e..pke SW ... .. , r RESOLUTION WHEREAS, a public hearing was held on September 10, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Adolph Coors, Golden, Colorado, requesting approval of site for the construction of a compressor station and related transmission facilities on the following described property, to-wit: A parcel of land situated in Section 25, Township 1 North, Range 68 West of the 6th Principal Meridian, Weld County, Colorado, more particularly described as follows: Beginning at the southeast corner of Section 25, Township 1 North, Range 68 West of the 6th P. M. , thence along the south line of Section 25, South 89° 58' West, 1359. 21 feet to the western R. O. W. boundary of the Union Pacific Railroad, said point being the True Point of Beginning; thence along said right of way North 24° 06' 40" West, 2168. 29 feet, thence South 89° 58' West, 357. 19 feet, thence South 00° 56' West, 664. 82 feet, thence South 89° 58' West, 1092. 41 feet, thence South 00° 56' West, 1255. 15 feet, thence South 89° 58' West, 1494. 55 feet, thence South 29° 22' 56" East, 68. 73 feet to a point on the south line of Section 25, thence along said section line North 89° 58' East, 3827. 47 to the True Point of Beginning, and, WHEREAS, the petitioner was present, being represented by Mr. Lyle Bush, Mr. Quinton Darnell, Mr. Bob Schliem, and by counsel, Walker Miller, of Greeley, Colorado, and WHEREAS, there was no opposition to the request of petitioner for the location of said compressor station and related transmission facilities, and WHEREAS, the said requested location for said compressor station and related transmission facilities is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said compressor station and related transmission facilities may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Adolph Coors, Golden, Colorado, to locate a compressor station and related transmission facilities on the premises indicated above be, and it hereby is granted under the conditions following: PL0763 730562 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2, That petitioner shall proceed with due diligence to effect said construction of a compressor station and related transmission facilities and that it shall have up to one year from date hereof to begin the construction of such facilities; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. Subject to a suitable chain link fence (six (6) ft, high) being erected around the perimeter of the property excepting along the east side which is bounded by the Union Pacific Railroad right of way, 4. Subject to a green belt being established thus screening with a suitable type of vegetation the following perimeters of the property, to-wit: Beginning at a point on the south side of subject property, being a distance of1620 feet, more or less, from the Southwest corner thereof; thence west along the south line a distance of1620 feet, more or less, to the southwest corner; thence north along the west line a distance of 1200 feet, more or less, to a point; thence east and parallel to the south line a distance of 1100 feet to a point; thence north and parallel to the west line a distance of 650 feet to a point on the extreme north line of subject property. That such compressor station and related transmission facilities shall be limited to the items as shown on plans as submitted and attached hereto and made a part hereof by reference, 6. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Lorenson stated there was sufficient funds to raise Mr . Adams ' salary to $640 a month . MOTION : By Mr . Weigand to approve the raise . Seconded by Mr . Nix . A vote of "Aye" by Anderson , Watson , Nix , Heitman and Weigand . Motion carried 918 Mr . Parks asked for an extension on the time required to begin construction . Didn ' t feel he would be able to comply with that particular item. It was suggested that possibly 18 months would be better . Mr . Paul requested that the word "aerated" be stricken from the Wastes Inventory . If approved , also sub- ject to final plans . Item #5 , 47th Avenue is on a section line , therefore , the County automatically has 30 ' on either side of the line . On the east side is a 50 ' dedication for construction of a road . An additional 30 ' is a buffer zone . On the west side of the line , they have a legal right to 30 ' . Still can- not get any response from the owner . Item #1 , if city refuses to serve water , then Central Weld will serve the development . Hill -N-Park will not develop the water system until they know what the system will be . Item #6 , Mr . Ohi stated he felt covenants would be better . Mr . Ohi stated the Planning Com- mission would like a firmer source of water for entire develop- ment. It was suggested the final plat be filed in