No. ...1706841 •�.-------. ..in, Recorder 2RESOLUTION 't ' I WHEREAS, a public hearing was held on October 16, 1972, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Ivan Gilbaugh, 914 8th Avenue, o Greeley, Colorado, requesting change of zone from "A" Agricultural District to "A-UD" Agricultural Unit Development of a tract of land as hereinafter recited, all as appears on plat as submitted and made a part hereof by reference, and WHEREAS, the petitioner was present and represented by counsel, 0 William E. Bohlender, and WHEREAS, there was some opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the • testimony and statements from those present, and WHEREAS, the Board of County Commissioners has studied the recommendations of the Weld County Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, County of Weld, State of Colorado, for change of zone from "A" Agricultural District to "A -UD" Agricultural Unit Development of a tract of land as appears on plat, said area being more particularly described as follows: The West One-Half (WZ) of the Southwest One-Fourth (SWI) of Section Thirty-three (33), Township Seven (7) North, Range Sixty-five (65) West of the Sixth P. M. , Weld County, Colorado, and All that part of the Southwest Quarter (SW4) of Section 33, Township 7 North, Range 65 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Beginning at the Southwest Corner (SW Cor) of said Section 33, Township 7 North, Range 65 West of the 6th P. M. and considering the West line of said Section 33, as bearing North 00° 35' 00" East and with all other bearings con- tained herein relative thereto: Thence North 00° 35' 00" East, 2, 489. 00 feet along the West line of said Section 33; Thence North 89° 30' 00" East 1, 384. 00 feet; Thence South 00° 35' 00" West 2, 547. 40 feet to a point on the South line of said Section 33; Thence North 88° 05' 00" West, 1, 384. 00 feet along the South line of Section 33 to the point of beginning, said described parcels containing 79. 995 acres, more or less, is hereby granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. ( A variance requested on certain block lengths wasc discussed . A letter from /the Town of Firestone was read regarding their con- cern of the development. Mr. Lorenson stated other than the block lengths , they have met all requirements . Street profiles have been approved by the County Engineer. RESOLUTION : Be it therefore resolved to recommend denial to the Board of County Commissioners due to the seepage in the area , the perc- olation tests are not in the area of the homes and the proposed private road. Mr. Paul stated they have had a lot of trouble with the septic tanks in the area . Mr. McLain has bought the dev- elopment and is willing to put in all the sewage facilities and re- commended this be done . The system will have to be approved by the Weld County Health Department and the State Health Department. Mr. McLain stated he will be responsible for the maintenance of the plant. There are approximately 270 dwelling units . Mr. Lorenson stated on the Lochbuie Development submitted and the design criteria is to provide not only sewer service to the existing units , but the proposal is for another 1500 dwelling units or a population of 5250 or a grand total of 6125 . The design is approximately 700% over the existing requirements . If approval is given for this size facility , it should be considered in no way an implication that a new development or new town would be approved . Mr. Mclain said any future development that would be proposed would be on the order of Dacono , the sale of lots and modular units or an incorporated town . No action was taken . SUBJECT : Section 9 of the Subdivision Regulations DISCUSSION: Mr. Lorenson stated the State Land Use Commission requested the term "minor subdivision" be changed to "recorded exemptions " . Mr. Houtchens stated the ditch abuts the back end of the lots and questioned how to make the ditch and residential units compatible. Mr. Hammond presented a letter from Mr. DeGood of the FL.rmer' s Ditch Company. They have met with the developers and have worked out a procedure to resolve any questions . Mt. Olhausen read a letter regarding the comments presented by Mr. Ohi at the previous meeting . Mr. Chotvacs stated in regards to the dedication Mr. Capron of the Highway Department still feels that the Highway Department would request that the 150 ' be dedicated for highway improvement , however they would be amenable to any proposal that they would make and be willing to take it into consideration . He thought consideration should be to the highways . Mr . Chotvacs stated that 34 is a major thoroughfare and access should be con- trolled by some means . Mr. Stobbe stated there is no way they can afford to dedicate the ROW because of economics . Mr. Hammond stated they would agree to a designation on the plat and not platted into lots and they are not trying to increase the value of this designated area . There was discussion regarding substandard lots with less than required lot frontage . These would require excessive front yard set-back to meet the minimum required lot frontage . Mr. Shupe stated they have a meeting scheduled with the ditch company to work out the details of an agreement with them. A letter from Wm. Southard , attorney for the ditch company , was read. Cindy Telep read a note from John Houtchens , attorney for Ray Amen , who objects to the development as it will res ,lt in comments from the inhabitants of the development regarding his cattle feeding operation to the south of the area. He is also concerned about the sewage disposal from the area . Mr. Stobbe stated they feel the design of their treatment plant will be zd- equate and efficient so as to eliminate any seepage. Our suggestion would be that the hydrant near Lot 2 be moved near lot 1 and closer to the barn where there no doubt will be large amounts of hay and feed. The other two hydrants --rather third hydrant should be near lot g or 7. We always recommend that hydrants be no further from structures than 500 feet. The present plan leaves ground outside this recommendation. For future reference on planning divisions and so forth in our district it is well to remamber that a radius of 500 feet is recommended and it is better to overlap, than to leave property outside the 500 feet circle.
