HomeMy WebLinkAbout20200367.tiffHEARING CERTIFICATION DOCKET NO. 2020-10 RE: CHANGE OF ZONE, COZ19-0004, FROM THE A (AGRICULTURAL) ZONE DISTRICT TO THE 1-3 (HEAVY INDUSTRIAL) ZONE DISTRICT - RICHARD SACK A public hearing was conducted on February 5, 2020, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Steve Moreno, Chair Pro -Tern Commissioner Scott K. James Commissioner Barbara Kirkmeyer Vacant Commissioner Position Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Department representative, Mike McRoberts Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated January 2, 2020, and duly published January 8, 2020, in the Greeley Tribune, a public hearing was conducted to consider the request of Richard Sack, for a Change of Zone, COZ19-0004, from the A (Agricultural) Zone District to the 1-3 (Heavy Industrial) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. S Chair Freeman explained for the applicant and the public, there are four (4) Commissioners present and approval of the application takes three (3) affirmative votes. 'Angela Snyder, Department of Planning Services, presented a brief summary of the proposal, explained the location of the site, and stated 15 referrals were sent out and nine (9) agencies responded. She indicated the applicant requested the COZ to be consistent with adjacent zoning and enhance the market value of the site, and noted the site contains two (2) residential dwellings. She cited the Weld County Code, outlined the uses allowed by permit in the 1-3 (Heavy Industrial) Zone District and entered the favorable recommendation of the Planning Commission into the record as written. In response to Commissioner James, Ms. Snyder clarified the identification markers on the displayed map and provided images of the site and surrounding views. !� Mike McRoberts, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated access is on County Road (CR) 2.5, which is under the jurisdiction of the City of Brighton, and indicated any drainage and/or traffic impacts will be addressed with future Land Use cases. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stated a domestic well provides water to the residences, and there is a septic system permitted to serve both residences. E Richard Sack, applicant, provided the history of property and reiterated the reason for the request, previously stated by Ms. Snyder. No public testimony was offered concerning this matter. Commissioner Kirkmeyer stated she is in support of the COZ, given the uses and zoning in the surrounding area, and made sure the applicant was aware of the U.S Highway 85 Access Management Plan, which allows only for a right -in, right -out access at CR 2.5, and suggested a note regarding this be added to the plat. El In response to Commissioner Kirkmeyer, Ms. Snyder clarified Condition of Approval (COA) #2.D and, after discussion, Commissioner Kirkmeyer suggested changing the language to read, "Any future structures or uses onsite must be approved through a Site Plan Review." Commissioner Kirkmeyer also suggested adding a new COA #2.G to read, "County Road 2.5 is identified on the U.S. Highway 85 Access Control Plan and is limited to right -in, right -out access." 5� In response to Chair Freeman, Mr. Sack indicated he had reviewed, and agreed to abide by, the Conditions of Approval, as amended. Commissioner Kirkmeyer moved to approve the request of Richard Sack for a Change of Zone, COZ19-0004, from the A (Agricultural) Zone District to the 1-3 (Heavy Industrial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as amended. The motion was seconded by Commissioner James, and it carried unanimously.
