting a Landscape and Screening Plan. In response to Commissioner Kirkmeyer, he
reiterated the requirements of the Platteville/Gilcrest Fire Protection District and Mr. Roberson
confirmed there is not a requirement for the dedication right-of-way. Commissioner Kirkmeyer
suggested adding a new Condition of Approval (COA) #1.E (Landscaping and Screening Plan),
adding language to COA #1.F.6 (map shall show the landscaping) regarding the Landscaping
and Screening Plan, deleting the "s" from "locations" in COA #1.F.10 (access), deleting "and
tracking control" from COA #4.A (construction of approved access), and adding language to
COA #1.A (Improvements and Road Maintenance Agreement). Commissioner James suggested
adding language to DS #4 (hours of operation) to clarify customer hours. Commissioner
Kirkmeyer suggested adding "in accordance with the approved Landscaping and Screening Plan"
to DS #6 (maintenance of screening/landscaping) and adding compliance language to DS #8
(Noise Abatement Plan). She also suggested adding "and Road Maintenance" to DS #15
(requirements of Improvements and Road Maintenance Agreement) and #16 (annual review of
Improvements and Road Maintenance Agreement), deleting duplicate DS #17 (requirement of the
Road Maintenance Agreement) and #18 (annual review of the Road Maintenance Agreement),
adding language to the last sentence in DS #24 to read, "The operator shall be in compliance with
the approved Dust Abatement Plan at all times", and deleting DS #25 (permissible noise level).
Commissioner James suggested adding additional language to CDS #4 to read, "The boarding
facility is a 24 -hour operation." The Board agreed to all of the aforementioned changes.

le In response to Chair Freeman, Mr. Andersen indicated he had reviewed, and agreed to
abide by, the Conditions of Approval and Development Standards, as amended. Mr. Choate
offered the additional language of "with triggered future improvements" for the aforementioned
change to COA #1.A.
• No public testimony was offered regarding changes made to the Conditions of Approval and
Development Standards.
• Commissioner Kirkmeyer moved to approve the request of Troy Andersen for a Site Specific
Development Plan and Use by Special Review Permit, USR19-0069, for a Kennel (up to 120 dogs
six (6) months of age or older, to include dog daycare and boarding) in the A (Agricultural) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as amended. The motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:31 a.m.
This Certification was approved on the 24th day of February, 2020.