two filings-- the first one for 190 lots and when water is available for the other 216 , a second filing be made . APPLICANT : Robert Foster CASE NUMBER : S-86 Tape 495 SUBJECT : Replat of Northwest Estates LOCATION : Pt WZ SWQ Sec 29 T7 R67 APPEARANCE : Robert Foster; Dennis Messner , NHPQ DISCUSSION : Main purpose for this replat is to accommodate single family and multiple family dwellings in this filing . There are some minor changes to Lots 7 , 8 and 9 , 11 and 12 . Original lot lines changed in order to allow for 30 ' frontage on the cul -d-sac . The lot line between Lots 11 and 12 has been changed in order that the line follows an existing concrete irrigation ditch . Lot 11C will be an outlot for irrigation purposes with a retention pond . Has not changed the density any. Planning staff recommends approval because the density remains the same as the first plat ; and 2 ) Utility Board has recommended approval . On Item #2 , Mr . Messner and Mr . Ohi have received different opinions from the Co . Engineer whether or not the utility easements should also be properly used as irri - gation easements . Mr . Foster stated that the only reason this had happened was the one line between 6A , B and C and 7A and B and 8A was the only way surface irrigation water could get to the lots . Will probably use pipeline . All the electrical will be overhead , gas is in the street . Carol stated that it would not go against what is presently there . However , according to the regu- lations , it does not comply with land use policy or the pro- posed comprehensive plan . Therefore , the Planning staff recommends denial . Mrs . Burrett , a neighbor , does support this proposed zone change . Mr . Watson asked if Mr . SUBJECT : Lower Latham Reservoir Improvements Tape 494 DISCUSSION : This is basically presented for informational purposes only . Mr . Paul Hoshiko , Bob Bokenkamp and John Haley pre- sented facts and figures concerning the A-95 Review which will be submitted to the Regional Planning Commission . In order to keep the Federal funds , they had to come up with a letter stating they had someone to loan them the necessary money . Original spillway was only 18 ' long . Proposed new one would be 360 ' long . Any modifications of request have to be in by August 6 and funds have to be fully expended and project made useful by May of next year . Capacity of reservoir is approxi - mately 5 ,700 acres . MOTION : By Mr . Nix , To recommend an affirmative A-95 Review to the Regional Planning Commission . Seconded by Mr . Weigand . The date of August 7 was suggested and approved to meet and take the field trip prior to the regularly scheduled meeting . Meeting adjourned . The Planning Commission felt that the County Commissioners ' actions predjudiced the Planning Commission recommendations and that the site approval should be deter- mined in the future before pipeline permits are granted . We concur with the findings and recommendations of Mr. Niles E. Grosvenor who has made an in-depth study of the coal resources of the area. Be- cause of local high density faulting, irregular and steep dips, and thin- ning of the coal, especially in the south part of the section, we do not believe extraction of the coal is economically feasible in the foreseeable future. It is desired that a small domestic supply be secured for personnel use at this site. It is expected that a well capacity of 5 to 10 gpm would be sufficient. Based upon the USGS topo map, State Engineer's Office well registration computer print out and a USGS map I-795, it is not expected that shallow ground water supplies could be obtained as tentatively no sand and gravel would exist, i .e. bedrock should be en- countered at a shallow depth. As of now, the most logical source for a small supply would be the Laramie Foxhills formation which tentatively would lie at a depth from 500' to 750' below ground level . As of the State Engineer's Office January 19, 1972 computer print out, there were no wells constructed in all of Section 25. It might be noted that in Section 27, a 675' Laramie Foxhills well had a water level of 200' and a reported yield of 25 gpm when the well was constructed in November of 1968. For the minimal supply requirements, coupled with the non-tributary nature of the Laramie Foxhills formation, it is anticipated that there should be no problems in obtaining Laramie Foxhills well permit from the State Engineer's Office. After a well is drilled, it is recommended that a complete chemical and physical analysis be made of the well in order to determine if any water quality problems would be present. It has been found in the past that hydrogen sulfide, iron, odor and .taste problems can be encountered, though not frequently, in the Laramie Foxhills formation.
