As of this date, there are no recent applications for home occupations or home businesses that have been filed with weld County, and no communication has been received by the HOA Board from any homeowner on the topic. There are now income figures in the current 2019-20 fiscal year - by this time of year we can have actuals plus estimated. President Ruof asked several Board members to write down their suggestions for estimating that projected income and she would take those suggestions to Deb Coulson. • Oil and Gas Consultant Ben MacFarlane emailed his oil and gas update PowerPoint to the Board — Discussion. This is not emailled out to the homeowners ahead of time, • The Broadband Committee will be doing a PowerPoint presentation. , Presentation not ready yet. Suggested changes or questions can be handled through email this coming week. This is not emailed out ahead of time. • Secretarys minutes from the 2019 HOA Annual Meeting will be emailed out to Board, please make any suggested edits by email. The final version needs to be +mailed out to homeowners 3 ahead of time. President Ruof will also add them to the final documents to be copied for the annual meeting. • President Ruof needs to get Yearly ACC report from ACC Secretary Stroud to add to documents to be copied. • Deb Coulson will be making a PowerPoint presentation about status of Governing Documents, will be emailed out to Board for suggested edits/changes.. This is not emailed out ahead of time. • Will need to email out some documents to the homeowners before the meeting- financial pages and minutes - Director Hoekstra can do that through MailChimp • President Ruof would like to take in originals on Thursday to be copied - please send back all edits/changes by Wednesday night. We are planning on moving $150,000 total, Need officers to take in identifying information to the bank to be put on signature card. • CPA has filed for an extension on our taxes for this past year, is working on them now, President Ruoff Treasurer Rieke, and Secretary Hersch met with CPA on January 31. Board approved mailing follow-up letter of 3/21/19, No sign of additional repairs/painting but weather was very wet cold; warmed up in summer. A horse loafing shed was moved onto property on 11/28/19 without first submitting plans to the ACC; tenant of homeowner did call President Ruof ACC Chairperson Stroud on 11/27/19 to notify he was moving the shed onto property the next day. He was told that we could not approve him doing that; if the plan was not accepted by the ACC, he would have to remove the shed. Tenant said he would .send required paperwork immediately but did not do so. Tenant called President Ruof on 12/21.19 to discuss the unsightly letter, also discussed the unapproved structure. Email sent to homeowner tenant 12/21/19 with requirements for ACC paperwork, requested response date of 1/3/20. No plan received. I am the Secretary/Chair of the Architectural Control Committee (the "ACC") for the Northmoor Acres Homeowners Association and have been for 19 years. The purpose of this letter is to provide you with information about Northmoor's ACC policy and procedure process, specifically relating to the pole barn plan submitted by Paul and Valerie Tams, to use as storage for classic cars, an RV, a tractor, etc. The plan paperwork was reviewed by the ACC at the February 5, 2020 ACC meeting. There are two things I remember specifically about the plan that was submitted. The first was that the Tams told me that they had already been to Weld County and learned that the size of the pole barn was too big for the property to structure ratio of their lot but that they still wanted to submit this size building to the ACC for review and planned, if approved, to request a variance from Weld County. The second was that Northmoor Acres currently has a 17' height limit for outbuildings and the Tams' plan was for a structure that was 17'2" tall. After discussion with the committee membership and Paul and Valerie Tams, the Tams made the commitment to work with the builder and cut into the ground on the high side/south side of the structure in an attempt to get the peak of the structure as close to 17' high as possible. Having met all the ACC policy and procedure requirements, the structure was approved unanimously by the quorum of the committee membership in attendance. It is important to note that Northmoor Acres does not have a property to structure ratio requirement so this is not something that would keep the ACC from approving a structure or be something we would get involved in. I am aware of only one other structure that was approved in 2019 by the ACC that had property to structure ratio issues with Weld County —Kevin and Ivy Rhoades at 20253 Cactus Drive because they told me. They learned about the property to structure ratio issues when they applied for a permit. They chose not to build the structure that had been approved by the ACC. Page 2 Weld County Planning and Zoning As is my procedure for structures that could impact neighbors, and before finalizing the approval and obtaining Paul and Valerie Tams' signature on the plan paperwork, which must be done within 30 days of the meeting date, I personally spoke to six of