Under date of December 9 , 1922 , I forwarded to The Stock Growers National Bank of Cheyenne , Wyoming , draft payable to said bank for $3557 . 34 as the purchase price for Sheriff ' s Certificate of purchase issued to said bank for the North Half of Section 12 , Township 11 North , of Range 63 West of the 6th P . M. , in Weld County , Colorado , together with tax sale certificate No . 150 , being the tax sale for taxes of 1919 , due and payable in 1920 and on account of failure to pay taxes the above described land was sold by the Treasurer of Neld County , on December 11 , 1920 , for $148 . 69 . Under date of December 11 , 1922 , The Stock urowers National Bank of Cheyenne , Wyoming , forwarded to me the Sheriff ' s Certificate of Purchase for said land and the tax sale certificate No . 150 above mentioned assigned to the Bank of Car enter and I received the same on the 12th day of December , 1922 . The reason the Bank of Carpenter purchased said Sheriff ' s Certificate of Purchase and the tax sale certificates was that the Ban's of fi ,,rpenter held a subsequent deed of trust on said premises and purchased said certificates for the purpose of obtaining the title to said land . By mistake of some kind the tax sale certificate 150 for the year 1920 above mentioned has been lost and cannot be found . The said tax sale certificate was issued to 11. C . R . Park under date of Dec 11 , 1920 , for taxes of 1919 , in the amount of $146 . 69 . Under date of October 19 , 1921 , the taxes for 1920 on said land were endorsed on said certificate in the amount of x;,138 . 11 and February 7 , 1922 , the said tax sale certificate was assigned by u . R . Park to the Wyoming Trust and Savings Bank of Cheyenne , Wyoming , and said bank paid ' therefor 327 . 37 . The records of the County Treasurer of eld County and the County Clerk of .-.geld County show that said tax sale ce _ tificate was assigned to the Wyoming Trust and Savings Bank of Cheyenne on February 7 1922 . The said certificate is now the property of of the Bank of Carpenter and has never been assigned by the Bank of Carpenter to anybody but cannot be produced and surrendered to . the Count:T Treasurer for redemption purposes because it is lost . iHEREFORE , this affiant respectfully asks the County Treasurer of Weld County , Colorado , and the County Commissioners of Weld Counv , Colorado , to cause a redemption to be made from said tax sale without surrender of th,_ tax sale certificate and your affiant tenders herewith a bond indemnifying the County treasurer and the County Commissioners of Weld County from any and all loss or damage because of issuing a certificate of re- demption from said tax sale without surrender of the original tax sale certificate . This affiant and also his wife have executed said bond as surety and both of said sureties are owners of real property in Weld County , Colorado and well able to pay any damage that may be suffered by Weld County on account of redeeming said land without surrena er of the tax sale certificate . Eldred , the Uounty Assessor of said Weld County arbitrarily returned a 1923 tax schedule for said corporation , and did , in said schedule , return the net total of said corporation ' s taxable personal property at the grossly and opp . essively excessive amount of $27 ,060 . 00 . That , thereafter , and on or about Auuuat 17 , 1923 , your petitioner formally com- plained in writing to the said County Assessor of the tax valuation of its property so returned arbitrarily , and objected to the excessive amount so returned for the purposes of taxation , and requested a reduction in the net total valuation of its personal property for the purpose of the 1923 tax. That a hearing was held by said County A .: sessor upon this petition for reduction , and , on or about August 28 , 1923 , said County Assessor did reduce the net total valuation of said corporation ' s personal property , for the purpose of the 1923 tax , from said arbitrary valuation of $27 , 060 . 00 to a net total valuation of $6960 . 00 . That said net total valuation of $8960 . 00 includes the item of $2500 as a valuation on the n: t ;s held by your petitioner as a cart of its assets ; that said item of x;,2500 is excessive in amount , and is erroneous in statement and computation , and utterly disre:cards the provisions of law in the computation of solvent credits possessed b:,T said corporation . Your petitioner further alleges that the total assessment on the Southwest Quarter of said section 34 , should not be in excess of $2670 . 00 for real estate and $11 , 280 . 00 for improvements , and that the actual value of said real estate and improvements does not exceed such a ount . The improvements upon the Southeast Quarter of said section 343 have a value of not to exceed $43 , 000 .00 and any assessment placed thereon in excess of w43 , 000 . 00 and any assessment placed thereon in excess of $43000 . 