HomeMy WebLinkAbout20202169.tiffRESOLUTION RE: APPROVE WAIVER OF ANNEXATION IMPACT REPORT REQUIREMENT AND AUTHORIZE CHAIR TO SIGN - CITY OF EVANS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Waiver of the Annexation Impact Report Requirement in conformance with C.R.S. §31-12-108.5(1), of the City of Evans, and WHEREAS, after review, the Board deems it advisable to approve said waiver in adherence to the statue, that states "Such report shall not be required for annexations of ten acres or less in total area or when the municipality and the board of county Commissioners governing the area proposed to be annexed agree that the report may be waived." NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Waiver of the Annexation Impact Report Requirement in conformance with C.R.S. §31-12-108.5(1), of the City of Evans, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said waiver. The Property is legally described in Exhibit A attached hereto and incorporated by reference. The City of Evans owns the Property and intends to use the Property for open space and as part of the City's trail system. The City of Evans Weld County, by and through the Board of County Commissioners of Weld County, Colorado, agrees with this request and hereby waives request the requirement of an impact report.