the neighbors that I considered the most affected by the structure, meaning, they could have a direct view of the structure. I regularly do this especially for large structures that will be noticed, as I believe it is helpful to the neighbors to know that the structure was submitted to the ACC and received the proper Northmoor approval. It is important to note that the ACC does not solicit neighbors' approval for structures as we do not require neighbors' approval. However, I will say that sometimes we do mitigate/alter the placement of a structure, but not in this case. None of the neighbors that I spoke to expressed a concern or issue with adding the structure to Paul and Valerie Tams' property. Not one of them asked any questions or expressed any objections to the structure. In fact, a couple of them seemed surprised that I was even there making the effort of notifying them about the approved structure. The neighbors I spoke to are: • Brian Kane (direct east neighbor), 5130 Yucca Court —spoke to him personally —the Tams' had already told them about their plan to add the pole barn to the property • Norm Thielbert (direct west neighbor), 5O7O Yucca Court —spoke to him personally he is an ACC member but did not attend the committee meeting —he was already aware of the Tams' plan to add the pole barn when I spoke to him —he was in agreement with his fellow ACC members • Cindy McClain, 503O Yucca Court —spoke to her personally • Brittany Wolf, 5111 Yucca Court —spoke to her personally • Charlotte Schultz, 5131 Yucca Court -spoke to her personally • Cindy Eldenburg, 20O34 Cactus Drive —spoke to her over the phone I was very surprised to learn that approximately 4 weeks later, a petition was submitted to Weld County against Paul and Valerie Tams' structure and even more surprised to learn that several of the property owners/neighbors I had spoken to had signed the petition. I cannot think of a reason why any neighbor would have an issue with or care about the property to size structure ratio of the Tams' structure. In this case, I do not believe it is because of the structure's intended location or because it is obstructing any special view. We have lived is Northmoor Acres for 27 years. We are writing in response to the notice we received regarding a Special Review e in for a building that our neighbors, Paul and Valerie Tarns, wish to build on their property. We are writing to express our --support for approval of -the Tare's application. Paul and Valerie Tarns have lived in Northmoor Acres almost as long as we have. Their home is about 4 houses from our home, on a cut de sac off of Cactus Drive. We see Pau] and Valerie's s house from our house. Over the years, we have watched the Tams make improvements to their home. They have taken great pride and have spent considerable time and money adding value to their property and to the neighborhood. There wil.l.. be no visual impact to our property as the building i ll be behind their home. In addition, it is unlikely that any of the neighbors on their street, willhave very much of a view of the building from their homes because of where the Tarns propose to put it and because of the other structures and existing vegetation.. It will mostly be seen when someone is driving behind the home on County road 42 The building is not larger in size than other outbuildings already in place in Northmoor Acres, it will not he taller, and there is nothing else remarkable about it that we can see,. When, built in compliance with Northrnoor Acres Architectural Control Committee guidelines, the outbuilding will match the home and enhance its value. Paul and Valerie Tams have a beautiful, well cared for home and always maintain their yard. In our opinion, the addition of an outbuilding in the back of the home will not negatively impact either their property, our property, or the properties of their neighbors and we support the approval of the USR, Respectfully, Crirldt r i I -Terse]) ems. I have been a homeowner in Northmoor Acres for 39 years, since 1961. I hove known the Tams since they moved to Northmoor although I am not a close neighbor. They have a beautiful and well -kept property and, in my opinion, have been great assets to the subdivision. I recently became aware that a petition was filed in opposition to the Tams application for this variance, even though the amount of the variance is quite small. The Northmoor Architectural Control Committee/HOA Board has never involved itself in the 4% property to structure ratio that is listed in the Weld County Code, but the petition signers may not be aware of that fact. Over the years, both Paul and Valerie have helped the Northmoor community by being willing to serve on the HOA Board of Directors, an often thankless and maligned job. In the past, HOA Board members have often become targets for disgruntled homeowners when some homeowners became angry about an issue in the subdivision -- the trash company engaged by the HOA, management of water shares, control of loose/aggressive dogs, or enforcement of the Covenants in general. Valerie is currently an HOA Board member and Paul is a past Board member. In summery, I support the variance application that was filed by the Tams.