00 constitutes an assessment in excess of the actual value of such improvements . The improvements on said quarter section were placed there in 1908 , and are not in any way modern or up- to-date . On account of the impr ove- tents being old and out of date , it is more expensive to operate its mine with the improve- monts and if they are replaced with up- to -date improvements and equipment at said mine for the reason that it has a life at said mine of not to exceed five years . At the tetermina- tion of the working life of this company at said mine all of said improvements and equipment will have to be sold as junk . The equipment at said mine w;' i ch is included in said assessment is old and out of date and very little could be realized therefrom if it were sold . In previous years , the rate of assessment for advertising boards in practically every county in C )lorado , has been ar ung 30/ per running foot . This year , your Assessor Mr . Bedford , has assessed us at the rate of a -:'iroximately Ol . 53 per running foot . On April 1st , we had Thirty-six Hundred and Twenty-five ( 3625 ) lineal feet of advertising boards in :;-our County , and turned in our assessment at the same figure at which they had been assessed in former years as approximately 30/ per foot , which made our assessment a -proximately 01000 .00 . The assessment made by the Assessor is $5540 . 00 . The writer was in Greeley on Wednsday , September 19 , to take this '1. p with the Board , as we had been advised by Lir . Bedford that this was the data on which matters of this kind would be given consideration . However , I was unable to meet the Board as you were all out of town and :;-our Mr . Hewitt advised me that the date of the hearing was September 18th , and that the entire Board w uld be out of town for the balance f' f the week , so he suggested that I , therefore , present our c .- se in writing to you . Our adve :.'tising boards are rather a temporary affair , that i s , we are never sure just how long they will remain on anyone location , and when a board is torn down , the material in the board is of very small value , so our sign boards , therefore cannot be classed as improvements on the property such as other permanent structures . A great deal of material which is used in our metal signs is second-hand material , which had pre- viously been used for painted signs else'. sere , and 1,7�: ich no longer will hold paint during the cola v either , so we the refore rebuild the si-7ns ana use them for poster i Bards . You can see that the value of a sign of this kind is considerably less than if it were built out of new material , and some of the signs we have in Greeley are quite old and are in constant need of re pair . The wooden sins on the �_ i :=:h' airs , a_ e structures that have a life of approximately five years , so that all told , an advertising board is in an entire different class of property from an ordinary improvement on real estate . An advertising board is an asset to this Company only as long as it has a live advertisement showing on the same , and the minute that the advertisement is no longer running , the sign board becomes a liability on our hands as the rent on the location on which they are placed goes on just the same . The present farm conditions in '►'veld County has seriously effected our business , in fact , of the Forty-seven ( 47 ) signs that we have built there , Twenty-four ( 24 ) of them have no advertisement on tjem at the present time and have not had for sometime past . This is due , of course , to the depresses farm conditions all over the country as the merchants can ' t afford to advertise if the farmer has not got the money wherewith to purchase the merchandise . Therefore , from a business standpoint , our hoards are really not worth as much to us now as they were when things were flourishing . Taking the matter from a standpoint of sale value , we have in the past sold a good many of our si : •ns in various counties , and also have purchased them from other companies , and we find from past experience that a resale value of an advertising hoard is close to 500 per lineal foot . AND WHEREAS , as the result of said investigations and said examination of said Abstract , it is the opinion and judgment of said Colorado Tax Commission that the total valuation for taxation purposes of the real and personal property in Weld County is and should be the slim of $114 , 378 , 220 . and not $110 , 231 , 820 . as heretofore certified by the Assessor of said County ; AND WHEREAS it is the opinion and judgment of said Tax Commission that of the said recommended increase of $4 , 146 , 400 . the amount of $2 , 501 , 310 should and ought to be placed upon the item and classification of lands in said County known as " Irrigated Lands" ; that the sum and amount of $874 , 640 . should and ought to be placed upon the item and classification of lands known as "Dry Farm Lands" ; and that the sum and amount of $770 ,450 . should and ought to be placed upon the items and classification known and designated in said Abstract as " Town and City Lots and Improvements Thereon" . Green , Frank Green , Anna Green Beardsley , Grace Loustalet Hunter and Winifred Hannas Klett , as a memorial to Anna Sterling , have given to Weld County to be kept at its Greeley Hospital an X-Ray machine ; AND WHEREAS , said figt is tendered on the following conditions : That Weld County shall furnish all accessories necessary to develop pictures and shall establish an X-Ray laboratory in said hospital in Greeley ; shall furnish equipment as may be needed from time to time for the proper use of the machine ; shall designate a person , to be trained as technicians to operate said machine and shall require that said machine be operatred only by the person , or persons so designated ; shall charge fees only at a reasonable rate for Roentgenoscopis and Flueroscopic work and shall regulate said fees according to the patient ' s financial ability , and shall charge no fees for patients under care of the County Physician , and patients from the County Hospital by the County Physician , declared to be paupers ; and shall keep said machine in good repair at all times . And further , said machine shall not be sold or leased to any one , but in the event Weld County should discontinue the operation of Greeley Hospital at Eleventh Avenue and Sixteenth Street , said machine shall be kept under the same conditions at the County Hospital on the north side of Greeley , or wherever the pauper hospital of Weld County shall be located . Frink have been unable to agree on the compensation to be paid her for the State Highway , which at Ione traverses a two acre tract of hers , and she has agreed to submit the matter of said compensation to arbitration , according to Chapter 26 , of the Colorado Code , and an agreement of arbitration in writing dated November 2nd , 1923 , prepared by the County Attorney has been executed by her . BE IT RESOLVED , that the Board of County Commissioners of Weld County , Colorado , join in said arbitration and execute this day said agreement submitting said matter of arbitration to John Birkle and I►I. R. Deacon , and they shall appoint the third arbitrator , as is more particularly set forth in said written agreement this day executed . Member C .A . Prink , as first party , respondent in eminent domain proceedings to be brought hereunder , and the Board of County Commissioners of Weld County , Colorado , petitioner in eminent domain proceedings to be brought hereunder , as second party , WITNESSETH : WHEREAS , Etta P . Prink is owner of a tract of land at the station of Ione , in Weld County Colorado , which tract is situate in the southeast Quater of Section Seven , Township Two North of Range Sixty-Six West of the 6th P .M. , being about 2 acres , more particularly described as follows : Commencing at a point on the westerly right-of-way line of Union Pacific Railroad Company , which point is Two Hundred ( 200 ) feet distant westerly at right angles from the center line of the main track of said railroad and six hundred fifty ( 650 ) feet north of the south line of said Section Seven ( 7 ) ; thence running northwesterly on said westerly right of way line a dis- tance of Six Hundred Seventy ( 670 ) feet to a point ; thence running westerly at right angles to said westerly right of way line a distance of One Hundred Thirty ( 130 ) feet to a point ; thence running southeasterly at right angles to the last mentioned course and parallel to said westerly right of way line a distance of Six Hundred Seventy ( 670 ) feet to a point ; thence easterly One Hundred Thirty ( 130 ) feet to place of beginning ; containing two ( 2 ) acres more or less . AND WHEREAS , Weld County has heretofore agreed to obtain the right of way for a state highway along the westerly side of Union Pacific Railroad between Ione and the southerly limits of Platteville , Colorado , which highway traverses said parcel of land , and possession of the portion of said land occupied by said highway has been ,: iven to Weld County , Colorado , for the use of said state highway , with the understanding that the award of compensation to be made to Etta P. Frink therefor would be later determined , 208 AND WHEREAS , the parties hereto have been unavle to agree upon the compensation to be paid the said Etta P. Frink for the talking of the land occupied by said highway , being a strip lying thirty feet each side of the center line of the cement pavement of the state highway as now constructed across said parcel of land . AND WHEREAS , it is desired by the parties hereto to settle the matter of said com- pensation for the right to said land occupied by said state highway by arbitration , NOW , THEREFORE , IT IS AGREED That to fully settle the amount of said damage for 11 the taking of first party ' s property for said state highway purpose , the said Etta P . Frink and the Board of County Commissioners of Weld County , Colorado , have agreed to submit the said controversy to arbitrators and to abide by the award of said arbitrators , and that when said award has been made , the said Etta P . Frink will execute quit claim deed to said strip of land occupied by said highway to Weld County , Colorado ; and the said parties , pursuant to the provision of Chapter 26 of the Colorado Code , do hereby submit the question of said compensation to the arbitration of John Birkle , M. R. Deacon , and , The parties hereto agree to abide by the award of said persons as arbitrators ; provided , that if said two arbitrators fail to agree , the said two arbitrators shall select a third , and the three , or any two of them , may arrive at an award , and that when the award is made it may be filed with the Clerk of the District Court of Weld County , Colorado , by the successful party , as a basis of judgment , and judgment may be entered thereon , and execution may be issued for its collection ; provided , however , that said award shall be made in writing , signed by the said arbitrators , and a copy thereof delivered to each of the parties hereto on or before the first day of December , A .
